High Times, Higher Stakes: Mental Health Impacts In New Recreational Marijuana Legal Landscape, Jason T. Lorenzon J.D., Chris Pezalla, Diana Semilia
National Training Aircraft Symposium (NTAS)
This presentation delves into the societal and mental health consequences arising from the increasing trend of legalizing recreational marijuana. Specifically, we will examine the potential normalization of unconventional behavior among aviation college students, who may grapple with substance use challenges due to stress, sleep difficulties, and the demands of college life. Given the rigorous nature of flight training, prioritizing the mental well-being of pilots becomes imperative.
With the recent legalization of recreational marijuana in Ohio, this presentation integrates insights from Diana Semilia's 2022 study on Kent State Flight Students Ages 19-26. The study's objective was to extract practical recommendations applicable …

"They Are Usually Borderline Homeless": Exploring The Nexus Of Homelessness, Housing Instability, Successful Reentry, And Long-Term Reintegration, Emily Troshynski, Carolyn Willis
Criminal Justice Faculty Research
For previously incarcerated persons, affordable and safe housing options are scarce. Barriers to securing housing include federal mandates (i.e., eligibility requirements) as well as local rules and regulations (i.e., zoning and ordinances). When housing is available, disclosing criminal history on applications impacts individuals’ chances to rent (Philips & Spencer, 2013). A lack of a consistent rental history, no personal and/or employment references, and securing capital to cover security deposits are added challenges. Since parole rules direct ex-convicts not to associate with others that have a criminal record, living with partners, friends, and family members may not be an option. Research …

Servant Leadership: The Change Needed In Law Enforcement, Shane H. Shetler
Servant Leadership: The Change Needed In Law Enforcement, Shane H. Shetler
Doctoral Dissertations and Projects
Servant leadership is a moral-based form of leadership in which leaders place the well-being of followers before their own (Canavesi & Minelli, 2022). It is a theory that has gained increased notoriety over the past several decades. Despite this, there remains a limited amount of empirical research on it and its potential benefits. However, several professions have adopted it, and their results have been positive. Leadership change is needed in many professions, and law enforcement is no exception. The policing profession faces many challenges, such as recruiting quality candidates and retaining existing personnel. Furthermore, the challenges plaguing policing also exert …
Redefining Disproportionate Arrest Rates: An Exploratory Quasi-Experiment That Reassesses The Role Of Skin Tone, Soren G. Brockdorf
Redefining Disproportionate Arrest Rates: An Exploratory Quasi-Experiment That Reassesses The Role Of Skin Tone, Soren G. Brockdorf
Doctoral Dissertations and Projects
The New York Times reported that Black Lives Matter was the third most-read subject of 2020. These articles brought to the forefront the question of disparity in arrest rates for darker-skinned people. Questioning arrest disparity is understandable because virtually everything known about disproportionate arrest rates has been a guess, and virtually all prior research on disproportionate arrest rates is questionable because of improper benchmarking (the denominator effect). Current research has highlighted the need to switch from demographic data to skin tone data and start over on disproportionate arrest rate research; therefore, this study explored the relationship between skin tone and …
“Genocide Of The Soviet People”: Putin’S Russia Waging Lawfare By Means Of History, 2018–2023, Anton Weiss-Wendt
“Genocide Of The Soviet People”: Putin’S Russia Waging Lawfare By Means Of History, 2018–2023, Anton Weiss-Wendt
Genocide Studies and Prevention: An International Journal
This article exposes the political underpinnings of the term “genocide of the Soviet people,” introduced and actively promoted in Russia since 2019. By reclassifying mass crimes committed by the Nazis and their accomplices against the civilian population—specifically Slavic—as genocide, Russian courts effectively engage in adjudication of the history of the Second World War. In the process, genocide trials, ongoing in twenty-five Russian provinces and five occupied Ukrainian territories, present no new evidence or issue new indictments, thus fulfilling none of the objectives of a standard criminal investigation. The wording of the verdicts, and a comprehensive political project put in place …

Out Of State, Out Of Mind: Legal Impact Of Out-Of-State Placement On Foster Youth, Lucy J. Johnston-Walsh
University of Pennsylvania Journal of Law and Public Affairs
The child welfare system, which has also been referred to as the family regulation system, was ostensibly created to protect children who are victims of abuse and neglect. When children are at risk of harm, courts can authorize governmental agencies to remove children from their families and place children in the custody of kin or a variety of other placement settings, including congregate care. Data shows alarming racial disproportionality in that 53% of Black families will be investigated for child abuse, and furthermore, Black children are more likely to be removed from their families than white children. Recent changes to …
What Do Consumers Understand About Predispute Arbitration Agreements? An Empirical Investigation, Roseanna Sommers
What Do Consumers Understand About Predispute Arbitration Agreements? An Empirical Investigation, Roseanna Sommers
Articles
The results of a survey of 1,071 adults in the United States reveal that most consumers do not pay attention to, let alone understand, arbitration clauses in their everyday lives. The vast majority of survey respondents (over 97%) report having opened an account with a company that requires disputes to be submitted to binding arbitration (e.g., Netflix, Hulu, Cash App, a phone or cable company), yet most are unaware that they have, in fact, agreed to mandatory arbitration (also known as “forced arbitration”). Indeed, over 99% of respondents who think they have never entered into an arbitration agreement likely have …

The Long And Short-Run Spatial Impacts Of Trade, Lin Ma, Yunlong Song, Yang Tang
The Long And Short-Run Spatial Impacts Of Trade, Lin Ma, Yunlong Song, Yang Tang
Research Collection School Of Economics
We explore how the spatial impacts of trade evolve over time using a dynamic spatial model that incorporates capital accumulation and skill acquisition. We show that in the short run, the spatial impacts of trade mainly depend on the initial conditions, especially the endowments of physical and human capital across locations. However, in the long run, trade shocks shape the distribution of production factors across space through factor accumulation and migration, resulting in significantly different spatial impacts. In the context of China’s WTO accession, we find that international trade is seven times more effective in driving the population towards coastal …

Challenging Gendered Islamophobia: Empowering Muslim Women Through Cedaw General Recommendation 40 On Leadership, Sarah Kawamleh
University of Pennsylvania Journal of Law and Public Affairs
This Comment examines the intersection of gendered Islamophobia and the empowerment of Muslim women through the Convention on the Elimination of All Forms of Discrimination against Women (CEDAW) General Recommendation 40 on leadership. It begins by addressing the limited understanding regarding Muslim women's experiences within international human rights law frameworks. Through in-depth case studies and analysis, the Comment explores how CEDAW can be utilized to empower Muslim women and combat gendered Islamophobia. It highlights the challenges faced by Muslim women in accessing leadership positions, a struggle that is especially evident in certain countries like France, while also critiquing the limitations …

Temporary Protection In The United States And The European Union: Same Words, Vastly Different Meanings, Maryellen Fullerton
Temporary Protection In The United States And The European Union: Same Words, Vastly Different Meanings, Maryellen Fullerton
University of Pennsylvania Journal of Law and Public Affairs
This Article examines the history and political context of temporary protection in the United States and the European Union, compares and contrasts key components of the different legislative frameworks, and assesses the effectiveness of the temporary protection programs. These programs typically provide an avenue of humanitarian relief to noncitizens by authorizing lawful residence for a time-limited period. When the Russian military invasion of Ukraine in 2022 forced a large portion of the population to flee in search of safety, countries neighboring Ukraine welcomed millions displaced by the attacks, as did countries around the globe. For the first time, the European …
Obstetric Violence And Forced Sterilization: Conceptualizing Gender-Based Institutional Violence, Rangita De Silva De Alwis
Obstetric Violence And Forced Sterilization: Conceptualizing Gender-Based Institutional Violence, Rangita De Silva De Alwis
University of Pennsylvania Journal of Law and Public Affairs
The twenty-first century continues to witness gynecological abuse in the form of forced sterilizations of minority women. In many parts of the world, states weaponize family planning programs as a form of reproductive policy against poor women and women of color, treating women’s fertility as a drain on the state's resources. The first part of this Article discusses how legal systems around the world do little to provide redress for women who are coerced to undergo certain medical procedures during, before, and after childbirth, and give little consideration to their right to bodily autonomy. The second part of the Article …

Data Sovereignty And Trade Agreements: Three Digital Kingdoms, Henry S. Gao
Data Sovereignty And Trade Agreements: Three Digital Kingdoms, Henry S. Gao
Research Collection Yong Pung How School Of Law
For centuries, international lawyers have wrestled with the relationship between national sovereignty and international law. This is also the case of international trade law, where the tension between trade liberalization and national sovereignty culminated in the famous “Great 1994 Sovereignty Debate” between the late Prof. John Jackson and other leading scholars when the WTO came into being. As we enter the digital age, the issue of sovereignty resurfaced once again in the form of data sovereignty. In this paper, I will examine provisions in trade agreements which deal with data sovereignty issues, such as restrictions on data flow such as …

Making Sense Of Making Parole In New York, Alexandra Mcglinchy
Making Sense Of Making Parole In New York, Alexandra Mcglinchy
Dissertations, Theses, and Capstone Projects
For many individuals incarcerated in New York, the initial step toward freedom begins with an interview with the Board of Parole. This process, however, is frequently a complex and challenging one, characterized by repeated denials and extended incarcerations. The disparity in outcomes – where one individual may receive over 20 denials and another is granted parole on their first attempt – highlights the ambiguity and inconsistency in the parole decision-making process. This project aims to clarify the factors that influence parole decisions by concentrating on measurable variables. These include age, race, duration of sentence served, proportion of sentence served, type …
