This paper aims to demonstrate that the terms 'mediation' and 'conciliation' are used to denote a general conciliatory procedure characterised by a 'nonadversary' but a 'cooperative' approach of the parties to a dispute towards reaching a settlement agreement by the assistance of a third neutral. A similarity between these procedures is based on the 'party control' of the proceeding, i.e. on the willingness of the parties to settle their dispute while the mediator or the conciliator only assist the parties in coming to a final agreement. The paper (I) outlines the nature and extent of the dissatisfaction with legal research instruction and demonstrates that the problem predates computer-assisted legal research, (II) presents the history of the debate (focusing on a heated exchange between advocates of a “process-oriented” approach and proponents of the traditional, “bibliographic” methods), and (III) presents the requisite elements of a satisfactory pedagogical model, discussing various issues surrounding each of these elements.

Profit-maximizing bidding in uniform price auction markets involves bidding above marginal cost. It therefore is not surprising that such behavior is observed in electricity markets. Common bidding behavior such as “hockey stick” bids easily are explained by suppliers determining their supply offers to maximize profits. This incentive to bid above marginal cost is not the result of coordinated action among the bidders. Rather, each bidder is independently selecting its bid to maximize profits based on its estimate of the residual demand curve it faces. Modeling The Adoption Rates Of Manufacturing Technology Innovations By Small Us Manufacturers: A Longitudinal Investigation Feb. 2003, Pp. 351-366., Paul Swamidass

This study provides conclusive evidence to support the view that small plants are slower than larger plants to adopt manufacturing innovations. This empirical study based on over 1000 US manufacturing plants engaged in producing discrete products, studies the adoption of manufacturing technologies in small plants relative to large plants between 1993 and 1997.

Under the assumption that small manufacturers are disadvantaged, several federal and state programs have been created to assist small manufacturers in acquiring and adopting manufacturing innovations. Through quantification of technology adoption in small manufacturing firms, this study’s findings reveal which manufacturing innovations are in greater need of …

Unemployment In The European Union: A Dynamic Reappraisal, Marika Karanassou, Hector Sala, Dennis Snower

This paper examines the movements in EU unemployment from two perspectives: (a) the NRU/NAIRU perspective, in which unemployment movements are attributed largely to changes in the long-run equilibrium unemployment rate and (b) the chain-reaction perspective, in which unemployment movements are viewed as the outcome of the interplay between labor market shocks and prolonged lagged adjustment processes. We present an empirical analysis that distinguishes between unemployment movements arising from long-run equilibrium changes and those arising from lagged intertemporal adjustments. This paper is an analysis of Estado Novo´s political ideology, through the study of the magazine Cultura Política: revista mensal de estudos brasileiros, government s official periodic. After having read selected articles, concerning the political organization instituted in Brazil by the Golpe de 37, it was possible to examine intellectuals rationalizations for the building of a strong and centralized national state in Brazil. At the end we could verify the role played by the magazine on the authoritarian regime, realize the burocracy s importance as producers of this ideological discourse, and distinguish some of its characteristics.

First, it seeks to make sense of and explain the evolution of that country’s party system from its early post-war years until today. This paper explores the history and evolution of credit union philosophy. The evolution of credit union philosophy spans nearly 150 years. It’s a story that begins in the middle of 19th century Europe as it was emerging from a long history of feudal relations and tyrannical rule that created “the miserable economic conditions of the period and the realization that people would have to take action themselves if their lives were to improve.”1 The democratic ideals that were so eloquently articulated by classical liberal philosophers such as John Locke and Thomas Hobbes began to be increasingly institutionalized during this time.
