The Narratives Of Cyberspace Law (Or, Learning From Casablanca), Michael J. Madison

Cyberspace scholars have wrestled extensively with the question of the "right" metaphorical approach to the Internet, in order to guide legal and policy decisions. Literary theorists have wrestled with the perception that cyberspace undermines conventional ideas about narrative. This Essay suggests that each group could learn from the other. Cyberspace tells a better story than literary scholars believe, and the lawyers should pay more attention to the narrative attributes of cyberspace. To illustrate the argument, the Essay proposes a specific story framework for cyberspace: the film Casablanca.

Legal scholars, lawmakers and, increasingly, the general public seem to place ever-increasing hope in the potential of law and legal theory, and of enforceable uniform international legal standards. Many appear to believe that identifying and enacting laws and a legal framework that correspond worldwide to human rights will solve the age-old problem of legalized barbarism. The historical propensity of courts, even in democratic states, to legitimate and enable racist policies provides compelling evidence that the current level of faith in law is misplaced.

This article reviews the work of the Special Commission of the Hague Conference on Private International Law, which meet during the first nine days of December 2003 to consider a Draft Text on Choice of Court Agreements. Negotiations originally sought a rather comprehensive convention on jurisdiction and the recognition and enforcement of judgments, with a preliminary draft convention being prepared in October 1999, and further revised at the first part of a Diplomatic Conference in June 2001. Since 1996 there have been 17 reported cases of violence in U.S. schools by children ranging in age from 11 to 18. These cases have prompted an increase in research on risk factors and correlates of aggression. A review of this new literature would serve to highlight common findings and explain discrepancies. In this literature review I will discuss family, peer, and community influences as factors in the development of aggression in children. The purpose of this study was to investigate the response of participants in the first three Stages of Change (SOC) to a preparation stage-tailored intervention to increase fruit and vegetable (F&V) consumption. An on-line survey was delivered to 400 university employees, and included questionnaires about their demographic information, SOC, self efficacy (SE), and decisional balance (DB). One hundred fifty six (39%) responded to the survey. A total of 40 were selected from the first three stages, precontemplation (PC), contemplation (C), and preparation (P), and were assigned into two groups (PC/C and P) with consideration to the best possible matching in …

Only two empirical studies of recess have been extended to children with a diagnosis of attention deficit hyperactivity disorder (ADHD) and only one has included a single-case analysis. In addition, no studies have been found that specifically evaluated the effects of a quiet, indoor break on the classroom behavior of children in general, and children with ADHD in particular. The primary purpose of this study was to evaluate the effects of a recess, break, and continuous classroom schedule on the subsequent classroom behavior of children with a diagnosis of ADHD both when participants did and did not receive stimulant medication. …

In this study I examine the effects of both network structure and network function on the gender role attitudes and division of household labor among Hispanic women. Using a representative sub-sample drawn from the first wave of the National Study of Families and Households, I determine to what extent network processes help explain the gender role attitudes and behaviors of Hispanic women. Specifically, I focus on how embeddedness within a Hispanic community, as well as a woman’s level of social support exchange with kin and non-kin help explain her current gender role attitudes and household labor allocation. This dissertation is a study of the thought of Michael Oakeshott with particular emphasis on his writings about the character of religion and aesthetics. The dissertation as a whole makes the case that a certain moral vision-one informed by religious and aesthetic considerations-lies at the center of Oakeshott's thought and informs his political philosophy. The dissertation begins as an examination of Oakeshott's debts to St. Augustine and to British Idealist thinkers such as F. H. Chronic symptoms of Postconcussional Disorder (PCD) occur in a significant minority of mild brain injury patients. The latest research suggests an interactionistic perspective as the most logical and empirically supported pathogenesis for the development and maintenance of PCD. The interactionistic perspective implicates organic factors in the development of acute symptoms of PCD, and psychological factors in the maintenance of chronic symptoms. Possible psychological factors relevant in the maintenance of PCD symptoms include a grief response, a coping hypothesis, and the development of dysfunctional coping loops. Neuropsychologists are often called upon to conduct psychological examination in the presence of an observer in litigation cases despite research clearly demonstrating altered performance on neuropsychological tests under such conditions. Past research into the social facilitation effect suggests attentional conflict (Baron, 1986; Manstead & Semin, 1980) and increased anxiety (Guerin & Innes, 1982; Guerin, 1983) when observers are present and cannot be monitored. However, this research has found conflicting results depending upon the complexity of tasks and differences in observation condition. Meta analyses point to task complexity (Bond & Titus, 1983) and evaluation apprehension (Guerin, 1986) as important moderators of …

Variation In The Performance Of Speech Acts In Peninsular Spanish: Apologies And Requests, Laura Elizabeth Stapleton

This study examines variations in the performance of speech acts and additional discourse features in situational speech patterns of Peninsular Spanish. Based on studies by Blum-Kulka, et al. (1989), nine situations were created, varying from less severe to more severe, to elicit natural responses for apologies and requests. Forty participants from Castile and Andalusia were interviewed, and the data were coded to examine the differences in speech act realizations and the use of specific discourse features. This work seeks to define, explain, and place into historical and social context the phenomena of Christian Repertory Theater (CRT). It does so by examining three CRT troupes: Acts 2 from Nashville, TN, sponsored by Two Rivers Baptist Church; The Company from Fort Worth, TX, sponsored by Southwestern Baptist Theological Seminary; and Gen X from Clinton, MS, which operated independent of external support . Ethnographic fieldwork was the primary vehicle of information-gathering in this case study analysis. The author experienced each group as either a participant-observer, observer, and/or interviewer. This dissertation examines media coverage of two social protests set more than three decades apart – “The March on the Pentagon” in October 1967, part of the anti-Vietnam war movement and “The Battle for Seattle” in November-December 1999, part of the movement for democratic globalization. Through two separate studies – a content analysis of print media coverage and qualitative in-depth interviews with journalists – this dissertation looks for patterns of sourcing and framing between the coverage of these two protests. The Behavior Analysis Services Program provides behavioral services, in the form of parenting classes and individualized assessments and treatments, to children and caregivers receiving child welfare services throughout the state of Florida. The program has many goals, including decreasing placement disruptions and increasing parenting skills. This study was a preliminary evaluation of the program that is now in its fourth year. First, characteristics of both foster children and foster parents that were associated with differential levels of placement disruptions were identified. It is critical for the depressive symptoms of adolescents to be recognized, evaluated, and treated. Depression can increase the risk for illness and interpersonal difficulties in the future and affect almost every aspect of an individual’s life. Self-report measures are often utilized to assess depression, and when these measures are able to effectively detect depression, diagnosis and treatment are expedited. School psychologists have increased their practice of consultation within the schools due to mandates by the National Association of School Psychologists (NASP) and positive outcomes associated with the service. Previous research has examined how training directors at school psychology graduate programs viewed consultation training. The current study investigated how school psychologists view their training in consultation and how they view the practice of consultation in school systems.

A random sample of 510 school psychologists from across the country was sent a survey to obtain their perspectives on consultation. A 46% return rate was achieved. The respondents were divided into two …

The paper investigates the development of party finance and party finance legislation in Germany and Italy. The main claim of the paper is that the differences between German and Italian party finance reflect differences in the party finance legislation enacted in the two countries, which, in their turn, are a result of how the German and the Italian constitutional principles were translated into practice.

A recent survey conducted in a sample of 83 countries by the Inter-Parliamentary Union in collaboration with the World Bank Institute on the Relations between the Legislature and the Executive in the Context of Parliamentary Oversight allows cross-national comparison for the role of legislatures in the budgetary process. One of the survey’s most significant indications is that legislatures in presidential systems are generally more involved in the preparation of the budget than legislatures in either parliamentary or semi-presidential systems.
