Finding International Law: Rethinking The Doctrine Of Sources, Harlan G. Cohen

The doctrine of sources has served international law well over the past century, providing structure and coherence during a time when international law was expanding rapidly and dramatically. But the doctrine's explanatory power is increasingly being challenged. Current doctrine tells us that treaties are international law; empirical evidence, however, suggest that treaties are poor predictors of state practice. The expansion of the international community, the rise of human rights, developments in international legal theory, and the international system's need to adapt to changing circumstances, have all also put pressure on the reified role of "treaty" in identifying rules of international …

In One Ear And In The Other: The Net Effect Of Advertising Frequency, Brent Andrew Wiethoff

This research used both quantitative and qualitative methodologies to explore the possible effects and functions that advertising may perform in developing individuals' attitudes. Using the Elaboration Likelihood Model (Petty & Cacioppo, 1984) and Cultivation Theory (Gerbner, 1979), advertising is viewed as a frequently repeated, consistent set of messages that reinforce consumer ideas and values. The net effect of advertising is examined through focus group discussion of high-media/high-materialist individuals. Results of the study show four themes emerging from advertising (advertisements as an entrance to participation in culture, advertisements as a landscape, advertisements as validation and legitimacy, and advertisements as need-generators). Introduction This study is an analysis of associations between optimism and other psychological well-being indicators among people over age 65 in the U.S. The analysis is based on a stratified random sample collected in 2001 (Wave 1) with a 2004 follow up (Wave 2). The original survey was restricted to African American and Caucasian respondents who were "Christian." The purpose of this study is to provide social workers a better understanding of the function of well-being, particularly optimism, among older people. Treatment for cancer has been indicated to negatively impact the quality of life for patients. Specifically, chemotherapy has been associated with fatigue, nausea, and peripheral neuropathy. More recently, chemotherapy has also been found to be related to cognitive impairment in various cognitive domains including working memory, information processing speed, and visual attention. At this time, the mechanisms underlying this impairment are not understood and there is currently no treatment for this condition. Sex And Shock Jocks: An Analysis Of The Howard Stern And Bob & Tom Shows, Lawrence Soley

Studies of mass media show that sexual content has increased during the past three decades and is now commonplace. Research studies have examined the sexual content of many media, but not talk radio. A subcategory of talk radio, called “shock jock” radio, has been repeatedly accused of being indecent and sexually explicit. This study fills in this gap in the literature by presenting a short history and an exploratory content analysis of shock jock radio. The content analysis compares the sexual discussions of two radio talk shows: Infinity’s Howard Stern Show and Clear Channel’s Bob & Tom Show.

The Change In Corporate Transparency Of Korean Firms After The Asian Financial Crisis: An Analysis Using Analysts' Forecast Data, Jinho Chang, Young Jun Cho, Hyun-Han Shin

Using analysts' forecast error and forecast dispersion of firms covered by the I/B/E/S database, this study examines the change in information asymmetry of Korean firms around the financial crisis of 1997. Results show that the information asymmetry of Korean firms is lower after the financial crisis than before, implying that corporate transparency did, in effect, improve with the change in business environment. In addition, this study finds that chaebol firms have higher information asymmetry than non-chaebol firm, and also that the corporate transparency improvement of chaebol firms is not higher than that of non-chaebol firms in the post-crisis period despite …

Women in the first decade of the 21st century encounter competing ideologies of traditional femininity and empowered femininity. Language, in particular Discourse Analysis, provides a means for investigating what these ideologies, or discourses, are and how they are perpetuated. One source of language which encodes and perpetuates ideologies of femininity is women's magazines. As pervasive, monthly texts directed specifically at women, women's magazines provide a rich source of contemporary ideologies of femininity. Very little attention has been paid to how well these seceded states fared at self-governance. This thesis proposes a theory to explain the behavior of the governments of seceded states and examines three variables to determine how politically stable seceded states may be. Illegal immigration is one of the most divisive domestic policy issues facing the United States and one could argue the absence of a solution may stem from a misunderstanding of how the public feels about illegal immigration. This survey explores the attitudes people have towards issues surrounding illegal immigration. The results indicate that attitudes towards illegal immigration vary according to demographics, but they also suggest there is more agreement over the issues than disagreement, regardless of demographics.
