This article examines the negotiations towards a Comprehensive Economic and Trade Agreement (CETA) between Canada and the European Union (EU) as an example of some challenges and solutions for implementing international trade agreements in multilevel federal systems. It briefly describes Canadian constitutional law governing the domestic implementation of international treaties and then canvasses three specific examples of current challenges related to the regulation of intellectual property. While the constitutional validity of federal regulations addressing pharmaceutical data protection, digital rights management (DRM), and geographic indications is far from guaranteed, legislators and courts have used several legal means to support implementation of …

Governments around the world are betting heavily on biofuels as one part of a solution to a wide range of public policy challenges, from environmental sustainability in the face of climate change, to energy security given rising geopolitical instability, to economic growth especially in rural regions and developing countries. Policy interventions typically take the form of legal and regulatory measures, for example, to drive demand for renewable fuels through mandates, or to subsidize costs through financial and other supports for production and processing of feedstock and output fuels. Between Hope And Racial Battle Fatigue: African American Men And Race-Related Stress, William A. Smith, Man Hung, Jeremy D. Franklin

Decades of empirical research has provided valuable evidence that racism is experienced as a stressor which can have a negative influence on the mental, emotional, and physical health of People of Color. The purpose of this study is to assess how hope, as a form of coping, mitigates the weight of racial microaggressions, societal problems, and mundane extreme environmental stress among 670 African American men. Using structural equation modeling, we find that for African American men, hope is like a pendulum that can intensify their racial battle fatigue or lessen it if it is not managed effectively. Price Discrimination Through Refund Contracts In Airlines, Diego Escobari, Paan Jindapon

This paper shows how an airline monopoly uses refundable and non-refundable tickets to screen consumers who are uncertain about their travel. Our theoretical model predicts that the difference between these two fares diminishes as individual demand uncertainty is resolved. Using an original data set from U.S. airline markets, we find strong evidence supporting our model. Price-discrimination opportunities through refund contracts decline as the departure date nears and individuals learn about their demand.

The historical experience of Latino communities is marked by segregation, poverty, and discrimination. Through a critical understanding of the effects of cultural, economic, and governance processes on urbanization patterns, placemakers start to reverse these effects in the contemporary moment. This chapter presents an account of the challenges, opportunities, and agents of change in the three historical periods of pre-Second World War, post-war, and in contemporary Latino communities, with a focus on Mexican Americans in the US Southwest.1 As with black communities in the South, for decades urban planning facilitated the segregationist management of Latino neighborhoods and proceeded unabated through the …

This essay shows the importance of placing Occupy Wall Street (OWS) in a global context of preceding social movements protesting against oppressive conditions from certain social groups. In particular, it suggests the opportunity that OWS has for thinking on and learning from Latin-American contestation and political projects against neoliberalism and in struggle for the rights of latina/os and immigrants in the United States. The Porto Maravilha Studio represents the work of seven Masters in Urban Planning students from Columbia University Graduate School of Architecture, Planning and Preservation with the guidance of their instructors. En este trabajo, se estiman los efectos distributivos de eliminar el tratamiento diferencial de ingresos empresariales respecto a los ingresos individuales en el sistema tributario Chileno, así como también, de eliminar la principal exención existente en el impuesto al ingreso de las personas: ahorro previsional voluntario. En el caso de esta exención, los resultados muestran que si bien quienes la usan son mayoritariamente personas de mayores ingresos, su eliminación no aumenta la progresividad del impuesto al ingreso. En el caso de la eliminación del tratamiento tributario favorable a los ingresos corporativos, los efectos distributivos son importantes en magnitud y el …

In sixteenth-century Antwerp, commercial contracts were supported with refined government-made rules that brought techniques, usages and customs practised by merchants to the level of sophisticated law. Because no body of unwritten substantive law on commerce existed and because commercial practices were often too rudimentary from a legal perspective, in the 1500s detailed and balanced normative precepts on contracts of trade came to be crafted. When in the first decades of the sixteenth century more and more foreign merchants visited Antwerp, its rulers gradually started supplementing and upgrading practices of merchants to default rules regarding contracts, with materials and concepts drawn …

The study traces the evolution of illicit financial flows from Mexico over the 41-year period 1970-2010. While such outflows have increased throughout the four decades, the pace picked up in the post- compared with the pre-NAFTA period. Furthermore, in spite of the somewhat erratic nature of the outflows over time, there is a discernable pattern to these outflows in the years leading up to the macroeconomic crises and their aftermath. We develop a dynamic simulation model that examines the interactions between fiscal developments, monetary expansion, and the generation of inflation on the one hand and on the interactions between the …

In this paper, the author attempts to explain why there is no Green Party in the northern part of Cyprus. Since the public opinion surveys give a blurred picture to the researcher trying to solve the puzzle, the author relies on in-depth qualitative interviews. Findings suggest that the Cyprus problem, economic problems and low trust in the output legitimacy of the system are the main variables to explain Green Party absence in northern Cyprus. The impact of strong emotions or mood on decision making and risk taking is well recognized in behavioral economics and finance. Yet, and in spite of the immense interest, no study, so far, has provided any comprehensive evidence on the impact of such emotions on financial contracts and particularly on debt contracts. This paper provides the theoretical framework to study the impact of mood on financial contracting.

Edward Glaeser’s TRIUMPH OF THE CITY is a love letter to cities and to New York City in particular. This Article examines ways that governments can mitigate the economic damage caused by the drug war. Part I details four specific legal reforms enacted in Colorado, which aim to reduce the problems of over-criminalization: Requiring a fiscal note for the creation of new statutory crimes; reducing drug possession from a felony to a misdemeanor; narrowing the scope of 'three strikes' laws, and; adjusting old sentences in light of new laws.
Part II explores the fiscal benefits of ending prohibition, such as reduced law enforcement costs and substantially increased tax revenues.

Abstract: This Article chronologically reviews the British gun control which precipitated the American Revolution: the 1774 import ban on firearms and gun powder; the 1774-75 confiscations of firearms and gun powder, from individuals and from local governments; and the use of violence to effectuate the confiscations. It was these events which changed a situation of rising political tension into a shooting war. Each of these British abuses provides insights into the scope of the modern Second Amendment.
From the events of 1774-75, we can discern that import restrictions or bans on firearms or ammunition are constitutionally suspect — at least …
