Criminal Labor Law, Benjamin Levin

This Article examines a recent rise in suits brought against unions under criminal statutes. By looking at the long history of criminal regulation of labor, the Article argues that these suits represent an attack on the theoretical underpinnings of post-New Deal U.S. labor law and an attempt to revive a nineteenth century conception of unions as extortionate criminal conspiracies. The Article further argues that this criminal turn is reflective of a broader contemporary preference for finding criminal solutions to social and economic problems. Christian librarians are exhorted to consider the role of providing encouragement, care, and emotional and spiritual support to college students. Caring for the whole student can have a positive impact on college student success and retention, as well as have a transformational effect on students’ spiritual lives. By treating college students as whole persons created in the image of God, Christian academic librarians can not only help these students succeed by meeting their academic needs, but also help students thrive by supporting them emotionally and spiritually.

Business entities play important and underappreciated roles in the production of international treaties. At the same time, international treaty law is hobbled by state- centric presumptions that render its response to business ad hoc and unprincipled.
This Article makes three principal contributions. First, it draws from case studies to demonstrate the significance of business participation in treaty production. This dissertation presents a theory of the separation of powers centered on the President’s “power to persuade.” To meet the imperial public expectations placed on the office in the modern age, the President will reliably try to supplement his limited formal powers by convincing others to support his agenda, the people, party allies, and courts being the most important. The President’s techniques of persuasion fall into three regular categories. First, there is “going public,” or popular leadership, where the President turns the force of popular majorities into a tool for shaping policy or legislative outcomes. When does a right to privacy become a right of censorship? Conversely when does freedom of speech become a carte blanche to violate the dignity and autonomy of others? Discussions of privacy throughout the world frequently boil down to these questions. Despite the parallel relationships between privacy and speech in the United Kingdom and America, and despite their shared legal heritage, the two legal systems have struck the balance in radically different ways. Trust is beautiful. The willingness to accept vulnerability to the actions of others is the essential ingredient for friendship, commerce, transportation, and virtually every other activity that involves other people. It allows us to build things, and it allows us to grow. Trust is everywhere, but particularly at the core of the information relationships that have come to characterize our modern, digital lives. Relationships between people and their ISPs, social networks, and hired professionals are typically understood in terms of privacy. In our inevitable big data future, critics and skeptics argue that privacy will have no place. We disagree. When properly understood, privacy rules will be an essential and valuable part of our digital future, especially if we wish to retain the human values on which our political, social, and economic institutions have been built. It can be challenging to forge connections between an academic library and undergraduate art students, who are often heavily engaged in beginning studio practice and may only associate the library with the more traditional research done by other disciplines. One way to overcome this challenge is to change their perceptions of the library through programming that demonstrates that the library can be a site for exploration, inspiration, research, and innovation by artists. In 2014 librarians at the Claremont Colleges Library piloted a 2-part workshop series that gave graduate students the opportunity to closely read a primary source as artifact, explore related digital primary sources, identify interesting research questions, and find secondary scholarship that spoke to those questions. This Primary Source Workshop series was developed collaboratively by special collections librarians, subject liaison librarians, and graduate faculty. The series has since been adapted for a variety of graduate and undergraduate classes. Lobbying in Israel was unregulated for 60 years. Scholars have decried the fact that high value is attached to the written decree, but implementation does not necessarily follow: quite a few laws have remained at symbolic level in Israel. There were two unsuccessful bills submitted to legislate lobbying regulation: first by Knesset Member (MK) Merom in 1993 and the second one by MK Naot in 2001. The bill submitted by MKs Yechimovich and Sa'ar in 2007 resulted in passing the Israeli lobbying regulations in 2008, but the Lobbyist Law displayed unexpected characteristics, and there was a 500% growth in lobbyist …

Antipsychotic sensitization and tolerance refer to the increased and decreased drug effects due to past drug use, respectively. Both effects reflect the long-term impacts of antipsychotic treatment on the brain and result from the brain’s adaptive response to the foreign property of the drug. In this review, clinical evidence of the behavioral aspect of antipsychotic sensitization and tolerance is selectively reviewed, followed by an overview of preclinical literature that examines these behavioral characteristics and the related pharmacological and nonpharmacological factors. The relationship between attention deficit hyperactivity disorder (ADHD) and obesity in children has received considerable attention in recent years. However, the literature currently overlooks the potential causal and maintaining role that sleep problems may play in this relationship. Using a biopsychosocial framework, this article highlights how sleep problems impact the biological, psychological, and social aspects of both ADHD symptomatology and obesity. An in-depth examination of this model illustrates the imperative need for future research and clinical practice to recognize and explore the role sleep has in the link between obesity and ADHD symptomatology.

Spatial symbols can generate attentional biases toward peripheral locations compatible with the symbol’s meaning. An important question concerns how one symbol is selected when competing symbols are present. Studies examining this issue for spatially distinct symbols have suggested that selection depends on the task goals. In the present study, we examined whether the influence of competing symbolic stimuli (arrows) at different levels of structure on attentional control also depends on the task goals. Participants made simple detection responses to a peripheral target preceded by a spatially uninformative compound arrow (global arrow composed of local arrows). Neoclassical economic theory has long been scrutinized for its failure to be congruent with reality, often lacking generality and tractability due to, what many critics argue to be, unrealistic assumptions. Partner psychological aggression has been shown to be positively correlated with psychological distress and low self-esteem for women. This study adds to the existing literature by including research on men since very little research had been done on the effects of partner psychological aggression and the self-esteem of men. However, there were a limited number of men who participated in this study and who endorsed experiencing partner psychological aggression. An influential conventional wisdom holds that oil causes intrastate conflict and that oil in particular explains the prevalence of domestic political violence in the Muslim world. I show that the relationship between oil and intrastate conflict in the empirical literature is more ambiguous than commonly assumed. I test to see if the various measures of the oil resource predict any dimension of intrastate conflict in the Muslim world. My results show oil resources are associated with lower levels of civil conflict, repression and terrorism in Muslim-majority countries. In recently years, there has been a dramatic increase in the use of online dating websites among adults over age 50. Nevertheless, samples collected in existing literature are mainly centered on White/Caucasian Americans. Furthermore, the only theoretical guide has been sexual strategies theory. This study fills the gap by using sexual strategies theory and acculturation theory to test Chinese American older adults dating preferences.

Men's athletics is often viewed as an environment where hegemonic masculinity is perpetuated, though some believe this environment provides a safe space for men to break away from hegemonic masculinity. This study was designed to gain an understanding of how male student-athletes experience masculinity and how the context of athletics influences meaning-making about masculinity. Using a phenomenological approach, the researcher interviewed five male student-athletes and observed the practice sessions of two different teams. The participants were student-athletes of junior or senior status from the following sports: tennis, soccer, swimming, baseball, and basketball. In spite of the fact that pain is an unpleasant experience that is generally avoided, recent research suggests that there may be some positive conquences of experiencing pain, including a reduction in negative affect. Better understanding of the mechanisms that allow pain to reduce negative emotions is important for the study of emotional functioning across populations. The current studies tested whether pain disrupts the link between rumination and negative affect, as suggested by the emotional cascade theory. Organized by their level of analysis, these areas are Latin America (at the System-Level-of Analysis), Colombia (at the State-Level-of-Analysis), and the city of Cartagena (at the Sub-National-Level of Analysis). Eyewitness testimony plays a crucial role in the justice system. Misidentification from eyewitnesses was reported in 70% of 300 DNA exonerations of wrongfully convicted individuals (Wixted et al., 2015). Similarly, many convicts can also be set free because of juror’s faulty eyewitness recall during examination. Previous research indicated that females are more reliable in recall than men. However, these findings were not extensively examined with regards to time delay prior to the trial. The purpose of this study is to measure the message terror organizations hope to convey using the financial markets as a proxy of measurement to determine patterns within the marketplace and the effects on the terrorists’ ability to deliver a desired message due to the increased use of digital devices and access to instantaneous news, seen over the past decade. The idea that free will may be an illusion has been a source of great concern. It has led to suggestions that it may be wise to avoid public discussion of this topic lest it lead to a general moral decay. This concern has seemingly been supported by research demonstrating that individuals, when primed with the notion they lack free will, tend to cheat more and prefer less retributive punishment.
