For the criminal defendant, his attorney acts as his loyal and zealous advocate before the court (American Bar Association, 2015), and due process protections of the U.S. adversarial system have afforded this relationship special privilege. In this chapter, we explore the influence and role of the attorney in plea decision making. We first explore the legal context of the attorney’s role in plea bargaining, reviewing several cases that address a defendant’s right to effective assistance of counsel. We then review the shadow of trial theory and other theoretical perspectives as they relate to the attorney’s role in the plea-bargaining process, …

Small Business Lending And Social Capital: Are Rural Relationships Different?, Robert Deyoung, Dennis Glennon, Peter J. Nigro, Kenneth Spong
The Journal of Entrepreneurial Finance
We test whether rural versus urban location, and the amount of social capital present in those locations, influence the performance of Small Business Administration (SBA) 7(a) loans originated between 1984 and 2012. On average, we find that rural loans are about 11% less likely to default than urban loans, and that a standard deviation increase in social capital reduces default by about 5%. Surprisingly, these two effects are largely independent of each other, even though social capital is substantially higher in rural places than in urban places. Our findings advance the small business lending literature and offer insights for a …

The Public Choice Of Public Stadium Financing: Evidence From San Diego Referenda, Candon Johnson, Joshua Hall
The Public Choice Of Public Stadium Financing: Evidence From San Diego Referenda, Candon Johnson, Joshua Hall
Faculty & Staff Scholarship
Abstract: Local politicians and team owners frequently argue that the public financing of stadiums is important for local economic development. The sports economics literature, however, has largely found that new professional sport facilities do not generate any new net economic activity. We provide context to this literature by exploring the public choice in the public financing of stadiums. In 2016, San Diego had two ballot measures related to the San Diego Chargers. Measure C would allow officials to raise hotel taxes to pay for a new downtown stadium for the Chargers. Measure D would also raise hotel taxes, but explicitly …

Treatment of father daughter incest (FDI) survivors using the victim advocacy/child welfare approach to FDI that predominates today in the US has never been compared to results in untreated control subjects in any published report. In the present study, thirty-two survivors of FDI who received treatment based on the victim advocacy/child welfare approach to FDI were compared to 32 control subjects who did not receive treatment. No significant differences were found using analysis of variance on 21 scales and subscales. Statistical analysis of the data from all 64 of the FDI survivors showed that items reflecting a poor self-image and …

This research is part of a larger study of police crime—that is, crime committed by nonfederal sworn law enforcement officers with general powers of arrest—across the United States. In 2014, after several fatal on-duty police shootings garnered national media attention, our principal investigator, Philip Stinson, conducted a joint research project with The Washington Post to count the number of police officers charged with murder or manslaughter resulting from an on-duty shooting where the officer shot and killed someone. The results of the joint research project were published in The Washington Post on April 12, 2015, and The Washington Post was …

Orangutan pelves commonly exhibit a large, projecting tubercle in the iliopubic region, historically assumed to homologous to the pubic tubercle in humans. However, it is not clear whether this tubercle is a unique feature of Pongo, or if it is anatomically homologous with the human pubic tubercle when considered as a soft tissue attachment point. To clarify this issue, we dissected orangutan and other ape cadaveric specimens to evaluate the pelvic brim soft tissues and how they may relate to the tubercle (when present). We additionally conducted a broad osteological survey of pelvic brim morphology across 28 primate genera …

Opportunity theories of crime emphasize the non-random spatial and temporal patterning of criminal events. Such theoretical development has proven useful when extended beyond traditional applications to crime event data. This study continues to explore the wider utility of such criminological theories by examining the spatio-temporal patterns of vehicle fires through an opportunity lens. Specifically, we explore the patterns associated with different types of vehicle fires, and consider longitudinal socio-economic trends that may influence the perceived costs and benefits associated with crimes committed with the intention of escaping debt, such as vehicle arson. Data for this study were obtained from Surrey …
