A Matter Of Interpretation? Understanding And Applying Mediation Standards For The Cross-Border Enforcement Of Mediated Settlement Agreements, Dorcas Quek Anderson

This article focuses on the future role to be played by mediation standards in view of the signing of the Singapore Convention on Mediation. It argues that the convention has elevated the standing of mediation standards from soft regulatory codes to quasi-legal grounds impacting the enforcement of mediated settlements. However, the inherently generalized nature of mediation standards does not render them amenable to contextualized interpretation. More significantly, the courts may adopt the wrong frame when construing mediation standards. It is therefore imperative that the mediation community find ways to bridge frames and facilitate the cross-border understanding of standards.

Recent theorizing and empirical evidence suggesting thatsituational judgment tests (SJTs) are more context-independent than previouslythought has sparked a debate about the role of situation descriptions in SJTs.To contribute to this debate and add to our understanding of how SJTs work,this paper conceptually embeds SJT performance in a situation construal modeland examines the effects of situation descriptions on the construct saturationand predictive validity of SJT scores, as well as on applicant perceptions.Across two studies (N = 1,092 and 578) and different SJTs, personality andcognitive ability were equally important determinants of SJT performance regardlessof whether situation descriptions were presented or omitted. In this paper we build a search model with asymmetric information regarding houses' energy efficiency. The objective is to shed light on the house owners' incentives to disclose energy certificates (ECs) in the rental market. Such incentives depend not only on the rent premium for more efficient houses - as previously documented - but also on the implicit rent penalty for unlabeled houses. Interestingly, we show that such a penalty is higher the greater the disclosure rate of ECs in the local market. Objectives: To determine whether exposure to an epidemic is associated with better health behaviors.

Methods: Using nationally representative survey data collected in 2011 and 2014, we identified middle-aged and older Chinese adults whose communities experienced an outbreak of the 2002–2004 severe acute respiratory syndrome (SARS). We estimated logistic models of health behaviors in the years after the SARS epidemic.

Results: Compared to those who lived in communities not hit by the epidemic, respondents who lived in communities with a SARS outbreak in 2002–2004 were more likely to get a physical examination in 2010–2011 and have their blood pressure checked and …

This study examines the effects of priming, situational factors, and attitudes on deadly force decision making. A small sample of undergraduates completed high-fidelity deadly force simulations. Simulation results were compared across experimental conditions and various attitudinal and demographic factors. Participants were generally accurate when assessing the threat posed by suspects. Participants primed to expect a threat were more accurate in their decisions but were no more likely to shoot an unarmed suspect. Participants were more accurate when responding to unarmed suspects. Participants more likely to exhibit implicit bias were less accurate. Several attitudinal and demographic traits were associated with deadly …

This study will assist in understanding the extent to which sport-relevant thoughts and emotions impact depression and anxiety in collegiate athletes. Stereotype-consistency bias refers to the idea that people tend to remember stereotypical information about others better than non-stereotypical information (Fyock & Stangor, 1994). Limited research has examined how people may use stereotype-consistency bias when recalling information about LGBT characters in narratives (Bellezza & Bower, 1981; Clark & Woll, 1981; McGann & Goodwin, 2007; Snyder & Uranowitz, 1978). The impact of stress on eyewitness recall and identification accuracy has been studied extensively but with somewhat inconsistent results. Understanding the effects of stress are important if they are to be generalized to victims or witnesses of real crimes. This study consisted of two experiments that used an extreme haunt and a haunted house to examine attendees’ ability to recall details of and identify actors encountered, as a function of state anxiety and in the context of Deffenbacher’s (1994) catastrophe model of memory performance under anxiety. Objective: Animal and human data indicate that fluctuations in ovarian hormones (e.g., estrogen and progesterone) across the estrus/menstrual cycle drive changes in eating behavior. Post-ovulatory phases (i.e., mid-luteal and pre-menstrual in women) correspond to distinct ovarian hormone profiles (i.e., low estradiol or high estradiol coupled with high progesterone) that are known to have stimulatory effects on eating behavior and have been associated with increased risk for emotional eating and binge eating. Relational aggression involves the aggressor harming the victim’s social status, reputation, and/or relationships. This form of aggression is a relatively new topic in the literature that would benefit from additional research with emerging adults. The present study examined two models involving relational aggression in a college student sample (N= 247). First, we predicted, based on the general aggression model, that anger rumination would partially mediate the relationship between trait anger and relational aggression. Adolescent externalizing behaviors have consistently been related to both poverty and family dysfunction within the psychological literature; however, the distinction between the effects of objective poverty and perceived poverty on adolescent behavior is relatively new. The current study aimed at understanding the relationship between adolescents’ perceived poverty and their engagement in externalizing behaviors.
