Public Reason As Higher Law, Gordon D. Ballingrud
Public Reason As Higher Law, Gordon D. Ballingrud
Gordon D Ballingrud
This paper presents a model of higher-law formation by employing a modified version of John Rawls’ idea of public reason. The model specifies a theory of public reason that combines the procedural and substantive aspects of public reason, and extends the concept over a third dimension, time. This concept, by virtue of its multi-generational democratic pedigree, forms a repository of political and legal concepts of justice that conform to the duty of civility, and the broad consensus on political and legal norms required of the content of public reason, which forms the overlapping consensus. Thus, public reason as higher law …

Decoding Prejudice Toward Hispanics: Group Cues And Public Reactions To Threatening Immigrant Behavior, Todd K. Hartman, Benjamin J. Newman, C. Scott Bell
Todd K. Hartman
Consistent with theories of modern racism, we argue that white, non-Hispanic Americans have adopted a “coded,” race-neutral means of expressing prejudice toward Hispanic immigrants by citing specific behaviors that are deemed inappropriate—either because they are illegal or threatening in an economic or cultural manner. We present data from a series of nationally representative, survey-embedded experiments to tease out the distinct role that anti-Hispanic prejudice plays in shaping public opinion on immigration. Our results show that white Americans take significantly greater offense to transgressions such as being in the country illegally, “working under the table,” and rejecting symbols of American identity, …
Social Dominance And The Cultural Politics Of Immigration, Benjamin J. Newman, Todd K. Hartman, Charles S. Taber
Social Dominance And The Cultural Politics Of Immigration, Benjamin J. Newman, Todd K. Hartman, Charles S. Taber
Todd K. Hartman
We argue that conflict over immigration largely concerns who bears the burden of cultural transaction costs, which we define as the costs associated with overcoming cultural barriers (e.g., language) to social exchange. Our framework suggests that the ability of native-born citizens to push cultural transaction costs onto immigrant outgroups serves as an important expression of social dominance. In two novel studies, we demonstrate that social dominance motives condition emotional responses to encountering cultural transaction costs, shape engagement in cultural accommodation behavior toward immigrants, and affect immigration attitudes and policy preferences.

Job Insecurity Isn't Always Efficient, David J. Balan, Dan Hanner
Job Insecurity Isn't Always Efficient, David J. Balan, Dan Hanner
David J. Balan
Workers value job security. If at least some workers value it enough, then it is efficient for at least some firms to adopt policies in which they commit (implicitly or explicitly) not to dismiss employees except for “just-cause,” as opposed to policies in which employers are free to dismiss employees “at-will.” In this paper, we develop a simple model in which the equilibrium distribution of workers between just-cause firms and at-will firms is not generally efficient: there can be inefficiently many workers in just-cause firms or inefficiently few. If there are inefficiently few, then a tax or even a ban …
Bargaining In Hospital Merger Models, David J. Balan, Keith Brand
Bargaining In Hospital Merger Models, David J. Balan, Keith Brand
David J. Balan
Hospital prices for commercially-insured patients are generally set through bilateral negotiations with health insurance companies. Reflecting common industry practice, contemporary models of hospital/health insurer bargaining usually assume that multi-hospital systems bargain on an all-or-nothing basis. However, hospitals within systems may bargain separately, and a commitment to do so is sometimes put forward as a remedy for an otherwise anticompetitive merger. We analyze and compare the merger-induced changes in equilibrium prices in a Nash Bargaining framework under these two modes of bargaining. We show that, while the magnitude of price effects under either mode depends critically on the degree of pre-merger …

(Re)Setting The Agenda For College Men Of Color: Lessons Learned From A 15-Year Movement To Improve Black Male Student Success, Shaun R. Harper, Ph.D.
Shaun R. Harper, Ph.D.
Between 1997 and 2012, much was done on college campuses and elsewhere to improve Black male student achievement. Notwithstanding, their enrollments, academic performance, and rates of baccalaureate degree attainment remain just as troublesome now as they were 15 years ago. But why? And what can be learned as various stakeholders introduce future initiatives in response to issues affecting Black undergraduate men, as well as Asian American/Pacific Islander (AAPI), Latino, and Native American male collegians? In this chapter, I chronicle the 15-year emphasis on Black male students in U.S. higher education. I first catalogue a range of efforts enacted between 1997 …

During the last several decades, research concerning the developmental trajectories, experiences, and behaviors of college men as ‘‘gendered’’ persons has emerged. In this article, we first critically review literature on Black men’s gender development and expressions within college contexts to highlight certain knowledge gaps. We then conceptualize and discuss progressive Black masculinities by relying on Mutua’s germinal work on the subject. Further, we engage Black feminist scholarship, both to firmly situate our more pressing argument for conceptual innovation and to address knowledge gaps in the literature on Black men’s gender experiences. It is our belief that scholars who study gender …

Succeeding In The City: A Report From The New York City Black And Latino Male High School Achievement Study, Shaun R. Harper, Ph.D., And Researchers From The Center For The Study Of Race And Equity In Education
Shaun R. Harper, Ph.D.
This report is the first publication from the New York City Black and Latino Male High School Achievement Study, a project that entailed individual interviews with 415 students from 40 public high schools – 90 were enrolled in 44 colleges and universities, the rest were college-bound high school juniors and seniors. Understanding how these young men succeeded in and out of school, developed college aspirations, became college-ready, and navigated their ways to postsecondary education was the primary aim of this project. Instead of further amplifying deficits and documenting failures in urban schools, 13 Black and Latino male researchers from the …

Glissading offers the purest form of snow sports and is an important skill for mountaineers. Learning how to glissade can be an end in itself, for recreation, or a technique to safely descend mountain slopes when speed is of the essence. Training can reduce risk and improve safety in mountain travel.

This chapter considers how American Sign Language (ASL)—a visual-manual language—is a heritage language of deaf, hard of hearing, and hearing people in the United States. Traditionally, heritage language education and maintenance efforts have centered on spoken languages. This chapter aims to broaden the scope to include signed languages. It begins with a historical overview of ASL, explicates for whom ASL is a heritage language, and examines the influence of current policy trends and technological advancements on language shift and language maintenance. Particular attention is drawn to the role of deaf communities in fostering language maintenance despite concerted efforts to restrict …

Libraries are the wonderful gathering places to pursue knowledge, whether you are student, teacher, parent, laborer, employed or unemployed. ....

Banks And The World's Major Banking Centers, 2010, Adrian E. Tschoegl, Sang Rim Choi, Daekun Park
Adrian E Tschoegl
We update three earlier articles on the determinants of interpenetration of financial centers by banks by adding the year 2010 to our analyses for 1970 and 1980, 1990, and 2000. In addition, we also re-estimate our model to include data for Beijing/Shanghai, and add those emerging centers for 2010. First, the number of banks in our data and the number of their offices in other centers has fallen by 46% and 24% since peaking in 1990. Second, even so our matrix saw less turbulence than in the prior two decades as density and number of presences in other centers per …
