We examine the leading pro-competitive justification for RPM, free-riding on dealer services, in today’s context of brick-and-mortar versus online retailing. Market research studies show that many consumers visit a brick-and-mortar store to examine a product and select its features, but then purchase it at a discounted price from an online retailer. An often-voiced concern is that such “showrooming” will discourage traditional retailers from providing demand-enhancing sales services. According to the classic free-riding theory (Telser, 1960), manufacturers can solve this problem by imposing price floors that prevent online retailers from undercutting brick-and-mortar retailers. We consider a monopolistic supplier’s optimal choice of two-part tariff contracts and resale price maintenance when downstream firms are asymmetric. We show that a ban on input price discrimination may induce the supplier to impose a minimum, maximum or fixed resale price on the downstream firms, where the supplier’s preferred form of RPM depends on demand and cost conditions. Consistent with historical evidence in the United States, we find that when minimum or maximum resale price maintenance is imposed, the resale price provision is binding on only a subset of the downstream firms. This Article reconsiders the prevalent ahistorical assumption that international law began with the Treaty of Westphalia. It gathers together considerable historical evidence to conclude that the ancient world, particularly the New Kingdom period in Egypt or Kemet from 1570-1070 BCE, deployed all three of what today we would call sources of international law. African states predating the modern European nation state by nearly 6000 years engaged in treaty relations (the Treaty of Kadesh), and applied rules of custom (the MA'AT) and general principles of law (as enumerated in the Egyptian Bill of Rights). This paper will discuss the ways in which Cognitive Grammar (CG) has integrated the fundamental concepts of phonology. Phonology has traditionally been the neglected stepchild of CG, in part because the initial excitement of CG revolved around the insightful semantic analyses of what had previously been thought to be purely syntactic or arbitrary lexical puzzles, and phonology is, by definition, about meaningless units. Additionally, phonology deals with the coordination of motor activity and auditory perception, areas that initially didn’t seem to lend themselves to the conceptual tools of CG.

Through an intersectional lens, this article reflects on the dialog between planning and gender, feminist, and queer studies to analyze the lesbian, gay, bisexual, transgender, and queer (LGBTQ) youth of color (YOC) community in New York City (NYC). The community is subject to multiple disenfranchisements, given their ethno-racial status, class, age, gender, and sexual orientation. This community's limited access to safe public spaces and amenities, housing, health services, job training, and other opportunities is an urban planning challenge insufficiently understood or addressed. This article reports on the current state of health disclaimers, online health resources, and credibility markers provided on public library websites (N = 105) for those seeking health information. In light of the Affordable Care Act (ACA), these findings have implications for consumer health reference services in public libraries. Approximately half of the public library websites in the study sample (n = 52, 49.5%) referred users to the ACA Health Insurance Marketplace website (HealthCare.gov). It is argued that including civil society at the negotiation table can increase the perceived legitimacy of peace treaties. As a result, it can contribute to the consolidation of peace. In this paper, the author presents the findings from a controlled experiment in order to test the impact of inclusive peace negotiations on the perceived legitimacy of peace treaties. Contrary to the expectations of the scholars working on the inclusiveness and the consolidation of peace hypothesis, the results show that the treatment group in the experiment does not perceive inclusive peace agreements to be more legitimate.

The aim of this paper is to investigate the roots of the stagnation in the Italian total factor productivity (TFP). The analysis focuses on the specific pattern of technical progress in determining the dynamics of the TFP. This analysis cannot be done with Cobb-Douglas technology, but requires the employment of a constant elasticity of substitution (CES) production function that allows distinguishing between the direction and the bias of technical progress. China produces most of its food grains in the North China Plains. However, there is evidence that groundwater aquifers in this region are being overexploited. We use a unique GIS-referenced dataset of the depth of the water table for all the 12,000 odd tube wells in Lankao county. We find that the construction of new highways has led to a depletion of the water table in wells close to the highways. We propose a methodology of an ex ante prediction of users’ performance based on analyzing the pupillary diameter variability captured by ordinary eye-tracking systems. Based on a realistic large-scale experimental evaluation of our methodology we show promising results that pave the way for a dynamic real-time adaption of IT to the user’s mental effort and the expected user performance. Our non-invasive contactfree methodology can be applied cost-efficiently both in research and practical environments, without disturbing the participant/user.

This Article recommends an economic methodology of contract interpretation that enables the court to maximize the benefits of exchange for the parties and thereby enhance the institution of contracting. We recommend a methodology that asks the parties to identify the determinants of a surplus maximizing interpretation so that the court can determine whether the determinants raise issues that need to be tried. We thus avoid the false choice between textualist and contextualist methodologies, while allowing the parties and the court to avoid costly litigation. This presentation proposes a reconceptualization of interpretive communication through the lens of foreign language (FL) literacy and the multiliteracies framework. The communicative modes and multiliteracies frameworks are similar because they suggest curricular goals for FL programs grounded in cultural content and adopt a broad understanding of communication in which language modalities are overlapping. They differ because the multiliteracies framework additionally outlines a pedagogical approach that puts into practice goals, content, and communication and foregrounds texts as the core content of FL courses.
