That so many battered women defendants receive ineffective legal assistance ought to compel introspection and remedial action within the legal profession. A review of cases in which courts found the conduct of counsel unacceptable reveals an astonishing degree of incompetence, with catastrophic consequences for battered defendants. The problem is characterized by attorneys' failure to present defense theories linked to the abuse endured by battered women defendants and is further compounded by judges who refuse to apply the law. This Article contends that the current debate over gay civil rights is, at base, a dispute over the nature of same-sex desire. Pro-gay forces advocate an ethnic or identity model of homosexuality based on the conviction that sexual orientation is an immutable, unchosen, and benign characteristic. The assertion that, in essence, gays are "born that way," has produced a gay political narrative that rests on claims of shared identity (i.e., homosexuals are a blameless minority) and arguments of equivalence (i.e., as a blameless minority, homosexuals deserve equal treatment and protection against discrimination). Instances of wrongful conviction in North America and Great Britain have uncovered numerous cases in which an innocent suspect has provided a false confession to a crime. As a result, social scientists have studied the interrogation process in an effort to understand the factors that may lead to such false confessions. In the present article, we review what is known about the psychology of police interrogations, including critical aspects of investigative bias, coercive interrogation techniques, and vulnerabilities of the suspect that can increase the likelihood of obtaining a false confession. Controlling Emotions In Sport, Marc Jones

Emotions play a central role in sport performance. Accordingly, it is important that athletes are able to draw on a range of strategies to enhance emotional control. The present paper outlines a number of strategies based on Lazarus’ cognitive-motivational-relational theory of emotion. Strategies are outlined that aim to change cognitions, resulting in either a more appropriate emotional response or a suppression of the expression of emotion and any maladaptive behavioral consequences. These techniques comprise self-statement modification, imagery, socratic dialogue, corrective experiences, self-analysis, didactic approach, storytelling metaphors and poetry, reframing, cognitive paradox, and use of problem-solving skills. Im Oktober 2000 hat die Europäische Kommission eine Sondierung zur Patentier-barkeit software-bezogener Erfindungen eingeleitet. Gegenwärtig beraten die Mit-gliedstaaten des Europäischen Patentübereinkommens beim Europäischen Patent-amt darüber, ob die diesbezüglichen Einschränkung für die Patentierung aus dem Patentübereinkommen gestrichen werden soll. Hintergrund dieser Diskussionen ist die Befürchtung, dass das Fehlen EU-weit einheitlicher Rechtsvorschriften die Wettbewerbsfähigkeit und das Wirtschaftswachstum der Europäischen Union hemmen könnte [4, 5]. Auch der im Frühjahr 2002 vorgelegte Richtlinienvorschlag der Europäischen Kommission wird kontrovers debattiert; eine Lösung die den In-teressen aller betroffenen Akteure berücksichtigt scheint auch heute noch in weiter Ferne zu sein [8].

The importance of information and communication technologies in everyday life is increasing strongly. The growing penetration of PCs in households and offices and the almost ubiquitous use of mobile communication devices are vivid examples for this development.

The key drivers influencing the penetration, usage patterns and specific energy consumption of IC-equipment were examined and a bottom-up analysis of the direct energy consumption of ICT-equipment in households and offices was made for 2001 resulting an energy demand of 38 TWh. Steamboats provided a critical commercial link between Monmouth County, New Jersey and New York City from the early nineteenth through the third quarter of the twentieth centuries. Over 200 vessels have been documented as plying Monmouth County's waters, carrying farm goods to market and leisure patrons to the shore. This presentation summarizes the steamboat's history in Monmouth County, and provides several examples of vessels that ran in the area.

How can we reach “new” levels of knowledge if “new” means that there is something “evolved” that cannot be generated simply by deduction or by induction from what has been given before. The paper’s first goal is to show that two paradigmatic attempts at solving this so-called “learning paradox,” Plato’s apriorism and Aristotle’s inductivism, form two horns of a dilemma: While the inductivist cannot justify any representation of data without assuming a priori given hypotheses, the apriorist cannot justify why a certain application of given ideas is correct without being caught in an infinite regress. This paper examines how the degree of competition among firms in an industry affects the optimal incentives that firms provide to their managers. A central assumption is that there is free entry and exit in the industry, which implies that changes in the nature of competition lead to changes in the equilibrium market structure. The main result is that as the intensity of product market competition increases (as a result of greater product substitutability or greater market size), principals unambiguously provide stronger incentives to their agents to reduce costs. Material Culture As Memory: Combs And Cremation In Early Medieval Britain, Howard M. R. Williams

This paper argues that mortuary practices can be understood as ‘technologies of remembrance’. The frequent discovery of combs in early medieval cremation burials can be explained by their mnemonic significance in the post-cremation rite. Combs (and other objects used to maintain the body’s surface in life) served to articulate the reconstruction of the deceased’s personhood in death through strategies of remembering and forgetting. This interpretation suggests new perspectives on the elationships between death, material culture and social memory in early medieval Europe.
