The Struggle For Sex Equality In Sport And The Theory Behind Title Ix, Deborah Brake

Title IX's three-part test for measuring discrimination in the provision of athletic opportunities to male and female students has generated heated controversy in recent years. In this Article, Professor Brake discusses the theoretical underpinnings behind the three-part test and offers a comprehensive justification of this theory as applied to the context of sport. She begins with an analysis of the test's relationship to other areas of sex discrimination law, concluding that, unlike most contexts, Title IX rejects formal equality as its guiding theory, adopting instead an approach that focuses on the institutional structures that subordinate girls and women in sport. …

Givings - government acts that enhance property value - are omnipresent. Givings and takings are mirror images of one another, and of equal practical and theoretical importance, but the Takings Clause of the Fifth Amendment has enabled takings to dominate scholarly attention. This Article makes the first step toward rectifying this disparate treatment by laying the foundation for a law of givings. The Article identifies three prototype givings: physical givings, regulatory givings and derivative givings. The Article shows that givings are a formative force in property, and that a comprehensive takings jurisprudence cannot be devised without an attendant understanding of …

The present study aimed to examine whether visual contact with natural imagery would result in reduced levels of anxiety in older people, when compared with the effects of urban imagery. Thirty-three older adults between the ages of 61 and 91 participated in this study. Thirteen of the participants were male and 20 were female. In a partial replication and extension of the work of Ulrich et al. (1991), the participants were randomly assigned to one of three groups - a nature video group. urban video group or control group. A Reciprocal Welfare Program, Amy L. Wax

This paper examines how social welfare programs should be structured to comport with the principle of conditional reciprocity. A previous paper, Rethinking Welfare Rights, 63 Law & Contemporary Problems 257 (Winter/Spring 2000), drew upon voter survey data to suggest that a powerful cluster of attitudes governs citizens' views on social redistribution. Most people accept collective responsibility for the poor but adhere to a moralistic distinction between deserving and undeserving recipients of public aid. They view entitlement to group resources as conditional on each person's reasonable effort, consistent with ability, to support himself and his family. It was speculated that the …

Problem. Clergy sexual misconduct is a significant problem for the church. There are legal and financial problems, as well as damage to individuals and communities. The purpose of this study was to examine personality profiles and situational themes of ministers in treatment whose presenting problems included sexual misconduct.

Method. Inactive case files of ministers in treatment were analyzed. From the case file it was determined if the minister was involved in an intimate affair which included an emotional bond, a casual affair with no emotional bond, or was not involved in an affair. An inter-governmental body is encouraging the replacement of currency with the objective of discouraging illegal economic activities. This policy is analyzed in a search-theoretic model where individuals choose legal or illegal production, settle trades via monetary or costly intermediated exchange, and where the government imperfectly monitors monetary transactions. Stationary monetary equilibria with both legal and illegal production exist, in which case the over-provision of currency may increment the extent of illegal production. This result holds also in the presence of intermediated exchange of legal goods. Equilibria with differing transaction patterns and degrees of illicit activities coexist.

The Effect Of Spectral Composition On The Photochemical Production Of Hydrogen Peroxide In Lake Water, Andrea Y. L. Wong, George T. F. Wong

Hydrogen peroxide was produced when samples of lake water were exposed to direct or filtered sunlight in which UV or UV(B+C) light was selectively removed. In all cases, the concentration of hydrogen peroxide increased linearly with time-integrated irradiance. While both visible and UV light can induce the formation of hydrogen peroxide, the contribution from the latter was disproportionately large as it was responsible for about two-thirds of the formation of hydrogen peroxide. Among the UV lights, the contributions from UV-A and UV-(B+C) light were 70% and 30% respectively. The contribution from UV-A light was equivalent to about one half of …
