Cultural Rights And Internal Minorities: Of Pueblos And Protestants, Andrew M. Robinson

This article considers the question: should rights extended to cultural communities to help them preserve themselves include the right to discipline dissident members who violate cultural norms? The case of the Pueblo Protestants is employed to consider two important defenses of cultural rights (revisionist liberal and cultural communitarian) that offer conflicting answers. Both are found unsatisfactory because of their implicit reliance on “cultural monism” (that is, the assumption that individuals identify with only one cultural community). An approach to defining cultural rights is then outlined that avoids this assumption and its application is illustrated with respect to the Pueblo case.

Ontario child welfare is entering territory where other countries have gone before. A decade earlier, jurisdictions in England, the United States and Australia implemented similar reforms and, not coincidentally, encountered comparable difficulties, creating high levels of dissatisfaction among service users and service providers. Our contention is that such frustrations are inherent consequences of the underpinnings of the “Anglo-American child protection paradigm”. To do better, it is helpful to look for ideas outside of what is familiar and to consider how useful approaches from other jurisdictions might be adapted to a Canadian context. I HAVE ALWAYS LIKED metaphoric interfaces. When the Internet Public Library (IPL) and the Engineering Information Village (Ei Village) first came out in the mid-1990s, they both made good use of metaphors. IPL used the metaphor of a small library reference/reading room, complete with reference librarian sitting behind the desk, ready-reference books on the desktop, bookshelves arranged in subject categories, and a study area.

"Are You Beginning To See A Pattern Here?" Family And Medical Discourses Shape The Story Of Black Infant Mortality, Elaine R. Cleeton

Postmodern and poststructuralist theorizations of the interrelations of the particular and the universal have identified women's bodies to be the last frontier for scientific discovery leading to and satisfying the modern compulsion to stabilize and control life from birth to death. This institutional ethnography of one city's response to an elevated infant mortality rate among the babies of African American urban, impoverished women explores their discursive transformation from single mothers who cannot begin prenatal care before the second trimester because too few physicians will treat Medicaid patients, into sexually-immoral, illegaldrug- using women who deliberately harm their babies. This article examines telecommunications reform and related infrastructure and service developments in Southern African states. In focusing on this region, the article analyses the role of the Southern African Development Community (SADC) and the different associations and commissions it has created to develop the telecommunications sector and facilitate reform, which is essential to promote network efficiencies and extend the infrastructure to rural areas. This paper aims to demonstrate that the terms 'mediation' and 'conciliation' are used to denote a general conciliatory procedure characterised by a 'nonadversary' but a 'cooperative' approach of the parties to a dispute towards reaching a settlement agreement by the assistance of a third neutral. A similarity between these procedures is based on the 'party control' of the proceeding, i.e. on the willingness of the parties to settle their dispute while the mediator or the conciliator only assist the parties in coming to a final agreement. The paper (I) outlines the nature and extent of the dissatisfaction with legal research instruction and demonstrates that the problem predates computer-assisted legal research, (II) presents the history of the debate (focusing on a heated exchange between advocates of a “process-oriented” approach and proponents of the traditional, “bibliographic” methods), and (III) presents the requisite elements of a satisfactory pedagogical model, discussing various issues surrounding each of these elements.

Profit-maximizing bidding in uniform price auction markets involves bidding above marginal cost. It therefore is not surprising that such behavior is observed in electricity markets. Common bidding behavior such as “hockey stick” bids easily are explained by suppliers determining their supply offers to maximize profits. This incentive to bid above marginal cost is not the result of coordinated action among the bidders. Rather, each bidder is independently selecting its bid to maximize profits based on its estimate of the residual demand curve it faces. Profit-maximizing bidding does not mean that “the sky’s the limit.” Typically, bidders are limited in how …
