This article discusses basic copyright issues and resources in order to provide the tools librarians need to develop their own institutional copyright policies. The relevant laws are discussed including the legal rights given to copyright holders (§106), the limitations on these rights ( §107, §108, §110), and the DMCA. The four criteria for a fair use analysis (§107) are covered as well as the pros and cons of the established fair use guidelines. Special library exemptions and problems are explained for Interlibrary Loan, unsupervised patron copying, archives and copying and viewing videos.

Agricultural land in Nebraska is a significant asset of wealth and a key economic input into the state’s economy. It is no mere coincidence that Nebraska consistently ranks fourth among the 50 states in total cash receipts from farm marketings while also ranking fourth in land acreage in farms and third in terms of irrigated acreage. Consequently, it is of considerable importance to identify and understand the basic patterns of land ownership and tenure that exist within the state.

About 30% of clients worldwide are diagnosed as Borderline Personality Disorder (BPD) (Bohus et al., 2000). BPD is a complex disorder and difficult to treat. Therefore, it is necessary for counselors to gain as much knowledge about treatment modalities and their effectiveness as possible. This paper attempts to define BPD by looking closely at its history.and describing the criteria for diagnosis. Linehan's Dialectical Behavior Therapy (DBT) and Kernberg's Object Relational Theory (ORT) are compared as to their effectiveness in working with clients who exhibit symptoms of BPD.

Though praised as an outstanding scholar, Robert L. Meriwether was perhaps most proud of his work in helping other scholars as a teacher, editor, archivist, and librarian, with the founding of the South Caroliniana Library as the pinnacle of those efforts. Born in Edgefield County, South Carolina, in 1890, his love of history and affection for his native state seem inextricably intertwined from a young age. This Article reviews recent developments in the law of access to information, that is, cases involving click-through agreements, the doctrine of trespass to chattels, the anti-circumvention provisions of the Digital Millennium Copyright Act, and civil claims under the Computer Fraud and Abuse Act. Though the objects of these different doctrines substantially overlap, the different doctrines yield different presumptions regarding the respective rights of information owners and information consumers. The Article reviews those presumptions in light of different metaphorical premises on which courts rely: Internet-as-place, in the trespass, DMCA, and CFAA contexts, and contract-as-assent, in the click-through context. The conventional model of criminal trials holds that the prosecution is required to prove every element of the offense beyond the jury's reasonable doubt. The American criminal justice system is premised on the right of the accused to have all facts relevant to his guilt or innocence decided by a jury of his peers. The role of the judge is seen as limited to deciding issues of law and facilitating the jury's fact-finding. Despite these principles,judges are reluctant to submit to the jury elements of the offense that the judge perceives to be . routine, uncontroversial or uncontested.

Substantial evidence indicates that clinically irrelevant patient characteristics, including race and gender, may at times influence a physician's choice of treatment. Less clear, however, is whether a patient who is the victim of a biased medical decision has any effective legal recourse. Heedful of the difficulties of designing research to establish conclusively the role of physician bias, this article surveys published evidence suggesting the operation of physician bias in clinical decision making. The following article is based upon field research conducted by Dr. Gordon A. Crews dealing with juveniles and young adults involved in the “Goth” lifestyle across the United States. This research is part of his ongoing efforts over the last decade to examine the impacts of alternative lifestyles, beliefs, and practices upon juvenile delinquency and violence. Most of the information in this article has been derived from face-to-face interviews with individuals aged 13 to 39 years of age proclaiming to be Goth, Vampires, Satanists, Pagans, Wiccans, New Agers, Druids, and a myriad of other occult-based identities.

After years of intense debate, global climate change has finally been acknowledged as a serious threat to global biological, political and economic systems. There is overwhelming evidence that the atmospheric warming observed over the course of the past 50 years, as well as the increasing incidence of extreme weather events and floods, is being caused by the acceleration of the rate in which greenhouse gases (GHGs) produced by the burning of fossil fuels are being released into the atmosphere. Is Ageism Alive In Date Selection Among Men? Age Requests Among Gay And Straight Men In Internet Personal Ads, Gayle Kaufman, Voonchin Phua

We examine 2,400 personal ads from male advertisers collected from the Internet, focusing on age preference by race and sexual orientation. We look at whether advertisers display any age preference in personal ads and whether the preference varies by race and sexual orientation. We find that gay men are more likely than straight men to state an age preference. Also, the preference for younger partners intensified among the older advertisers regardless of race and sexual orientation. Youth is still a treasured commodity in date selection for men. However, some men, especially gay men, prefer more mature partners. At least 20 …

Although drug therapy is the more common treatment of ADHD (attention deficit hyperactivity disorder), and has been shown to reduce symptoms, the benefits of the theraputic drugs are temporary, and the therapy can have adverse side effects. For these reasons, many prefer not to use drug therapy for ADHD. Alternative treatments have been shown to have some efficacy, especially when used in conjunction with drug therapy. Dynamic Systems theory suggests that an intervention which combines graphomotor exercises with music may have a positive effect on a child's behavior and attention. Some Evidence On The Performance Benchmarking Of Australian Fixed Interest Funds, David E. Allen, Victor Soucik

In this paper we analyse the performance of Australian fixed interest managed funds by examining the relative effectiveness of various indices of bond performance which are combined with various measures of: interest rate fluctuations, economic fundamentals, maturity risk, default risk, and equity market returns, in an attempt to find an ‘optimum’ index. Our dataset is sourced from the Australian fund-rating agency ASSIRT. We show that a correct combination of a bond market variable, a mixture of interest rate factors and economic factors as well as a proxy for movements in the equity markets yield the optimal benchmark.

In the past decade there has been a proliferation of courseware management systems being developed and promoted as a means of simplifying the creation and management of instructional websites. Implementing these systems can be resource intensive and require large budgets to cover aspects such as infrastructure, integration into legacy databases, training, maintenance and on-going support. This study examines the major arguments for and against enhanced monetary integration in North America, with particular emphasis on the Canadian perspective. In this context, the question is whether the current floating rate regime should be replaced by greater fixity of exchange rates in relation to the U.S. dollar. While the choice among fixed rate systems is wide in principle, for practical purposes the Canadian debate centres on the pros and cons of monetary union. Environmental Sovereignty Discourse Of The Brazilian Amazon: National Politics And The Globalization Of Indigenous Resistance, Anne Marie Todd

This analysis explores the connection between globalization and national identity in cultural expressions of environmental sovereignty. Competing claims to resources in the Brazilian Amazon reflect changing notions of state authority and the role of indigenous citizens in protection of biodiversity. The debate between Brazilian state governments and the Yanomami Indians and seringueiros (Brazilian Rubber Tapper communities) illustrates the complex interaction of national identity and expressions of local culture in a global ecological context.
