In Maine, people have long used private land for recreation. James Acheson points out that this “open land” tradition—unique in the nation—has huge economic implications, especially for the state’s tourism industry. In recent years, there has been a substantial increase in land posting, largely in response to abuses by the public. From some psycholinguistic perspectives, this study examines language transfer by exploring the nature of the multilingual mental lexicon in relation to sources of language transfer. It assumes that the multilingual mental lexicon contains not only lexemes but also language-specific lemmas; language-specific lemmas may activate language-specific morphosyntactic procedures in speech production, and third language learners' activation of lemmas for target language items may be influenced by the lemmas already stored in their mental lexicon through their previous language acquisition, especially second language acquisition. Nursing practice in forensic psychiatry opens new horizons in nursing. This complex, professional, nursing practice involves the coupling of two contradictory socioprofessional mandates: to punish and to provide care. The purpose of this chapter is to present nursing practice in a disciplinary setting as a problem of governance. A Foucauldian perspective allows us to understand the way forensic psychiatric nursing is involved in the governance of mentally ill criminals through a vast array of power techniques (sovereign, disciplinary, and pastoral), which posit nurses as “subjects of power.” These nurses are also “objects of power” in that nursing practice is constrained …

This thesis examines the issues that have become enmeshed in the body politic of the current generation of Asian/Pacific American student activists at Oberlin College. It discusses students' personal trials as they confront academic burnout, institutional amnesia, and a continued lack of support for A/PA studies, through a case study of activism in motion. Other aspects of this research include the role of identity in pan-ethnic Asian American community organizing, the power dynamics of identity and the strategic deployment of identity as a political tool (Lowe 1991, Espiritu 1992). Ideas of race, racial identity, and racial categorization, reflect the inconsistent, context-specific and fluctuating nature of racial meaning (Nagel, 1986; Forbes, 1990; Davis, 1991; Nagel, 1994; Haney-Lopez, 1995; Ignatiev, 1995; Kibria, 1996,1998; Niven & Zilber, 2000; Morning, 2001; Lacy, 2004). Studies of racial hierarchy, specifically, enable an understanding of not only the social construction of race, but also the manner in which ideas of race operate to influence human reality.! In her work Methodology of the Oppressed, Chela Sandoval claims that although inequities in material sources and subordination by race, class, nation, gender and sex continue to operate under the protection of law and order, a new kind of psychic penetration that respects no previous boundaries is evolving. She argues that "Mutation in culture, today, makes new forms of identity, ethics, citizenship, aesthetics and resistance accessible" (36.7).

Public policy makers and administrators around the world recurrently face the question of whether to grant tax privileges to businesses in order to promote investment, jobs, or economic development in general. This article analyzes a very popular form of local incentive, the property tax abatement, and its ability to reduce capital cost. The research question is: By how much do property tax abatements reduce the capital cost of business and homes? Results show that abatements can account for quite a large range of possible percentage reductions in the price of investment for firms. The findings provide public administrators and policy …

However, the contemporary system of local self-government in Ukraine is still not consistent with the principles of the European Charter of Local Self-government. Interlanguage pragmatics (Kasper & Blum-Kulka, 1993) is a research area that is concerned with what second language (L2) learners do with the target language, and how their competence in using the language develops over time. However, until 1996 when Kasper and Schmidt put out agendas for more developmentally oriented investigations, research on interlanguage pragmatics had been predominated by studies focusing on the former, L2 use at a point in time. School Choice Demonstration Project

This study evaluates the initial effect Washington D.C.'s Opportunity Scholarship Program (OPS) on the academic performance of public schools and its effects on the opportunities District students have to attend integrated schools. OPS is a federally sponsored school voucher program that provides vouchers worth up to $7,500 for an estimated 1,800 to 2,000 students in the District of Columbia. Students can use the scholarships to pay tuition at participating private schools in the District. The pilot program is designed to last for 5 years.

The purpose of this study was to find out if either The New York Times or The Washington Times participated in unbalanced media coverage during the last two weeks of the 2004 Presidential Election. Through content analysis paragraph tone was used to evaluate news stories, columns, and editorials as positive, negative or neutral from a composite week sample. This essay argues that, while many restorative processes are quite valuable, there is the potential for their use to produce results that conflict with the community's shared intuitions of justice and to thereby undermine the criminal law's moral credibility. Because such moral credibility can have practical crime-control value, it ought not be undermined unless the crime-control benefits of doing so clearly outweigh the costs. In practice, it is entirely possible to rely upon restorative processes in ways that avoid injustice and that assure justice is done.

The federal preemption of state law has emerged as a prominent field of study for legal scholars and political scientists. This rise to prominence of a technical and often dull field of jurisprudence is due to a number of developments-increasingly frequent federal statutory preemptions; the states' unprecedented aggressiveness in regulating business transactions, the expansion of corporate liability under state common law and the increased resort of corporate defendants to federal preemption defenses; and, not least, the Rehnquist Court's discovery of federalism and states' rights.

Mandatory Waiting Periods For Abortions And Female Mental Health, Jonathan Klick

Proponents of laws requiring a waiting period before a woman can receive an abortion argue that these cooling off periods protect against rash decisions on the part of women in the event of unplanned pregnancies. Opponents claim, at best, waiting periods have no effect on decision-making and, at worst, they subject women to additional mental anguish and stress. In this article, I examine these competing claims using adult female suicide rates at the state level as a proxy for mental health. Panel data analyses suggest that the adoption of mandatory waiting periods reduce suicide rates by about 10 percent, and …

In this Essay, Professor Burbank comments on the essays by Professors Nagareda and Issacharoff. Welcoming the opportunity to revisit the interplay between procedure and substantive law and the question of democratic accountability that Professor Nagareda’s essay presents, Professor Burbank concludes that the parts of that essay are greater than the whole. He finds that Professor Nagareda’s pursuit of unifying themes and a general normative theory leads to inconsistencies in classification between procedure and substance and to an impoverished vision of institutional legitimacy.
