Ip's Problem Child: Shifting The Paradigms For Software Protection, Jacqueline D. Lipton Jan 2006

Ip's Problem Child: Shifting The Paradigms For Software Protection, Jacqueline D. Lipton

Articles

Computer software is somewhat of a problem child for intellectual property law. Courts and legislatures have struggled to encourage innovations in software development while, at the same time, attempting to avoid undesirable digital information monopolies. Neither the patent nor the copyright system has provided a particularly satisfactory paradigm for software protection. Although patents have received greater attention than copyrights in the software context (consider, for example, the recent BlackBerry case), copyright law arguably creates more insidious undercurrents in today's marketplace. This is partly because we have not yet appreciated the potential impact of recent developments in programming methodology and digital …

Political Differentiation In Consumer Preferences For Underdog Businesses : Does Everybody Love A Winner?, Kelly O'Connor Jan 2006

Political Differentiation In Consumer Preferences For Underdog Businesses : Does Everybody Love A Winner?, Kelly O'Connor

Honors Theses

In an exploratory study of the intersection between the worlds of social behavior and personal economics, this experiment will examine the links between political ideology and consumer preference for an ''underdog" business. The stereotypical image of the Mom and Pop comer store is romantic, but when we juxtapose this sentiment with the convenience and predictability of shopping at a giant retailer, it is unclear which store consumers will prefer, and why. This study tested the hypothesis that individuals with more liberal political orientations will be more likely to exhibit a preference for underdog businesses than individuals with conservative political leanings, …

Health is instrumental to the ability of individuals to fulfill their potential. The societal systems designed to nurture health are thereby particularly important both for the flourishing of the individual and that of society, for a society flourishes to the extent that each of its individual members flourishes. The medical professionals who strive to preserve good health in their communities through these systems are integral to the maintenance of a thriving society. They are the individuals most directly responsible for the quality of health care available to community members. It is their medical prowess and critical thinking skills that determine …

The Effects Of Single-Sex Student Leadership Positions On Leadership Style Used, Perceptions Of Effective Leadership, Self-Efficacy, Domain Identification, Intent To Lead In The Future, And Perceptions And Evaluations Of Leaders, Alyson Emrick

Honors Theses

Included in this paper are two studies, a survey study, and a vignette study. The survey research, Study 1, examined the effects of single-sex student leadership positions on leadership style used, perceptions of effective leadership, leadership self-efficacy, domain identification, and intent to lead in the future. It compared a group of male and female leaders of single-sex organizations, a group of men and women holding leadership positions in coeducational groups, and a group of male and female non-leaders. Male and female leaders reported using different leadership styles; men reported higher levels of the autocratic-task style while women reported higher levels …

IN the First quarter of 2003, employers took 1,508 mass layoff actions. this trend continues in 2005. there are many reasons for these layoffs, including bankruptcy, business ownership change, financial difficulty, reorganization, domestic or overseas relocation, model change over, product line discontinuation, weather-related reasons, and so on. The employment market is tight right now, and professionals are forced to expand their job searches beyond their geographic areas. Many professionals who have a family look for jobs in the suburbs, trying to avoid congestion and pollution. The U.S. Census shows an increase in nontraditional families also moving to the suburbs.

Anti-System Parties:Policy Choices For Democracies A Study Of India's Bharatiya Janata Party And Austria's Freedom Party, Kristina M. Teater Jan 2006

Anti-System Parties:Policy Choices For Democracies A Study Of India's Bharatiya Janata Party And Austria's Freedom Party, Kristina M. Teater

Browse all Theses and Dissertations

In the decades following WWII, countries across the globe witnessed the rise of anti-system parties. Political scientists have attributed their success to economic conditions, electoral systems, party systems and the electorate’s disaffection with mainstream parties. The analysis also suggests the influence of global factors. While the causes for success have been examined, effective policy choices for democracies have not been equally explored. This study makes the argument that by including anti-system parties in government, states are able to lessen the threat they pose to democracy. The analysis of India’s Bharatiya Janata Party and Austria’s Freedom party suggest that anti-system parties …

Matching And Anonymity, C. D. Aliprantis, Gabriele Camera, D. Puzzello Jan 2006

Matching And Anonymity, C. D. Aliprantis, Gabriele Camera, D. Puzzello

Economics Faculty Articles and Research

This work introduces a rigorous set-theoretic foundation of deterministic bilateral matching processes and studies systematically their properties. In particular, it formalizes a link between matching and informational constraints by developing a notion of anonymity that is based on the agents' matching histories. It also explains why and how various matching processes generate different degrees of "informational isolation" in the economy. We illustrate the usefulness of our approach to modeling matching frameworks by discussing the classical turnpike model of Townsend.

Efficient Monetary Allocations And The Illiquidity Of Bonds, P. Boel, Gabriele Camera Jan 2006

Efficient Monetary Allocations And The Illiquidity Of Bonds, P. Boel, Gabriele Camera

Economics Faculty Articles and Research

We construct a monetary economy with heterogeneity in discounting and consumption risk. Agents can insure against this risk with money and nominal government bonds, but all trades must be monetary. We demonstrate that a deflationary policy a la Friedman cannot sustain the constrained-efficient allocation as no-arbitrage imposes too stringent a bound on the return money can pay. The constrained-efficient allocation can be sustained when bonds have positive yields and, under certain conditions, only if they are illiquid. Illiquidity, meaning that bonds cannot be transformed into consumption as easily as cash, is necessary to eliminate arbitrage opportunities due to disparities in …

Importing Extended Producer Responsibility For Electronic Equipment Into The United States, Chad Raphael, Ted Smith Jan 2006

Importing Extended Producer Responsibility For Electronic Equipment Into The United States, Chad Raphael, Ted Smith

Communication

Extended Producer Responsibility (EPR) is a policy approach that holds manufacturers accountable for the full costs of their products at every stage in their life cycle. EPR typically involves requiring that producers take back their products at the end of their useful lives, or pay a recycling contractor to do so, thereby internalizing the costs of recycling or disposal in a manufacturer’s bottom line. When companies know that they will bear the costs of product return and recycling, they are more likely to redesign their products for easier and safer handling at each step in the life cycle. This approach …

Serving Sophomore Students, Jessica S. Lothman '06

Honors Projects

College sophomores have been deemed "invisible students." This label is the result of a combination of issues students typically face during their sophomore year. Problems include: integration into social networks, declaration of a major, decisions regarding study abroad and/or internships, and disenchantment with the university, among others. A review of survey data reveals that sophomores at Illinois Wesleyan University are no different and face all of these problems. In addition to the above, sophomores at Illinois Wesleyan University have some expectations of the University that are not being met, such as course availability, adequacy of food service, and advising. These …

Intuition Versus Analysis- Which Process Is Most Appropriate For Solving Everyday Problems With Differing Levels Of Social Content And Complexity?, Amy E. Kowalski '06 Jan 2006

Intuition Versus Analysis- Which Process Is Most Appropriate For Solving Everyday Problems With Differing Levels Of Social Content And Complexity?, Amy E. Kowalski '06

Honors Projects

The investigators wanted to test the theories laid out by Hammond (1987) and McMackin and Slovic (2001) that problem attributes affect the appropriateness of intuition for solving problems. The study investigated the appropriateness of strategy (intuition, analysis, or no strategy) for everyday problems that varied in social nature and complexity. It was hypothesized that problems high in social nature and complexity would be solved more accurately using intuition. Results were partially supported but only among novice participants. Results indicate that highly intuitive novice individuals score more accurately than those who are highly analytical when solving everyday problems. One of the …

The Development Of Perfectionism Among Adolescents: Comparing The Influence Of Friends And Parents, Heather Kwoka '06 Jan 2006

The Development Of Perfectionism Among Adolescents: Comparing The Influence Of Friends And Parents, Heather Kwoka '06

Honors Projects

This study investigated the development of perfectionism in adolescence by examining the associations between perfectionism, parenting styles, and friendship experiences. Furthermore, this study investigated the nature of perfectionism by examining whether internal psychological characteristics (i.e., loneliness, depressive symptoms, anxiety, self-esteem, and life satisfaction) were associated with the development of types of perfectionism (i.e., adaptive and maladaptive) or orientations of perfectionism (i.e., self-oriented or socially prescribed). Gender differences regarding each of these components were also explored. Questionnaires were completed by sixth, seventh, and eighth grade adolescents that measured perfectionism, internal psychological characteristics, perspective on parenting styles, and friendship quality. Three general …

The Relationship Between Gay-Related Stress And Ethnicity For Homosexual And Bisexual Males, Keyona Jarrett '06

Honors Projects

This was a two-part study that aimed to explore the relations between ethnicity and internal and external gay-related stress for homosexual and bisexual males. In the first study, ethnic participants exhibited more internal and external gay-related stress than Caucasian participants. Ethnicity was found to be closely related to internal gay-related stress, and less related to external gay-related stress. In the second study, which' was a secondary analysis of data from the Lighthouse Institute, ethnicity and/or sexual orientation did not seem to be closely related to substance abuse or mental/emotional health issues.

The Study On M&A In Today's China Shipping Industry, Yichun Cao Jan 2006

The Study On M&A In Today's China Shipping Industry, Yichun Cao

World Maritime University Dissertations

In 2005, although there came along another wave of M&A activities in global shipping industry, we haven’t seen any sign of the emergence of large-scale M&As in China shipping industry so far. It’s quite unfavorable to the future development of whole China shipping sector. Besides, most Chinese shipping companies show no interest in, and even resist carrying out such economic event. However, the reasons behind the problem are various and intricate. The unique China macroenvironment and different kinds of deficiencies in Chinese shipping enterprises really hinder the appearance of mass M&A activities in China shipping industry. Here the macroenvironment includes …

Screenplay: Cinema/Videogames/Interfaces [Book Review], Marc Ouellette Jan 2006

Screenplay: Cinema/Videogames/Interfaces [Book Review], Marc Ouellette

English Faculty Publications

Recognizing the growing importance (at least for consumers) of video games as a popular form of narrative fiction, Geoff King and Tanya Krzywinska situate their collection, ScreenPlay: cinema/videogames/interfaces as a text which is corrective, informative and explorative. In the first case, the editors sought essays which would move the critical discourse on video games away from the more familiar but reductive debates surrounding the "effects" of video games (especially on children) and their modes of representation (especially of the female form and violence). Indeed, these have become the sine qua non of video game criticism and one feeds the other …

Final Evaluation Report: Domestic Violence Case Coordination Project, Karen Monahan, Diane Gout, Anita St. Onge

Children, Youth, & Families

The project sought to address two primary problems: the lack of information available to judges issuing orders in cases involving domestic violence regarding other actions and orders that could affect victim safety (e.g., defendant’s criminal history or related criminal, civil, or other PFA actions); and the lack of judicial follow-up to assure that offenders were complying with the requirements of court orders (e.g., probation conditions requiring the offender to obtain mental health or substance abuse treatment, participate in a certified batterer’s intervention program, or obtain other social services.)

Generation "X" Professional Women Leaving The Workforce To Become Full-Time, Stay-At-Home Mothers: A Qualitative Analysis Of Motivation, Meaning, And Mindful Parenting, Monisa Shackelford

LSU Doctoral Dissertations

Using qualitative data gathering and analysis, the current trend of professional women leaving workforce to rear their children full-time is examined. Women in the second generation to enter the labor force in large numbers indicate that there are factors that push them out of the workforce, such as a non-family friendly workplace, and factors that pull them back home, such as a profound need to rear their own children. While the transition from professional to stay-at-home mother is a complex process, the women in this study deal with this identity shift, and its attendant resistance, by framing their change in …

Cut-And-Paste Plagiarism: Teaching Student Researchers Boundaries, Tami Echavarria Robinson

The Christian Librarian

Librarians affiliated with educational institutions, as members of an academic community, participate in teaching students and future scholars how they share in the responsibility of upholding ethical standards of scholarship and values of academic honesty. Academic honesty, in its variant forms, was part of issues in education long before the introduction of computers. Two forms, plagiarism and copyright infringement, were chronic problems in the print realm and present additional dimensions in today’s electronic environment. The causes of copyright infringement and plagiarism are extensive and complex. Divergent positions are represented in the literature on how to deal with these issues. They are …

In light of the known benefits and the increasing importance of an international study experience, the UNF International Center has been investigating and offering more opportunities for Study Abroad. In the fall of 2004, the Director of the International Center, Dr. Tim Robinson, wished to investigate the level of interest of UNF freshman and sophomore students in studying abroad. He had the idea of conducting a survey to learn more about their previous experiences abroad and their attitudes towards Study Abroad Courses. Dominik Güss and Emma Glencross developed a first draft of the survey. Upon modification, a final survey was …

Commodification And Contract Formation: Placing The Consideration Doctrine On Stronger Foundations, David Gamage, Allon Kedem Jan 2006

Commodification And Contract Formation: Placing The Consideration Doctrine On Stronger Foundations, David Gamage, Allon Kedem

Articles by Maurer Faculty

Under the traditional consideration doctrine, a promise is only legally enforceable if it is made in exchange for something of value. This doctrine lies at the heart of contract law, yet it lacks a sound theoretical justification a fact that has confounded generations of scholars and created a mess of case law.

This article argues that the failure of traditional justifications for the doctrine comes from two mistaken assumptions. First, previous scholars have assumed that anyone can back a promise with nominal consideration if they wish to do so. We show how social norms against commodification limit the availability of …
