The interpretation-construction distinction, which marks the difference between linguistic meaning and legal effect, is much discussed these days. I shall argue that the distinction is both real and fundamental – that it marks a deep difference in two different stages (or moments) in the way that legal and political actors process legal texts. My account of the distinction will not be precisely the same as some others, but I shall argue that it is the correct account and captures the essential insights of its rivals. This article focuses on the extent to which unenforceable voluntary initiatives undertaken by corporations can change corporate behavior to make businesses more environmentally responsible, i.e. not only comply with the law, but to do more than the law actually requires of them. These initiatives, loosely gathered under the umbrella of a movement called corporate social responsibility (CSR), are often proposed by the government as a way to fill regulatory and enforcement gaps or by industry, often as an alternative to regulatory requirements. When a country experiences an economic downturn, as the United States has since late 2007, the negative effects are widespread. Workers are laid off, and households and firms spend less due to decreased income. In most industries, revenues and profits decline during recessions, and professional sports franchises may be no different. In a period of high unemployment, one would expect that consumers first cut back on recreation and entertainment. This study was designed to determine the impact of unemployment on one such entertainment activity, Major League Baseball games.

This article looks at soup making as a lens to view the impact of societal change for Hungarian pensioner women. Food as a practice illustrates agency: strategies and tactics used in time and space to communicate meaning for people in everyday life. During the Socialist period women endured frustrations of long lines and scarce resources. Post socialism, their heroic clout as food providers is diminished by the introduction of a market economy. However, the survival skills learned in the socialist era allow them to adapt to the new era of high inflation, and high unemployment. I use descriptions of one …

Demystifying The Irb: Human Subjects Research In Academic Libraries, Maura A. Smale

Many academic librarians are interested in pursuing research studies that involve students, faculty, and other library patrons; these projects must be approved by an institutional review board (IRB). This article reviews federal requirements and regulations for human subjects research and explains the IRB application process. The author discusses common types of research projects undertaken by academic librarians that require IRB approval and offers suggestions for successful navigation through the IRB process. Academic librarians should embrace research involving human subjects because the results contribute to the corpus of scholarly knowledge in library and information science as well as in higher education.

Throughout the world, baby selling is formally prohibited. And throughout the world babies are bought and sold each day. As demonstrated in this Essay, the legal baby trade is a global market in which prospective parents pay, scores of intermediaries profit, and the demand for children is clearly differentiated by age, race, special needs, and other consumer preferences, with prices ranging from zero to over one hundred thousand dollars. Quantitatively measuring a person’s fluency in a second language (L2) is difficult, but analysis of formant movements during vowel production may provide a more accurate way of measuring the accuracy of acquiring a native-like production of the L2. This study examined the accuracy with which two groups of native English speakers perceived and produced the Spanish vowel /e/ and diphthong /ei/, and compared their results with the results from a group of native Spanish speakers. American social culture had a long-prevailing ideology that minorities were inferior to their Caucasian counterparts. Clearly, though, integration reflected an acknowledgement that racial equity and equality could and should be achieved in the composition of schools. Disrupted But Not Destroyed: Fictive-Kinship Networks Among Black Educators In Post-Katrina New Orleans, Daniella Ann Cook

Drawing on Adkins’ (1997) notion of reform as colonization and using ethnographic data from African American teachers in New Orleans after Hurricane Katrina, this article discusses how black educators’ fictive-kinship (Fordham 1996, Chatters, Taylor, and Jayadoky 1994, Stack 1976) networks have been altered in the changing landscape of reform. I argue that the importance of fictive-kinship relationships among educators and students was ignored in school-reform efforts in post-Katrina New Orleans. Post-Katrina school reforms disrupted, but did not destroy, these fictive-kinship networks. I discuss three themes: (1) fictive-kinship networks created before Katrina cultivated an environment centered on cooperation, collaboration, and solidarity, …

U.S. merchants and traders helped sustain Spanish imperial commercial networks in Venezuela and the Spanish Caribbean. Shipping foodstuffs, arms, re-exported European manufactures, and slaves to the Spanish colonies were profitable enterprises for neutral U.S. traders. Through private negotiations and even Spanish-government contracts, partnerships between Venezuelan and U.S. merchants provided the shipping tonnage and merchandise that Spanish officials and colonial elites needed most to maintain their rule and to fend off the challenges of economic and environmental crises, slave conspiracies, and revolutionary plots before 1810.

With a growing number of digital libraries and other open education repositories being made available throughout the world, effective search and retrieval tools are necessary to access the desired materials that surpass the effectiveness of traditional, all inclusive search engines. This paper discusses the design and use of Folksemantic, a platform that integrates OpenCourseWare search, Open Educational Resource recommendations, and social network functionality into a single open source project. Learning scientists have created and used virtual worlds to support players’ historical, scientific, and ecological inquiries. Much less explored has been the impact of community events on players’ investigations in virtual worlds. The authors present here the case of a community event Whypox, a virtual epidemic whose annual outbreak in Whyville affects players’ communication and appearance. The authors analyze the different levels of participation ranging from casual to systematic in which players searched out more information about the Whypox, participated in online discussions about its causes and investigated different scenarios with simulations. Misunderstandings and misinformation about copyright run rampant on college campuses today which can lead to stifling classroom teaching or even liability for copyright infringement. In this column I begin with a short overview of copyright and fair use followed by a discussion of some of the more common copyright myths I have encountered over the past few years.

It is commonly understood that approximately 10 % of the U.S. population is gay, lesbian, or bisexual. It has been well-documented that gay people face a heightened risk of suicide that is different and more severe than heterosexuals. Although it is known that both suicide attempts and completions are disproportionately higher among gay adolescents than heterosexual ones, there is a paucity of research on the phenomenon of suicide survivorship. Because lesbian adolescents in particular have higher rates of depression, drug or alcohol abuse, and suicidality than heterosexuals, there is a demonstrated need for studies which explore the experiences of lesbian …

Mental competency as a prerequisite for due process was established by the United States Supreme Court‟s Dusky decision (1960). The Court mandated that a defendant must possess reasonable levels of factual and rational understanding in order to competently participate in the adjudication process. The precise definitions of competence were not included in any of the Court‟s decisions regarding the concept of Competency to Stand Trial (CST). The use of color electrophotographic (EP) laser printing systems is growing because of their declining cost. Thus, the print quality of color EP laser printers has become increasingly important. Since text and lines are indispensable to print quality, many studies have proposed methods for measuring these print quality attributes. Toner scatter caused by toner overdevelopment in color EP laser printers can significantly impact print quality. A conventional approach to reduce toner overdevelopment is to restrict the color gamut of printers. However, this can result in undesired color shifts and the introduction of halftone texture. Woman's Work: Female Lighthouse Keepers In The Early Republic, 1820–1859, Virginia Neal Thomas

During the Early Republic between 1820 and 1859, women, on average, comprised about five percent of the principal lighthouse keepers in the United States. These women represent a unique exception to the experience of the majority of working women during the Early Republic. They received equal pay to men, and some supervised lower-paid male assistants. They filled these predominately male positions because lighthouse work had much in common with stereotypical woman's work, they were most often related to the previous keeper, and they fit within cultural ideals of gender roles. In a setting of increased movement, communication, and flows across space, commodity chain networks bring valued cultural commodities to transnational communities. This research examines the networks bringing foreign cuisine ingredients to Peruvian transnational communities in San Francisco, California. It seeks to answer three inter-related questions: 1) What are the origins and transportation networks bringing Peruvian food items to San Francisco; 2) Who controls and benefits from the movement of this food and resulting capital; and 3) How do networks vary for different classes of end consumers?
