Pro-Prosecution Judges: "Tough On Crime," Soft On Strategy, Ripe For Disqualification, Keith Swisher

In this Article, I take the most extensive look to date at pro-prosecution judges and ultimately advance the following, slightly scandalous claim: Particularly in our post-Caperton, political-realist world, “tough on crime” elective judges should recuse themselves from all criminal cases. The contextual parts to this claim are, in the main, a threefold description: (i) the "groundbreaking" Caperton v. A.T. Massey Coal decision, its predecessors, and its progeny; (ii) the judicial ethics of disqualification; and (iii) empirical and anecdotal evidence of pro-prosecution (commonly called "tough on crime") campaigns and attendant electoral pressures. As community benefits agreements (CBAs) become more common in urban redevelopment, they are generating conceptual confusion and political controversy. Planners who encounter CBA campaigns in practice have limited means of evaluating CBAs’ desirability and likely impact without a more complete understanding of how they interact in practice with municipal government leadership and policy. This paper examines four urban redevelopment projects in which community benefits agreements have been enacted by some combination of community organizations, legislators and developers. Rather than view the alleged proliferation of “czars” in recent presidential administrations as a threat to the constitutional order, we consider it part of an ongoing reorganization of the presidential branch designed to maximize leadership capacity as presidents continue to take more responsibility for policy development and implementation, a phenomenon driven as much by congressional abdication as presidential zeal for power. The real debate lies over whether the president can delegate his constitutional authority to those who work beneath him. During emerging adulthood, most youth receive family support to help them weather the difficulties associated with transitioning to independence. When foster youth emancipate, they confront the challenges associated with emerging adulthood, and are at risk of having to transition without family support. Many are in danger of failing to meet minimal levels of self-sufficiency. A caring adult who offers social support is normative for adolescent development and protective for youth across many risk conditions. Natural mentoring can cultivate such relationships. This study examines whether there is a significant relationship between homeownership and engaged parenting practices among low- and moderate-income households. Using analytic methods which account for selection effects and clustering, we test whether homeownership can act as a protective factor against parental disengagement from children. Controlling for individual characteristics, analyses demonstrate that homeowners are more likely than renters to demonstrate engaged parenting behaviors such as organizing structured activities for their children. While renters are more likely to read to their children, the children of homeowners spend less time watching television and playing video games. Implications for low-income housing policy are …

Scholars have long understood that the instability of power has ramifications for compliance with international law. Scholars have not, however, focused on how states’ expectations about shifting power affect the initial design of international agreements. In this paper, I integrate shifting power into an analysis of the initial design of both the formal and substantive aspects of agreements. I argue that a state expecting to become more powerful over time incurs an opportunity cost by agreeing to formal provisions that raise the cost of exiting an agreement. Much of the existing literature investigating the relationship between legal regimes and economic growth focuses on the agency problem of aligning judicial incentives with social welfare. In this paper I look instead at the factors that in‡fluence the quality of law when judges have incentives to promote social welfare but they have limited knowledge about the environment in which law is to be applied. Historians commonly use the twin concepts of transnationalism and diaspora in exploring the lives of overseas Asian migrants, but such analyses are only just emerging among archaeologists. These concepts forefront processes of culture change and identity formation that consider simultaneously socio-economic and cultural influences from home and host countries. They also present an interpretive framework and common axes along which scholars can compare distinct groups of migrants. This study compares patterns of material consumption among Chinese and Japanese migrants at a salmon cannery in British Columbia through the lens of social drinking.
