The First Principles Of Standing: Privilege, System Justification, And The Predictable Incoherence Of Article Iii, Christian Sundquist

This Article examines the indeterminacy of standing doctrine by deconstructing recent desegregation, affirmative action, and racial profiling cases. This examination is an attempt to uncover the often unstated meta-principles that guide standing jurisprudence. The Article contends that the inherent indeterminacy of standing law can be understood as reflecting an unstated desire to protect racial and class privilege, which is accomplished through the dogma of individualism, equal opportunity (liberty), and “white innocence.” Relying on insights from System Justification Theory, a burgeoning field of social psychology, the Article argues that the seemingly incoherent results in racial standing cases can be understood as …

Faced with the global financial crisis, which has a large impact on the world's economy, China and the United Stated took different actions to pull the economy out of it, based on the fairly different financial, fiscal, and even political systems they have. This thesis focuses on the comparison of the financial and fiscal systems and trade structures between the two different countries, and how these have impact on their stimulus packages, thus influencing the economic recovery as a whole.

This research examines the organized far right movement and interviews members of four right wing organizations to understand their goals and operations. This study compares the utility of two social movement theories, Resource Mobilization Theory (RMT) and New Social Movement Theory (NSMT) to explain the functioning of the four organizations. Resource Mobilization Theory contends that change is done politically in the sphere of institutional power, while New Social Movement Theory argues that change occurs in civil society.

Physical activity may promote cognitive health in older adults. Popular media play an important role in preventive health communication. This study examined articles discussing associations between physical activity and cognitive health in top-circulating magazines targeting older adults. 42,753 pages of magazines published from 2006 to 2008 were reviewed; 26 articles met inclusion criteria. Explanations regarding the link between physical activity and cognitive health were provided in 57.7% of articles. These explanations were generally consistent with empirical evidence; however, few articles included empirical evidence. Physical activity recommendations were presented in 80.8% of articles; a wide range was recommended (90–300 min of …

With organizations and individuals increasingly interested in accounting for their carbon emissions, greater attention is being placed on how to account for the benefits of various carbon mitigation actions available to consumers and businesses. Generally, organizations can address their own carbon emissions through energy efficiency, fuel switching, on-site renewable energy systems, renewable energy purchased from utilities or in the form of renewable energy certificates (RECs), and carbon offsets. This paper explores the role of green power and carbon offsets in carbon footprinting and the distinctions between the two products. Social controversy is a sustained, mediated debate between at least two oppositional parties which is more than just a difference of opinion; rather it is a persistent conflict over the political and cultural implications that dominant forms of communicative reasoning, practices, and norms have for a public. Simply put, during social controversies the norms guiding public life can be negotiated, reaffirmed, negated, and/or transformed. This can lead to progressive political, cultural, and/or social change in some instances, while establishing or reifying conservative and even oppressive norms, practices, and laws in others.

Critical pedagogy is an approach that we have chosen as a necessary (albeit insufficient) vehicle for transforming the world. This study sought to replicate and extend the work done by Ellis, Brody and Speranza (1998) and Speranza (2001) by examining how counselor trainees differentially use three hypothesis testing strategies (i.e., confirmatory, disconfirmatory, and unbiased) to test and develop their diagnosis within three diagnostic contexts (i.e., the clinical data presented to trainees). The study's hypotheses were the following: (1) as predicted by Speranza (2001), the diagnostic context would affect the differential use of the hypothesis testing strategies by trainees; (2) identical to Speranza (2001), trainees would use a greater number of the disconfirmatory hypothesis testing strategy when compared to the …

The frequencies of behavioral symptoms of eating disorders (e.g., binge eating and purging) are highly variable across and within individuals. The presence and severity of these symptoms define both diagnostic boundaries and outcome states, but validated tools to retrospectively assess symptom frequencies that capture variability at the week-level do not exist. This study evaluated the reliability and validity of an assessment designed for this purpose in a mixed eating disorder sample of 113 individuals recruited from the community who provided symptom frequency data once weekly for 12 weeks and completed the Interactive, Graphical Assessment Tool for Eating Disorders (IGAT-ED) on …

Gender-based bullying (GBB) includes threatening behaviors based on gender/gender-role expectations, verbal/physical harassment, unwanted sexual attention and coercion, insults, intimidation, and assaults based on sexual orientation. In this study, 342 teachers completed an online survey to identify which variables predicted their rates of witnessing and intervening in GBB. Individual variables included teacher rates of homophobia and heterosexism. Systems variables included teachers' fear of angry backlash for reporting GBB, the comprehensiveness of districts' safe school policies (SSP), the timeliness of districts' responses to reports of GBB, and the consistency of administrative responses. Objectives of this project were to evaluate polymorphisms in upstream elements of the lactate dehydrogenase B (LDHB) gene in crossbred dairy heifers (n = 27) and their effects on immune function and heifer growth when grazing endophyte-infected tall fescue. Two cultivars of tall fescue were utilized: Kentucky 31 (KY31), a wild-type endophyte-infected tall fescue, and HiMag 4 (HiMag), a domesticated non-toxic endophyte-infected tall fescue. Crossbred dairy heifers (Holstein × Jersey) were stratified by weight and randomly allotted to forage. The LDHB gene codes for one subunit of lactate dehydrogenase (LDH), an enzyme that catalyzes pyruvate to lactate and back to …

· Using a broad group of family and independent foundations from a representative sample of Georgia foundations, the authors examined differences in giving patterns between family and independent foundations.
· Findings confirm the result of previous work that studied large foundations.
· There are no substantial differences between family and independent foundations’ preferences even when controlling for a nonprofit’s location and size.
· These findings are relevant for discussions about the role of non-family members on boards.

Health disparities research seeks to understand specific health-related needs and outcomes for groups of people, particularly minority groups. In 2011, the Institutes of Medicine (IOM) released a report commissioned by the National Institutes of Health entitled The Health of Lesbian, Gay, Bisexual, and Transgender (LGBT) People: Building a Foundation for Understanding. For the first time, research on the health and well-being of LGBT persons has been prioritized by research funders at the highest levels.

The goal of the current study was to examine how the presence of a best friend might serve as protection against the effect of negative experiences on global self-worth and the hypothalamic-pituitary-adrenocortical axis (HPA axis). A total of 103 English-speaking male (n = 55) and female (n = 48) participants from Grade 5 (M = 10.27 years) and Grade 6 (M = 11.30 years) completed booklets about their experiences that occurred 20 min previously and how they felt about themselves at the moment, and they provided saliva multiple times per day over the course of 4 …

In this paper, which was prepared to help set the stage at an interdisciplinary conference held at the University of Indiana (Bloomington) in March, I first briefly review what I take to be the key events and developments in the history of the study of judicial behavior in legal scholarship, with attention to corresponding developments in political science. I identify obstacles to cooperation in the past – such as indifference, professional self-interest and methodological imperialism -- as well as precedents for cross-fertilization in the future. In this essay we review some of the evidence confirming, and some of the reasons underlying, the phenomenon of the vanishing trial in federal civil cases and examine some of the costs of that phenomenon for democratic values, including in particular democratic values represented by the right to a jury trial under the Seventh Amendment. We discuss the Supreme Court’s recent pleading decisions in Twombly and Iqbal as examples of procedural attacks on democracy in four dimensions: (1) they put the right to jury trial in jeopardy; (2) they undercut the effectiveness of congressional statutes designed to compensate citizens for …

In The Master Switch, Tim Wu argues that four leading communications industries have historically followed a single pattern that he calls “the Cycle.” Because Wu’s argument is almost entirely historical, the cogency of its claims and the force of its policy recommendations depends entirely on the accuracy and completeness of its treatment of the historical record. Specifically, he believes that industries begin as open, only to be transformed into closed systems by a great corporate mogul until some new form of ingenuity restarts the Cycle anew. This article is a contribution to a symposium issue of the Alabama Civil Rights & Civil Liberties Law Review devoted to whether severe environmental deprivation, sometimes termed rotten social background, should be a defense to crime and why it has not been adopted. I begin by presenting the framework I apply for thinking about such problems. I then identify the main theses Professors Richard Delgado and Andrew Taslitz present and consider their merits. For the past several decades, U.S. policymakers and the courts have charged a largely deregulatory course with respect to telecommunications. During the initial stages, these decisionmakers responded to technological improvements by narrowing regulation to cover only those portions of industry that remained natural monopolies and deregulating those portions that became open to competition. Eventually, Congress began regulating individual network components rather than services, mandating that incumbent local telephone companies provide unbundled access to any network element. Why is a corporation a “person” for purposes of the Constitution? This old question has become new again with public outrage over Citizens United, the recent campaign finance case which expanded corporate constitutional speech rights. This Article traces the historical and jurisprudential developments of corporate personhood and concludes that the doctrine’s origins had the limited purview of protecting individuals’ property and contract interests. Over time, the Supreme Court expanded the doctrine without a coherent explanation or consistent approach. The Court has relied on the older cases that were decided in different contexts and on various flawed conceptions of the corporation. …
