Ever since Lord Hoffmann’s authoritative restatement of the principles relating to the interpretation of contracts in Investors Compensation Scheme v West Bromwich Building Society, various common law courts and academics have weighed in with their views on two main issues: whether the contextual approach articulated in Investors in fact represents a step forward from the traditional literal approach; and, accepting the operation of the contextual approach, whether there remains room for the exclusion of certain extrinsic evidence in interpreting contracts. Sham Marriages, Ancillary Powers, And Moral Discourse: Toh Seok Kheng V. Huang Huiqun; Adp V. Adq, Siyuan Chen

Is marriage an institution (of public morality) or a contract (of private ordering)? In Toh Seok Kheng, the High Court concluded that it was unable to declare a “sham marriage” void just because the motives behind the marriage seemed improper. In ADP, the High Court held that since a void marriage meant there was no marriage to begin with, the “wife” was not entitled to maintenance, and there could not have been any “matrimonial assets” to be divided, unless she had a strong “moral” claim. This piece considers how the aforementioned moral-contractual dichotomy emerges in these cases.

Intimate partner violence is a very serious issue in the United States. In spite of improvements, there is still much work to be done. Policies focusing on formal controls such as arrest, orders of protection, and prosecution have questionable potential. However, collective efficacy and the examination of community context have much to offer the field of intimate partner violence. Collective efficacy, comprised of social cohesion, social capital, and informal social control, may be more effective in reducing intimate partner violence than use of traditional formal social controls alone. While the counseling community embraces the use of creative approaches in counseling and supervision, few researchers have attempted to empirically describe the process of including an art-based technique into counselor group supervision. A grounded theory design guided the exploration of the factors and processes of including one art-based technique into six counselor supervision groups. Six doctoral-level supervisors who were trained in an art-based technique known as the visual case processing method introduced the method to their group supervisees who were completing a semester-long practicum or internship. The United States is undergoing a critical demographic transition: The population is aging. By 2040, the proportion of people over the age of 65 will top 20 percent, and people under the age of 18 will make up almost 23 percent of the population. As a result, the oldest and the youngest populations combined will make up almost half of all U.S. residents. This trend is also a global one, directly affecting planning practice worldwide (WHO 2007). Crimes are multifaceted events that are not adequately explained with basic descriptors, yet a considerable amount of significance is afforded to relatively few simplistic labels that make up the contemporary “scarlet letter.” Today's criminal records create a lifetime of stigmatization for a person. These public records employ a limited range of information. By acknowledging the deleterious effects of even one documented criminal event on an individual's self-concept and status in society, we cannot avoid being faced with a serious moral dilemma in light of society's prevalent reliance upon electronic criminal records. Domestic Violence In Men's And Women's Magazines: Women Are Guilty Of Choosing The Wrong Men, Men Are Not Guilty Of Hitting Women, Pamela Hill Nettleton

Men's and women's magazine discourse on domestic violence characterizes women as guilty of choosing the wrong men but does not hold men responsible for hitting women. Using qualitative narrative analysis on 10 leading titles over 10 years, I find an ongoing tolerance for and celebration of domestic violence in men's magazines and an enduring expectation in women's that women bear responsibility for both genders. No magazines discuss patriarchal cultural structures that enable violence against women.

Public relations helps an organisation and its publics adapt mutually to each other. However, this does not mean that the profession is value neutral or anything goes. There will be cases where professionals have to make discretionary ethical decisions and negotiate their roles and responsibilities, especially when faced with novel or difficult issues. In this conceptual paper, we describe how the notion of professional role morality not only shapes the individual struggles that practitioners endure but also highlights the organisational structures that foster or shun ethics in the decision-making process. The relationship between doctoral students and their chairperson has been linked to students' successful completion of their dissertation and program of study (Gardner, 2009; Lovitts, 2001). It is often the case that failure to complete the dissertation is what prevents doctoral students from completing their degree. When students do not successfully complete their degrees, attrition rates rise and programs and students feel the burden, both financially and as an investment of time. (Bair & Haworth, 2004). Within this study, teens are asked to analyze yoga studio homepages in relation to their experiences with the practice of yoga. This dissertation research engages the teen girls as participants responsible for co-designing the learning constructs through which they make meaning out of their experiences. This research is rooted in informational design, experiential design, and design practices for a teen demographic through the artifact of yoga.
Participant observation is used to examine how eight teen girls understand yoga as a practice, internalize their experiences with yoga, and thusly communicate what they have learned about yoga and a sampling of digital …

The certification of financial aid administrators has been debated for over 37 years. A job satisfaction survey conducted by the National Association of Student Financial Aid Administrators (NASFAA, 2008a) revealed that college and university administrators' perceptions of the efficiency, effectiveness, and quality of the services provided by the financial aid office have a direct effect on the job satisfaction of financial aid practitioners. The study also hinted at a possible link between these perceptions and the resources allocated to the financial aid office. A substantial amount of research has been done on Hurricane Katrina and its effects on New Orleans, Louisiana. However, few studies have focused on how the Mississippi Gulf Coast was affected by the hurricane. The purpose of this study is to bring attention to the reporting efforts of WLOX-TV and The Herald newspaper to cover Hurricane Katrina. This case study analyzes the practices WLOX and The Herald used to cover the hurricane and to explore which practices could be implemented in other newsrooms in the future. This dissertation consists of three essays. The first essay, Short Sales in the NYSE Batch Open and NASDAQ Opening Cross, examines opening-trade short volume's relation to short volume for the rest of the trading day and to overnight, previous-day, and same-day price changes. We find that short volume in the batch open and opening cross increases with short volume for the rest of the day, with previous-day, open-to-close price changes, and with overnight price changes for S&P 500 stocks. Batch-open short volume increases with overnight price changes, and it increases (does not decrease) for firms making positive (negative) overnight earnings …

The purpose of this qualitative content analysis was to identify themes found in children's quilt picture books that could connect to the Iowa Core Curriculum Social Studies Standards. Elementary teachers could utilize the quilt picture books to teach the elementary social studies curriculum. This researcher analyzed 15 quilt picture books with a copyright of 1994 and newer that were in the Wilson Children's Core Collection. The themes that emerged from the content analysis of children's quilt picture books were generosity, slavery, multicultural, generational, and westward expansion.
