Beyond Principal-Agent Theories: Law And The Judicial Hierarchy, Pauline Kim

This Essay critically examines the commonplace use by judicial politics scholars of principal-agent models to describe the federal judicial hierarchy. It argues that agency models are useful in highlighting certain aspects of the interaction between upper and lower courts - specifically, the existence of value conflicts and informational asymmetries - but that in other ways traditional principal-agent models fit poorly the relationship between the lower federal courts and the Supreme Court. As a consequence, these models tend to obscure important normative questions about the relationship between lower and upper courts, as well as to distort the role that law plays …

The international refugee protection system is under threat. States weary of increased refugee flows and preoccupied with national security increasingly exploit legal gaps or avoid refugee law altogether. The U.S. approach to resettlement of Guantánamo detainee refugees exemplified this trend. Yet, in the Guantánamo context, U.S. avoidance of international refugee law put the executive in a bind that it could not easily escape: Because the U.S. executive was unwilling to assume the political cost of resettling the refugee detainees domestically, it resorted to peddling them for resettlement to foreign states while, at the same time, mounting a robust legal defense …

The conception of tort privacy developed by Warren, Brandeis and Prosser sits at the heart of American understandings of privacy law. Rooted in protection of private information against unwanted collection, use, and disclosure, tort privacy protects against emotional injury, and was directed by design against disclosures of true, embarrassing facts by the media. In this essay, I argue that as conceived by Warren and Brandeis and interpreted by Prosser, tort privacy is a poor vehicle for grappling with problems of privacy and reputation in the digital age. This study translated SiHLE (Sisters Informing, Healing, Living, and Empowering), a 12-hour Centers for Disease Control and Prevention evidence based group-level intervention for African American females 14-18 years of age, into a 2-hour computer-delivered individual-level intervention. A randomized controlled trial (n = 178) was conducted to examine the efficacy of the new Multimedia SiHLE intervention. Average condom-protected sex acts (proportion of vaginal sex acts with condoms, last 90 days) for sexually active participants receiving Multimedia SiHLE rose from M = 51% at baseline to M = 71% at 3-month follow-up (t = 2.06, p = .05); no statistically significant difference …

The authors tested the proposition that the ubiquity of HeinOnline in law libraries would alter law review citation patterns. Has HeinOnline’s provision of the full runs of law reviews in full text led to more citations to older materials? This article reports the results of the study they undertook to test this theory.

The Knowledge Bases and Related Tools (KBART) project is an initiative of the National Information Standards Organization (NISO) and UKSG which has established a set of best practices for the exchange of electronic resource holdings metadata between content providers and knowledgebase developers. The benefits of KBART are that it relieves information professionals from the time consuming process of actively reconciling electronic journal title lists, and addresses the many inadequacies which are common in title holdings lists. In American football, impacts to the helmet and the resulting head accelerations are the primary cause of concussion injury and potentially chronic brain injury. The purpose of this study was to quantify exposures to impacts to the head (frequency, location and magnitude) for individual collegiate football players and to investigate differences in head impact exposure by player position. A total of 314 players were enrolled at three institutions and 286,636 head impacts were recorded over three seasons. The 95th percentile peak linear and rotational acceleration and HITsp (a composite severity measure) were 62.7g, 4378 rad/s², and 32.6, respectively. …

Description of a costing model developed by digital production librarian to determine the cost to put an item into the Claremont Colleges Digital Library at the Claremont University Consortium. This case study includes variables such as material types and funding sources, data collection methods, and formulas and calculations for analysis. This model is useful for grant applications, cost allocations, and budgeting for digital project coordinators and digital library projects.

Human trafficking is an international problem that penetrates every society on the globe. Trafficking in children for the purposes of commercial sexual exploitation, forced labor, and domestic servitude occurs in every state of the United States. Education is key in preventing human trafficking and American students lack proper knowledge of the issue. This study seeks to bridge this shortcoming through the creation and implementation of a holistic anti-trafficking advocacy curriculum that not only informs and motivates students and educators toward advocacy, but also meets Colorado state academic standards. There is longstanding tension in the study of religion between those who believe religion can be reduced to general psychosocial processes and those who think that religion is somehow unique. One way to test these two possibilities is to compare religious versions of mechanisms to nonreligious versions. If religion is somehow unique, then the religious versions should explain variance in outcomes that the nonreligious versions do not. Three studies confirmed religion's independent predictive power. Unlike microeconomics where there are relatively few disagreements, the field of macroeconomics has always been the arena of several competing theories. Despite that history of conflict, in the late 1980s during the Great Moderation, the New Classicals and the New Keynesians reached an agreement, known as the New Consensus during the Great Moderation. For decades, the New Consensus has dominated macroeconomic theory and policymaking not only in the U.S., but also throughout the world. After many years of calm, however, the 2007-2008 subprime mortgage crisis and its consequent Great Recession demonstrated that how fragile that consensus was.

In light of both the 2003 UNESCO Convention for the Safeguarding of the Intangible Cultural Heritage and the efforts of the Smithsonian Center for Folklife and Cultural Heritage in producing the Smithsonian Folklife Festival, it has become clear that work with intangible cultural heritage in museums necessitates staff to carry out ethnographic fieldwork among heritage communities. Following recent trends in scholarship that establish museums as complex sites where representations of Native American cultures are actively negotiated, this thesis explores the relationship between representational strategies and the employment of critical Indigenous methodologies by museum institutions in the display of Navajo weavings. A postcolonial theoretical framework is utilized to analyze six Navajo weaving exhibition installments over the past decade. This dissertation explores the rhetorical fragments in three case studies of the American Labor Movement constituting movement members in solidarity. Using Kenneth Burke's discussion of rhetorical substance, this project explores the possibilities for developing deep and broad forms of solidarity within the American Labor Movement. Rhetorical fragments of the Industrial Workers of the World, the United Farm Workers, and contingent faculty unionization efforts are explored.

I argue Burke's ideas of substance and identification provide a powerful lens through which we can examine the solidary practices of social movements. Through the examination of the case studies mentioned, I demonstrate that solidarity …

This quantitative study investigated student and faculty attitudes toward use of Digital Media Technology (DMT) at the University of Denver. The purpose was to understand how and why students and faculty used DMT on campus. Catastrophic natural disasters remain a constant and recurring mortal threat to people around the world. Since prevention of the events themselves is impossible, it is important to examine those factors which can reduce the loss of life and enable successful recovery. We intuitively expect good governance to be one of these factors. This paper discusses the concepts of governance and long-term disaster recovery and the difficulties inherent in numerically capturing these qualities. It explores the correlation between governance indicators and three development and economic measurements of recovery. Three case studies are used to qualitatively and anecdotally address the topic.

Ecotourism and cultural tourism are emerging as vehicles for many of the world’s indigenous peoples to integrate into the global market economy. The ecological knowledge and understanding of these societies may in turn be affected by these nascent industries. As part of shifting human-environment relationships, tourism can influence place-based spirituality. In this manuscript, I describe research on how tourism affected Khumbu Sherpa place-based spiritual values in Sagarmatha (Mt. Everest) National Park and Buffer Zone, Nepal. Consolidated Public Safety Dispatch Centers: Us Case Studies, Daila Shimek, Scott Winograd, Kimberly Renee Vining

This report includes case studies of consolidated dispatch centers in the United States. Each case study includes descriptions of the governing and operating structure, consolidation process, funding and fee structure, and the successes, challenges and lessons learned by each entity. The results suggest that, although the experiences among consolidated dispatch centers varied, the elements that should contribute to a successful transition are strong leadership, communication with affected employees, ability to compromise, consistency in treatment of employees, development of standard operating procedures, stakeholder inclusion, and beginning consolidation with a clear plan that treats all participants as equal partners.
