Jose E. Martinez-Reyes

Critical Race And Disability Framework: A New Paradigm For Understanding Discrimination Against People From Non-English Speaking Backgrounds And Indigenous People With Disability, Louise St Guillaume Dec 2010

Critical Race And Disability Framework: A New Paradigm For Understanding Discrimination Against People From Non-English Speaking Backgrounds And Indigenous People With Disability, Louise St Guillaume

Louise St Guillaume

This article develops a new paradigm for critically examining the problems
with the Racial Discrimination Act 1975 (Cth) and the Disability
Discrimination Act 1992 (Cth) for redressing discrimination experienced by
people from non-English speaking backgrounds (NESB) and Indigenous
peoples with disability. It highlights the limitations of a critical race and
whiteness studies approach and a disability studies perspective for NESB
and Indigenous peoples with disability through the development of a new
paradigm I term critical race and disability. A critical race and disability
approach foregrounds the intersectional multidimensional categories of
people’s identities and argues that the ideal disembodied social actor …

A New Solution For Salary Disputes: Implementing Salary Arbitration In The National Basketball Association, Scott Bukstein Jd Dec 2010

A New Solution For Salary Disputes: Implementing Salary Arbitration In The National Basketball Association, Scott Bukstein Jd

Scott Bukstein JD

This paper proposes that the National Basketball Association (NBA) adopt a salary arbitration system in specifically defined circumstances—for restricted free agents who either last played under a four-year rookie salary scale contract, or last played under a two-year or three-year contract as a second-round draft pick or undrafted free agent. Part I of this paper summarizes the use of salary arbitration in professional sport leagues. Part II of this paper provides an overview of the current arbitration procedures in the NBA. Part III of the paper outlines a proposed new NBA salary arbitration model. Part IV discusses some of the …

Understanding Chronic Non-Communicable Diseases In Latin America: Towards An Equity-Based Research Agenda, Fernando De Maio Dec 2010

Understanding Chronic Non-Communicable Diseases In Latin America: Towards An Equity-Based Research Agenda, Fernando De Maio

Fernando De Maio

Growing evidence suggests that although traditionally depicted as ‘diseases of affluence’, chronic non-communicable diseases actually strike along the fault lines of social inequality. The challenge of understanding how these conditions shape patterns of population health in Latin America requires an inter-disciplinary lens. This paper reviews the burden of chronic non-communicable diseases in the region, examines key myths surrounding their prevalence and distribution, and argues that a social justice approach rooted in the idea of health inequity needs to be at the core of research in this area. In conclusion, an approach to guide empirical research – the ‘average / deprivation …

Introductory Essay: Canada ’S Own Brand Of Truth And Reconciliation?, Joanna R. Quinn Dec 2010

Introductory Essay: Canada ’S Own Brand Of Truth And Reconciliation?, Joanna R. Quinn

Joanna R. Quinn

The question of how societies might reach some kind of truth or reconciliation is complicated in post-conflict societies, where physical and social devastation is obvious. Yet in so-called “settler” societies, evidence of that kind of devastation, including the gross violation of human rights and blatant abuse, along with the lasting impact of that abuse, remains invisible to many, as outlined by the authors who have contributed to this special edition.

Sierra Leone's 2007 Elections: Monumental And More Of The Same, Fredline A. O. Mcormack-Hale, Kevin S. Fridy

Fredline MCormack-Hale

When the National Electoral Commission of Sierra Leone announced that Ernest Bai Koroma and his party, the All People’s Congress, had been elected to replace the incumbent Sierra Leone People’s Party government, Sierra Leone joined a growing number of African nations to have experienced a peaceful turnover of power from one popularly elected government to another. Though the electoral tallies were not without their critics, the overwhelming sentiment both within Sierra Leone and without was that the 2007 elections marked a positive turning point in the country’s political history. Using newly released census data and election results, we analyze the …

Predicting Adolescents’ Future Intentions To Seek Help For Mental Health Problems., Coralie J. Wilson

Frank Deane

This study examined whether high school students’ current symptoms of general psychological distress, self-rated social problem-solving skills, and recent help-seeking experiences predict their future intentions to seek help for a mental health problem. At Time 1, 98 high school students, aged 12-17 years, completed the study self-report survey that included measures of psychological distress, social problem-solving skill, and recent help-seeking behaviour. At Time 2, three weeks later, the same students completed measures of help-seeking intentions. Students with more severe levels of distress symptoms at Time 1 had lower intentions to seek help for a mental health problem at Time 2. …

Performing Heteronormativity, Hegemonic Masculinity, And Constructing A Body From Bullying, Brandon O. Hensley

Brandon O. Hensley

Drawing upon literature in postmodern selfhood, bodybuilding subculture, embodied performance, and (re)construction of hegemonic masculinity in 21st century American culture, this exercise in autoethnography aims to contribute to the qualitative dialogue regarding the masculinized performance of (un)healthy embodiment through working out, along with the pleasures, pressures, meanings, and implications that come with it.

Judicial Expenditures And Litigation Access: Evidence From Auto Injuries, Paul Heaton, Eric Helland Dec 2010

Judicial Expenditures And Litigation Access: Evidence From Auto Injuries, Paul Heaton, Eric Helland

Paul Heaton

Despite claims of a judicial funding crisis, there exists little direct evidence linking judicial budgets to court utilization. Using data on thousands of auto injuries covering a 15-year period, we measure the relationship between state-level court expenditures and the propensity of injured parties to pursue litigation. Controlling for state and plaintiff characteristics and accounting for the potential endogeneity of expenditures, we show that expenditures increase litigation access, with our preferred estimates indicating that a 10% budget increase increases litigation rates by 3%. Consistent with litigation models in which high litigation costs undermine the threat posture of plaintiffs, increases in court …

Dangerous Psychopaths: Criminally Responsible But Not Morally Responsible, Subject To Criminal Punishment And To Preventive Detention, Ken Levy Dec 2010

Dangerous Psychopaths: Criminally Responsible But Not Morally Responsible, Subject To Criminal Punishment And To Preventive Detention, Ken Levy

Ken Levy

How should we judge psychopaths, both morally and in the criminal justice system? This Article will argue that psychopaths are generally not morally responsible for their bad acts simply because they cannot understand, and therefore be guided by, moral reasons.

Scholars and lawyers who endorse the same conclusion automatically tend to infer from this premise that psychopaths should not be held criminally punishable for their criminal acts. These scholars and lawyers are making this assumption (that just criminal punishment requires moral responsibility) on the basis of one of two deeper assumptions: that either criminal punishment directly requires moral responsibility or …
