TESOL theory is intended to inform teacher practice, but studying what teachers actually do in a given teaching context can sometimes lead to better theory. This report illustrates an area in which practice informed theory in the context of 1-on-1 writing conferences for prematriculated ESL writers. This report describes the creation and implementation of a writing conference program for 250 prematriculated students at an Intensive English Program (IEP) with language proficiencies ranging from high-beginning to low-advanced. Language learners and educators have subscribed to the belief that those who go abroad will have many opportunities to use the target language and will naturally become proficient. They also assume that language learners will develop relationships with native speakers allowing them to use the language and become more fluent, an assumption Pellegrino (Pellegrino, 1997, 1998) found to be held by study abroad participants. Objectives

This article examines Barack Obama's efforts to interpret and characterize the contrasting outcomes of the 2008 and 2010 elections, using an original data set of presidential communications.

Methods

We performed a content analysis of 241 presidential communications.

Results

Obama's post-2008 mandate claims alternated between claiming a mandate on a variety of policy issues and framing the election as a repudiation of Republican theories of governing. Post-2010, however, Obama framed the midterm results as evidence for electoral demand for bipartisan cooperation, rather than a repudiation of Democratic policies and ideas.

A primary goal of the Patient Protection and Affordable Care Act (PPACA) is to reduce the number of uninsured by making health insurance more affordable for small businesses and individuals. Toward that end, the PPACA encourages the creation of nonprofit, member-owned health insurance cooperatives to operate inside each state exchange. Co-ops face significant challenges in entering mature insurance markets, but they also possess unique characteristics that may help them survive and thrive. Using Common Ground Healthcare Cooperative in Wisconsin as a case study, this article traces the origins of co-ops in health care reform at national and state levels and …

The Intellectual Standard

Cultural relativism is the ever-popular theory claiming that, “any set of customs and institutions, or way of life, is as valid as any other” (Hartung,1954). In its appeal to tolerance—the seemingly incontrovertible “virtue” of the modern era—it has gained wide appeal amongst myriad disciplines, most notably in the social sciences (UNESCO, 1995). However, the theory is destructive in both theory and practice. In theory, cultural relativism emphatically denies reason and objective reality (Zechenter, 1997). In practice, it sanctions the worst manifestations of violence and oppression.

Many commentators credit the Supreme Court’s decision in Basic, Inc. v. Levinson, which allowed courts to presume reliance rather than requiring individualized proof, with spawning a vast industry of private securities fraud litigation. Today, the validity of Basic’s holding has come under attack as scholars have raised questions about the extent to which the capital markets are efficient. In truth, both these views are overstated. In the fall of 2013 Sturgis Library began investigating new collection development methods for serving the needs of students and faculty at Kennesaw State University (KSU), with the intent to enhance both collection and service excellence. One area targeted for improvement beginning in FY2013- 2014 was interlibrary loan service. These challenges include technological illiteracy, prohibitive cost, and the effect of these technologies on the traditional library environment. In this essay prepared for the University of Pennsylvania’s conference on Intellectual Property and the Common Law, I build upon my work on custom and intellectual property. I focus here on one important facet of the subject — how longstanding common law principles should inform our understanding of custom. The common law provides a number of lessons on how to appropriately limit the consideration of custom in intellectual property law and elsewhere. This Article advances a normative case for using say on pay litigation to enhance the state courts’ role in policing directors’ compensation decisions. Outrage over what many perceive to be excessive executive compensation has escalated dramatically in recent years. In 2010, such outrage prompted Congress to mandate say on pay—a nonbinding shareholder vote on executive compensation. In the wake of say on pay votes, some shareholders have brought suit against directors alleging that a negative vote indicates a breach of directors’ fiduciary duties. To date, the vast majority of courts have rejected these suits. This Article insists that such rejection …

Getting To Rights: Treaty Ratification, Constitutional Convergence, And Human Rights Practice, Zachary Elkins, Tom Ginsburg, Beth A. Simmons

This Article examines the adoption of rights in national constitutions in the post-World War II period in light of claims of global convergence. Using a comprehensive database on the contents of the world’s constitutions, we observe a qualified convergence on the content of rights. Nearly every single right has increased in prevalence since its introduction, but very few are close to universal. We show that international rights documents, starting with the Universal Declaration of Human Rights, have shaped the rights menu of national constitutions in powerful ways. In this research, I performed a content analysis of the required courses in technical and professional communication (TPC) graduate course syllabi to investigate the prevalence of ethics-related materials included in course instruction. The literature on the topic of ethics instruction in TPC programs identifies ethics as an important area of study for technical communication students. The literature also suggests that effective ethics instruction is layered into assignments and throughout TPC curricula. The content analysis for my research included collecting the syllabi of required courses from a sample of TPC graduate programs, and coding for the occurrence of journal articles and …

The alienability of legal claims holds the promise of increasing access to justice and fostering development of the law. While much theoretical work points to this possibility, no empirical work has investigated the claims, largely due to the rarity of trading in legal claims in modern systems of law. In this paper we take the first step toward empirically testing some of these theoretical claims using data from Australia. We find some evidence that third-party funding corresponds to an increase in litigation and court caseloads. Cases with third-party funders are more prominent than comparable ones. Background: The strong association between family history and prostate cancer (PCa) suggests a significant genetic contribution, yet specific highly penetrant PCa susceptibility genes have not been identified. Certain single-nucleotide-polymorphisms have been found to correlate with PCa risk; however uncertainty remains regarding their clinical utility and how to best incorporate this information into clinical decision-making. Genetic testing is available directly to consumers and both patients and healthcare providers are becoming more aware of this technology. Purchasing online allows patients to bypass their healthcare provider yet patients may have difficulty interpreting test results and providers may be called upon to interpret results. …

Policy shifts over the past 20 years have created an agenda that calls for a sustained commitment to integrated employment for individuals with disabilities. But despite these clear intentions, unemployment of individuals with disabilities continues to be a major public policy issue.

For people with intellectual and developmental disabilities (IDD), the disparity in labor market participation grows. Data suggest only 14.7% of individuals who receive supports from state IDD agencies work in either individual or group integrated employment, and 19% of individuals who receive day services from a state IDD agency participate in a service designed to support integrated employment …

The importance of cultural resource preservation cannot be overstated; however local economies are at least as important. Due to conservative archaeological site protection practices in Region 5 of the United States Forest Service, the economy of Northeastern California is being adversely affected. In an attempt to help the Forest Service make more informed management decisions and improve the Northeastern California economy, I undertook experiments on the effects of timber harvesting on lithic scatters on Modoc National Forest. The Center for Disease Control and Prevention estimated that there are 1.6-3.8 million sports related traumatic brain injuries in the United States annually which occur in both mainstream and extreme sports. Many of these concussions have been associated with collisional sports, like football, but high risk extreme sports, like motocross, also have many opportunities for collisions to occur. Unlike traditional varsity sports motocross races, especially at the amateur level, do not require more than advanced life support at a race in case of emergency situation leaving the amateur rider to recognize and decide on concussion management.
