Custom’S Last Stand: Why Mlb Trusts Tradition To Police Player Conduct And The Nfl Doesn’T, Mitchell J. Nathanson

This article examines the divergent ways player conduct is governed within the NFL and Major League Baseball and presents a hypothesis that might explain the differences.  It surveys the governing principles of participant comportment within both sports and asserts that while Major League Baseball is, and has been since the game’s inception, ruled largely in this regard by informal custom, the NFL eschews such an approach in favor of the formation, application and regular updating of formal, positive law.  As for why these different governing approaches exist, this article posits that the answer can be found within the origins of …

The S7-LES assesses the presence of negative or maladaptive responses (secondary crises) to medical events, illnesses, and procedures in relation to seven life domains.  The tool is a self-administered checklist that can be completed by patients in a provider’s office after a medical procedure, hospital admission, life-threatening diagnosis, or any other circumstances deemed appropriate by providers.

Agents in contemporary societies are faced continually with choices regarding engagement with technological artifacts. They can choose to engage or decline engagement after considering the costs and benefits in each case. However, certain aspects of the surveillance society may be irresistible in a number of ways, so that refusal to engage with them is not a realistic option. The proliferation of the Internet of Things (IoT), particularly as embedded in “smart city” initiatives, helps to make surveillance technologies potentially irresistible. The negative influence of adverse childhood experiences (ACEs) on social, emotional, and behavioral (SEB) outcomes are well documented. However, no research to date has examined the effect of ACEs on SEB outcomes in youth who received mental health services after reporting to the child welfare system. This study's analyses of data from the National Survey of Child and Adolescent Well-Being II revealed that the most prevalent ACEs included hospitalization for a medical condition, neglect, and exposures to domestic and community violence. Individuals with a personality disorder (PD) tend to experience more negative life events (NLEs) than
positive life events (PLEs). In community samples, the Five Factor Model of personality (FFM) predicts
both positive and negative life events. The present research examined whether FFM normal personality
traits were associated with positive and negative life events among individuals with 1 of 4 PDs: avoidant,
borderline, schizotypal, and obsessive– compulsive, and tested whether associations between the FFM of
personality and PLEs and NLEs were similar across the 4 PD groups and a control group. Among

More than 40% of US corn is now used to produce biofuels, which are used as substitutes for gasoline in transportation. Biofuels have been blamed universally for past increases in world food prices, and many studies have shown that these energy mandates in the US and EU may have a large (30-60%) impact on food prices. In this paper, we use a partial equilibrium framework to show that demand-side effects - in the form of population growth and income-driven preferences for meat and dairy products rather than cereals - may play as much of a role in raising food prices …

This paper formally models the virtues of Edmund Burke's conservatism, characterizes the optimal level of conservatism, and applies the model to management, law, and policy.  I begin by introducing ``switcher's curse,'' a trap in which a decision maker systematically switches too often. Decision makers suffer from switcher's curse if they forget the reason that they maintained incumbent policies in the past and if they naively compare rival and incumbent policies with no bias for incumbent policies.   Conservatism emerges as a heuristic to avoid switcher's curse. This study argues that different cities in China have different resource environments available for NGOs. Organizations react to these resource environments by constructing appropriate resource strategies, which in turn shape the characteristics and structures of the NGOs of that city. It further examines how these characteristics and structures influence the construction and performance of citizenship in an authoritarian environment. Specifically, some types of NGOs encourage Chinese citizens to be passive, while others offer a model for people to actively engage with social issues. This article suggests that Chinese NGO do not have the conviction that they are part of an epistemic community in mainland China. Interviews conducted in four cities, Chongqing, Kunming, Nanjing and Shanghai, suggests that this can be attributed to a lack of set standards and professionalization governing their sector of operation. Further, the study finds that Chinese NGOs do not see their primary role is to produce knowledge within their organizational development life cycle. The Beijing Consensus represents a philosophical movement towards an ultra-pragmatic view of conducting policy deliberation. Contrary to models of development which provide a subset of policy prescriptions for the policymakers’ disposal or a fundamentalist adherence to a particular economic tradition, the Beijing Consensus inherently recognizes that each development scenario has a potential set of challenges that may require unique and/or experimental solutions factoring the current political, social and economic environment. Received wisdom views political humor, viz. egao, in the Chinese cyber public sphere as a form of resistance. This study creates and tests a framework that best conceptualizes how different functions of egao are connected with one another: to analyze the patterns of ties that link the different facets of the phenomenon together. The study contends that by framing egao within network society theory, we can appreciate its fluidity and better understand its online ubiquity. This article evaluates the effectiveness of two major European Union technical assistance programmes, IPR2 and IP Key, in shaping China’s regional intellectual property (IP) enforcement. It argues that although technical assistance programmes have been effective in influencing the national IP legal framework, it has been less successful in assisting regional policy enforcement. This is primarily the result of divergent economic priorities at the sub-national level. The article further assesses potential priorities for future IP technical assistance.

The Medical Mental Health Screening tool assesses risk factors that can contribute to adverse psychological responses (specifically, traumatic stress responses) to medical events, illnesses, and procedures. It is a pre-screening tool and should be used as a means of flagging risk factors and intervening appropriately in order to prevent or minimize adverse emotional reactions to medical care.
The tool is a self-administered checklist that can be completed by patients during pre-admission to the hospital for a scheduled procedure, in a provider’s office prior to hospital admission, or in other circumstances deemed appropriate by clinicians.

Children’s descriptions of clothing placement and touching with respect to clothing are central to assessing child sexual abuse allegations. This study examined children’s ability to answer the types of questions attorneys and interviewers typically ask about clothing, using the most common spatial terms (on/off, outside/inside, over/under). Ninety-seven 3- to 6-year-olds were asked yes/no (e.g. “Is the shirt on?”), forced-choice (e.g., “Is the shirt on or off?”), open-choice (e.g., “Is the shirt on or off or something else?”), or where questions (e.g., “Where is the shirt?”) about clothing using a human figurine, clothing, and stickers. The purpose of this study was to explore the experiences of Black female college athletes at a Division I historically Black college/university (HBCU) and historically White institution (HWI) and identify key influences that facilitated their academic achievement and positive educational experiences. Two focus groups and eight individual interviews were conducted with three Black female college athletes at a HBCU and five Black female college athletes at a HWI. An 8-item demographic questionnaire was administered to obtain information related to the participants’ personal backgrounds. This paper proposes a method to estimate unconditional quantile treatment effects (QTEs) given one or more treatment variables, which may be discrete or continuous, even when it is necessary to condition on covariates.  The estimator, Generalized Quantile Regression (GQR), is developed in an instrumental variable framework for generality to permit estimation of unconditional QTEs for endogenous policy variables, but is also applicable in the conditionally exogenous case.  The framework includes simultaneous equations models with nonadditive disturbances which are functions of both unobserved and observed factors.  Quantile regression and instrumental variable quantile regression are special cases of GQR and available in …
