Certain battalion chiefs in the Kern County, California fire department are not executives under the Fair Labor Standards Act (FLSA). That's what the 9th U. S. Circuit Court of Appeals said in Abshire v. County of Kern, 908 F.2d 483 (1990). In March, the U. S. Supreme Court refused to review that decision, in effect upholding it. Some newspapers called that case an expensive disaster for municipalities. The real question is whether the executives in a city's municipal departments are executives as defined by FLSA.

Railroad Deregulation And Rail Rates: A Disaggregated Analysis, Mark L. Burton

This investigation first provides a highly disaggregated study of deregulated railroad rates for seventeen commodities. The results indicate that the Staggers Rail Act fundamentally altered the way in which rail carriers price their services. Rates now adhere more closely to incurred costs and exhibit a heightened sensitivity to the presence of both intermodal and intramodal competition. The model is then extended to accommodate the possibility of shipper responses to changed carrier behavior. The results of this extension suggest that shippers have responded eagerly to altered railroad behavior by changing the characteristics of their shipments. The Age-Related Effects Of Reproduction On Bone Mineral Density In Saddle-Back Tamarins (Saguinus Fuscicollis, Callitrichidae, Primates), Rachel A. Power

This research examines the age-related effects of reproduction on bone mineral density in saddle-back tamarins (Sanguinus fuscicollis). Analyses of variance and bootstrapping statistical techniques were performed on a sample of 69 tamarins (31 males and 38 females) in order to determine the relationship between bone mineral density, age, gender, and reproductive status. The total sample of tamarins exhibits a significant decrease in bone mineral density with age, paralleling the condition observable in humans and Old World monkeys. Nailing Down The Pattern In Historical Archaeology, Amy L. Young

This study suggests that middle-range research has an important role to play in historical archaeology. Three models are developed for interpreting nail assemblages from 19th and 20th century contexts. All models are based upon ethnoarchaeology, experimental archaeology, and direct observations of nails operating in their systemic contexts. The first model allows for discriminating between a nail assemblage from an ephemeral structure site and an assemblage from a dump site. The second model enables the archaeologist to identify whether a building was log, timber frame, or balloon frame construction. The Revenue Reconciliation Act of 1990 (Act) passed by Congress imposed increases in federal excise taxes on gasoline and diesel fuel. The tax on gasoline was increased to 14.1 cents per gallon while the tax on diesel fuel was raised to 20.1 cents per gallon. The new rates became effective December 1, 1990.

This article reports that by March or April 1991, all of the H. W. Wilson Company databases will become available on the Bibliographic Retrieval Service (BRS) online system. After seven years of exclusivity on WILSONLINE, the Wilson databases are branching out and BRS is only the first extension. Starting in 1986, Wilson offered ways to access electronic versions of its indexes. Many libraries have purchased selected Wilson indexes on CD-ROM to emphasize end-user searching. BRS implementation of the Wilson files is planned in stages throughout 1991. Stage 1 will bring up Readers' Guide to Periodical Literature, Applied Science & Technology …

During the 1991 session of the Tennessee General Assembly, more than 1,500 bills were introduced in each house. From these bills, our legislature adopted 523 new public acts. This publication, a joint effort of the Municipal Technical Advisory Service and the 1ML Risk Management Pool, summarizes those acts that affect municipalities and municipal officials. These two organizations feel that if municipal officials know about new laws, they are more likely to conform their actions to those laws.

Social Processes In Work Groups: A Model Of The Effect Of Involvement, Credibility, And Goal Linkage On Training Success, Catherine S. Clark

The effect of social processes in the work group on training has not been systematically studied. A model is proposed that considers the influence of pre-training social processes and supervisor credibility on expected training utility, training motivation and learning.

Survey data were collected before and after training in organizations from a large southern metropolitan area. Social process variables include group goal linkage, expected supervisor and work group training transfer climates, and involvement in training decision. In addition, job involvement and supervisor credibility were assessed. Dependent variables included expected job and career utility of training, motivation to take training, and learning. …

Murray Rothbard's anarcho-capitalism represents an largely unexplored portion of American political thought. Despite an overwhelming array of publications on politics, economics, history, methodology, and other realms of social theory, his writings have received very little attention from the community of social theorists.

A significant reason for the lack of analysis concerns the unique and radical nature of Rothbard's thought. Although this research concludes that his form of anarchism is surely an American phenomenon, he combines the influences upon his writings in ways which ultimately separate him from even his libertarian colleagues. This article introduces Faxtex, a series of database products by Searchcraft. Faxtex is being started for the purpose of leapfrogging over the primary three limitations in the industry namely, the need for a computer or a terminal, a modem and a password. Searchcraft's Faxtex service is a series of database products that have the potential to become the first truly mass-market, consumer-oriented database products. Faxtex requires only a touchtone phone to search textual databases. The user dials one of a series of 900 telephone numbers to connect to the Faxtex service. Tennessee Code Annotated (TCA) 50-3-2001- 2019, the Hazardous Chemical Right-To-Know Law, became a law in 1985. The stated purpose of the law was to "provide access to information regarding hazardous chemicals to enhance the ability of manufacturing and non-manufacturing workers to minimize hazardous exposure to such chemicals; to provide information to emergency personnel to protect the public health, safety and welfare; and to provide information to citizens to enable them to make informed decisions regarding their safety, health, and welfare."
