This Article advances the thesis that real options are not only ubiquitous in law, but also provide novel insights about legal decision making, doctrines and rules. An introduction provides a brief a primer about financial options, real options, and real options in law. Part I of this Article develops implications of the fact that every lawsuit contains a sequence of real options for the plaintiff to unilaterally abandon that lawsuit. Part II of this Article appraises the limitations of game-theoretic analysis of the abandonment options embedded in litigation and some responses to such limitations. The Nebraska Legal Services Corporation (NLSC) believes that it is increasingly necessary to provide funding sources, such as the Nebraska State Legislature and other potential contributors, with factual-information that is critical in making funding decisions. To meet this necessity, NLSC contracted with the University of Nebraska at Omaha (UNO), Center for Public Affairs Research (CPAR) to conduct an economic impact study.

No Free Lunch: How Settlement Can Reduce The Legal System's Ability To Induce Efficient Behavior, Abraham Lee Wickelgren

While there is widespread agreement that it is better for cases to settle than go to trial, the arguments in favor of settlement have typically overlooked how settlement affects one of the most important functions of the legal system: influencing the behavior that gives rise to lawsuits. This essay argues that, in some cases, settlement can impair the ability of the legal system to deter harmful behavior without chilling desirable behavior. Where it exists, this effect is a fundamental property of settlement in that there is no way to change other legal rules to eliminate it. Because settlements also have …

The Anchor began in 1887 and was first issued weekly in 1914. Covering national and campus news alike, Hope College’s student-run newspaper has grown over the years to encompass over two-dozen editors, reporters, and staff. For much of The Anchor's history, the latest issue was distributed across campus each Wednesday throughout the academic school year (with few exceptions). As of Fall 2019 The Anchor has moved to monthly print issues and a more frequently updated website. Occasionally, the volume and/or issue numbering is irregular.

What started out as a relatively good crop year for Nebraska rapidly changed during mid-summer. With the drought of 2002 fresh on producers’ minds this spring, many were relieved to receive enough precipitation and good planting weather to get the corn and soybean crop off to an above average start. A return to hot and dry conditions across much of Nebraska and other Corn Belt states in 2003, however, has resulted in a deterioration of crop conditions and lower yield expectations.

The Federal Communications Commission voted in a contentious three-two split to relax rules limiting ownership of TV stations, radio stations, and newspapers. Among its critics are members of Congress who may pass legislation reinstating the old rules. Others will likely file suit against the FCC in the hopes of overturning the decision. This article will discuss the current debate over media deregulation in light of the recent FCC order. Time Course Of Loudness Recalibration: Implications For Loudness Enhancement, Yoav Arieh, Lawrence E. Marks

Department of Psychology Faculty Scholarship and Creative Works

Loudness recalibration, the effect of a relatively loud 2500-Hz recalibrating tone on the loudness of a relatively soft 2500-Hz target tone, was measured as a function of the interstimulus interval (ISI) between them. The loudness of the target tone, assessed by a 500-Hz comparison tone, declined when the ISI equaled or exceeded about 200 ms and leveled off at an ISI of about 700 ms. Notably, the target tone’s loudness did not change significantly at very short ISIs (<150 ms). The latter result is incompatible with the literature reporting loudness enhancement in this time window but is compatible with the suggestion made by Scharf, Buus, and Nieder [J. Acoust. Soc. Am. 112, 807–810 (2002)] that early measurements of enhancement were contaminated by the influence of the recalibrating tone on the comparison …
