Encountering Latin American And Caribbean Feminisms, Sonia E. Alvarez, Elisabeth Jay Friedman, Ericka Beckman, Maylei Blackwell, Norma Stoltz Chinchilla, Nathalie Lebon, Marysa Navarro, Marcela Ríos Tobar

Politics

This article examines the Latin American and Caribbean Feminist Encuentros as critical transnational sites for the collective re-imagining of feminist politics in the region. Paying special attention to the most recent regional gathering, held in Juan Dolio, Dominican Republic in 1999, we analyze the major political and philosophical debates that have emerged during twenty years of Encuentros: 1) shifting conceptions of movement "autonomy" and feminisms' relationship to the larger women's movement and to other actors in civil and political society, the State, and international institutions; 2) controversies generated by the movements' recurrent "crises of inclusion" and "crises of expansion"; and …

A National Crisis Or Localized Problems? Getting Perspective On The Scope And Scale Of The Teacher Shortage, Patrick Murphy, Michael Dearmond, Kacey Guin Jan 2003

A National Crisis Or Localized Problems? Getting Perspective On The Scope And Scale Of The Teacher Shortage, Patrick Murphy, Michael Dearmond, Kacey Guin

Politics

Despite the considerable attention the popular press has devoted to the question of teacher shortages, there have been surprisingly few attempts to systematically measure the size and nature of the problem. This article attempts to estimate the size and nature of the celebrated teacher shortage of the late 1990s by using data from the U.S. Department of Education’s 1999-00 School and Staffing Survey. While limitations of the SASS data do not allow us to directly estimate the absolute size of the shortage, they do allow us investigate its relative impact. An examination of the data shows that the problem was …

Cross-Modal Enhancement Of Perceived Brightness: Sensory Interaction Versus Response Bias, Yoav Arieh, Lawrence E. Marks, Eric C. Odgaard Jan 2003

Cross-Modal Enhancement Of Perceived Brightness: Sensory Interaction Versus Response Bias, Yoav Arieh, Lawrence E. Marks, Eric C. Odgaard

Department of Psychology Faculty Scholarship and Creative Works

Stein, London, Wilkinson, and Price (1996) reported the presence of cross-modal enhancement of perceived visual intensity: Participants tended to rate weak lights as brighter when accompanied by a concurrent pulse of white noise than when presented alone. In the present study, two methods were used to determine whether the enhancement reflects an early-stage sensory process or a later-stage decisional process, such as a response bias. First, the enhancement was eliminated when the noise accompanied the light on only 25% versus 50% of the trials. Second, the enhancement was absent when tested with a paired-comparison method. These findings are consistent with …

When Success Breeds Failure: History, Hysteresis, And Delayed Exit Decisions, Jennifer Bragger, Donald Bragger, Donald A. Hantula, Jean Kirnan, Eugene Kutcher Jan 2003

When Success Breeds Failure: History, Hysteresis, And Delayed Exit Decisions, Jennifer Bragger, Donald Bragger, Donald A. Hantula, Jean Kirnan, Eugene Kutcher

Department of Psychology Faculty Scholarship and Creative Works

The effects of feedback equivocality, information availability, and prior decision-making history on escalation and persistence were investigated. Replicating the findings of J.L. Bragger, D.H. Bragger, D.A. Hantula, and J.P. Kirnan (1998), this study found that participants receiving equivocal feedback on their decisions invested more money and invested across more opportunities; those who could purchase information invested fewer resources than did participants who did not have the opportunity to purchase information. There was an inverse linear relationship between the percentage of opportunities in which participants purchased information and the delay to exit decisions and total resources invested. Six weeks earlier, some …

Effect Of Color On Expected And Experienced Refreshment, Intensity, And Liking Of Beverages, Debra Zellner, Paula Durlach Jan 2003

Effect Of Color On Expected And Experienced Refreshment, Intensity, And Liking Of Beverages, Debra Zellner, Paula Durlach

Department of Psychology Faculty Scholarship and Creative Works

The effect of color on the expected and experienced refreshment, intensity, and liking of lemon, mint, and vanilla beverages was studied. Subjects rated the expected and actual taste of brown lemon and mint solutions as less refreshing than the tastes of differently colored solutions of the same flavor. However, the refreshment ratings (expected and actual) of the brown vanilla beverage were not different from those of the vanilla beverages of other colors. Liking ratings also depended on color in a manner similar to that of the refreshment ratings. Intensity ratings also varied with color. However, unlike when subjects smell solutions …

“Legal Or Illegal? Documented Or Undocumented?” The Struggle Over Brookhaven’S Neighborhood Preservation Act, Jackson B. Miller Jan 2003

“Legal Or Illegal? Documented Or Undocumented?” The Struggle Over Brookhaven’S Neighborhood Preservation Act, Jackson B. Miller

Faculty Publications

This critical essay applies the concept of “presence” as a theoretical lens for explaining the rhetorical efficacy of protest events surrounding a contemporary debate about immigrants’ rights in a suburban New York township. Specifically, the protests surrounding the town board meetings regarding Brookhaven’s “Neighborhood Preservation Act,” a piece of legislation geared toward making rental laws more stringent, are examined. A group comprised largely of white, upper middle-class citizens voiced their support for the proposed legislation, while a group of day laborers and those sympathetic with their cause characterized the proposed legislation as a form of racial discrimination disguised as a …

A Non-Harmonized Perspective On Parallel Imports: The Protection Of Intellectual Property Rights And The Free Movement Of Goods In International Trade, Krithpaka Boonfueng Jan 2003

A Non-Harmonized Perspective On Parallel Imports: The Protection Of Intellectual Property Rights And The Free Movement Of Goods In International Trade, Krithpaka Boonfueng

SJD Dissertation Abstracts

This dissertation aims to define an appropriate international legal standard for the exhaustion doctrine as it pertains to parallel imports, being the importation of genuine goods but without authorization from intellectual property owners. The clarification of this issue is needed because developed and developing countries have different perspectives on the application of the exhaustion doctrine. Under the exhaustion doctrine, once an intellectual property owner deliberately releases or authorizes others to release goods into the stream of commerce, his exclusive right to further control the goods is no longer valid. However, there are three diverse aspects in the application of exhaustion …

“Don't Buy Another Vote. I Won't Pay For A Landslide": The Sordid And Continuing History Of Political Corruption In West Virginia, Allen Hayes Loughry Ii Jan 2003

“Don't Buy Another Vote. I Won't Pay For A Landslide": The Sordid And Continuing History Of Political Corruption In West Virginia, Allen Hayes Loughry Ii

SJD Dissertation Abstracts

This study documents the long and sordid history of corruption--both perceived and corroborated--in the West Virginia political process. The researcher explores the considerable amounts of money spent by wealthy individuals for election or re-election. It documents the effect of high-cost elections, an effect which in many instances has spawned criminal activity. The author relates ostensibly ceaseless measures of corruption at the executive, legislative, and judicial levels. The findings indicate the existence of problems in West Virginia politics since the State's inception in 1863, including vote buying, vote rigging, undue geographical barriers, and lawlessness leading to numerous declarations of martial law. …

The Right To Education Under The South African Constitution, Eric Berger Jan 2003

The Right To Education Under The South African Constitution, Eric Berger

Nebraska College of Law: Faculty Publications

The South African Constitution epitomizes a new breed of modern constitution, enshrining socioeconomic rights rather than only "negative" liberties. Among these is the right to education. However, despite the Constitution's progressive values, many South African schools remain inadequate. This Note argues that, given the opportunity, the South African Constitutional Court should hold the current educational system unconstitutional as applied to the worst schools. Constitutional text, purpose, and precedent, indeed, mandate this outcome. Moreover, vindicating the constitutional right to education will help South Africa attain other social and economic goals. However, in keeping with its other socioeconomic rights cases, the Court …

Multijurisdictional Practice For A Multijurisdictional Profession, Susan Poser Jan 2003

Multijurisdictional Practice For A Multijurisdictional Profession, Susan Poser

Nebraska College of Law: Faculty Publications

The issue of multijurisdictional practice ("MJP") concerns whether, and to what extent, lawyers can practice law in states in which they are not licensed. Under current law in Nebraska and almost every other state, it may be a violation of both the ethics rules and state law for a lawyer not licensed in that state to engage in activity that constitutes the practice of law, even on a temporary basis. This is law that is no longer practical or necessary and Nebraska should now consider modifying it.

Challenging The Four "Truths" Of Personal Social Security Accounts: Evidence From The World Of 401(K) Plans, Colleen E. Medill Jan 2003

Challenging The Four "Truths" Of Personal Social Security Accounts: Evidence From The World Of 401(K) Plans, Colleen E. Medill

Nebraska College of Law: Faculty Publications

This Article discusses the final recommendations of the President's Commission to Strengthen Social Security concerning the proposed creation of a system of personal Social Security accounts. The Article critically evaluates the Commission's findings (the four "Truths") in light of numerous research studies concerning participant-directed 401(k) plans. The Article claims that Truth #1, the assertion that all workers will be better off in terms of total benefits from the combination of traditional Social Security and personal account benefits, is based on unrealistic assumptions concerning how workers choose to diversify their investments. The 401(k) plan research evidence suggests that, due to their …
