Justification And Excuse, Law And Morality, Mitchell N. Berman

Anglo-American theorists of the criminal law have concentrated on-one is tempted to say "obsessed over"-the distinction between justification and excuse for a good quarter-century and the scholarly attention has purchased unusually widespread agreement. Justification defenses are said to apply when the actor's conduct was not morally wrongful; excuse defenses lie when the actor did engage in wrongful conduct but is not morally blameworthy. A near consensus thus achieved, theorists have turned to subordinate matters, joining issue most notably on the question of whether justifications are "subjective"-turning upon the actor's reasons for acting-or "objective"-involving only facts independent of the actor's beliefs …

This collection offers an economics-based overview of the various facets of risk. It contains six papers that examine a broad array of research relating to risk. Two papers examine risk management and its application to decision making as well as what researchers have learned over the past few decades in their theoretical investigations of risk. The remaining chapters examine how risk plays out in the particular markets in which it has a significant presence, including casino gambling enterprises, agricultural markets, auctions, and health insurance.

The religious context blurs vision and judgment when looking at issues related to matters that can be construed as theological matters. Religious issues are anchored deep inside individuals and the slightest challenge or questioning of an individuals beliefs brings about defensiveness. The Immigration Paradox: Poverty, Distributive Justice, And Liberal Egalitarianism, Howard F. Chang

The immigration of unskilled workers poses a fundamental problem for liberals. While from the perspective of the economic welfare of natives, the optimal policy would be to admit these aliens as guest workers, this policy would violate liberal egalitarian ideals. These ideals would treat these resident workers as equals, entitled to access to citizenship and to the full set of public benefits provided to citizens. If the welfare of all incumbent residents determines admissions policies, however, and we anticipate the fiscal burden that the immigration of the poor would impose, then our welfare criterion would preclude the admission of unskilled …

Private property is widely perceived as a potent prodevelopment and anticonservationist force. The drive to accumulate wealth through private property rights is thought to encourage environmentally destructive development; legal protection of such property rights is believed to thwart environmentally friendly public measures. Indeed, property rights advocates and environmentalists are generally described as irreconcilable foes. This presumed clash often leads environmentalists to urge public acquisition of private lands. Interestingly, less attention is paid to the possibility that the government may prove no better a conservator than private owners. Problem . Research investigating the relationship between loneliness and various dimensions of Internet use is mixed. While some studies support the connection, other studies refute the link. More analysis in this area is needed to help clinicians, parents, college students, school counselors, and educators better understand the effects of the Internet on college-age students. This study attempts to expand understanding of the conflictual relationship that exists between loneliness and the dynamics of Internet use in undergraduate students.

Strategies For Managing An Aging Workforce, Marie F. Jones

The Southeastern Librarian

Demographic trends show that the population of librarians in the U.S. is rapidly aging. This paper examines the ways that library managers can make workplaces more attractive to older librarians in order to encourage them to remain in the workforce beyond retirement age. The article dispels some negative stereotypes of "the older worker" and shows the advantages of retaining individuals with experience and maturity. It also addresses organizational climate, management, and training issues related to older workers.

We characterise the interplay between firms' decision in product development undertaken through a research joing venture (RJV), and the nature of their ensuing market behaviour. Participant firms in an RJV face a trade-off between saving the costs of product innovation by developing similar products to one another, e.g. by sharing most of the basic components of their products, and investing higher initial efforts in product innovation in order to develop more distinct products. In a two period model of strategic entry deterrence where the incumbent firm moves before the entrant by installing capacity for production, Dixit (1980) argued that in a (perfect) equilibrium excess capacity would not be observed, contradicting Spence's (1977) result on the same issue. In this note, we show that Dixit may not always remain true when we allow for demand uncertainty.

Two Facets Of Competitiveness And Their Influence On Psychological Adjustment, Elaine Kayhan '03

This study was conducted to explore the influence of competitiveness as a personality trait on psychological adjustment. Competitiveness was differentiated into two distinct facets referred to as superiority competitiveness and mastery competitiveness. In terms of psychological adjustment, the effects of these facets of competitiveness on depression, loneliness, self-esteem, anxiety, and eating patterns were examined. Questionnaires were used to assess the aforementioned dimensions. The results of the study revealed some noteworthy gender differences. Among females, superiority competitiveness was associated with higher levels of depression. Among males, superiority competitiveness was associated with less loneliness. This study examined the relationship between threatening masculinity identity in men and subsequent antigay attitudes and behaviors. In a group testing session, masculinity levels were assessed in college men using the Male Role Norm Scale. Male participants were called back for the experimental manipulation, in which they were assigned to one of two conditions. In the masculine threat condition, participants took a test supposedly measuring masculine knowledge and received false feedback of poor performance. In the no threat condition, participants took a test supposedly measuring general knowledge without receiving any feedback. Threatened masculinity may play a role in homophobic responses in college men. In this study, homophobic or non-homophobic responses to a gay confederate were measured after a masculine threat or no threat manipulation. 49 college men participated in the study: 24 in the masculine threat condition and 25 in the no threat condition. Masculinity level was pre-determined in an initial phase one testing using the Male Role Norms Scale (MRNS). In the masculine threat condition, participants were given a test that was said to measure masculine knowledge and then received false negative feedback.
