The question I explore here, stated in its broadest form, is this: What is the connection between theory and practice between academic claims about how judges should decide cases and the actual behavior of judges as revealed in the opinions they write? More particularly, do theories about the nature of law have any implications for the question whether a judge should adopt an "activist" or a "restrained" approach to deciding cases? An Author Co-Citation Analysis Of Medical Informatics, James E. Andrews

Objective: This study presents the results of an author co-citation analysis of the interdisciplinary field of medical informatics.

Methods: An author co-citation analysis was conducted for the years 1994 to 1998, using the fifty most-cited American College of Medical Informatics fellows as an author population. Co-citation data were calculated for every author pair, and multivariate analyses were performed to ultimately show the relationships among all authors. A multidimensional map was created, wherein each author is represented as a point, and the proximity of these points reflects the relationships of authors as perceived by multiple citers.

The purpose of this study is to examine whether the different type of ownership will affect the degree of objectivity of newspaper coverage of 2000 presidential election. It is predicted by Shoemaker’s news content theory that publicly-owned newspaper is more objective than privately-owned newspaper. The findings of this study support this theory. The purpose of this study was to test a general stress-related health behavior model as it applied to binge eating and obesity in African Americans using path analysis. Acculturation, racism, emotional distress, binge eating, and obesity were among the variables related to this theory, and included in the model. Other variables that have been implicated in the study of obesity in African Americans were also included, such as; lack of body dissatisfaction, accepting attitudes towards obesity, decreased dietary restraint, increased dietary fat intake and decreased physical activity. While concepts and investigations of human energy fields have been developed for centuries, there has been little systematic work comparing the fields of children, adolescents, and adults. In addition, general fields have had little comparison between average adults and those participating in an intense practice that may affect the field. Using the GDV machine, this research compared small groups of children, adolescents, average adults, and Dahn Hak Masters on measures of 20 basic aspects of the human energy fields, including the seven chakras. Prayer As Interpersonal Coping In The Lives Of Mothers With Hiv, E. James Baesler, Valerian J. Derlega, Barbara A. Winstead, Anita Barbee

The spirituality of 22 mothers diagnosed with HIV was explored through face-to-face interviews and revealed that 95% of the mothers pray. Active prayers (e.g., talking to God by adoring, thanking, confessing, and supplicating) were more frequently reported than receptive prayers (e.g., quietly listening to God, being open, surrendering). Supplicatory or petitionary prayers for help and health were the most frequent type of prayer, and adoration was the least frequent. The majority of mothers in the sample perceived prayer as a positive coping mechanism associated with outcomes such as: support, positive attitude/affect, and peace. Brown University Library hired a professional marketing and opinion research firm to conduct focus group meetings with library users and to provide data analysis. The discussion includes a review of the library literature on focus group use, practical aspects of focus group methodology, and the benefits of employing professionals where librarian expertise is low. Logistics of focus group preparation, meetings, and report are discussed. Findings and lessons learned are presented along with outcomes for the library.

This research utilizes the case study method to examine the effectiveness of truancy statutes recently implemented in Florida's Fourth Judicial Circuit prior to the 1999-2000 school year. The statutes were implemented state wide, but this study concentrates on the Fourth Judicial Circuit. The Fourth Judicial Circuit in Northeast Florida consists of Duval, Clay, and Nassau Counties. The legislation examined requires individual schools to conduct an initial truancy intervention when a student has accumulated 5 unexcused absences in a calendar month or 10 unexcused absences in any 90-day period.

As cultural animals we create meaning and order. Stories are the primary means our species uses to do this. Stories that rise to the level of myth exert powerful effects on behavior. The dominant myths that explain our relationship to the natural word have two serious failings: our self-importance and a superficial and simplified image of who we are. These stories obscure more than they enlighten, thereby preventing us from addressing the causes of the current extinction crisis. Learning is modeled as an infection, which jumps from person to person. The rate of infection mimics individual discount rates and induces savings behavior on its own. It is shown that the apparent discount rate, the combination of the agents’ true discount rate and the infection rate, decreases over time and approaches the agents’ true discount rate. This decrease, known as hyperbolic discounting, is consistent with what is observed in psychology studies, while the limiting case, exponential discounting, is consistent with market level observations. Based on twelve months of fieldwork in Dakar, Senegal and funded by the Wenner Gren Foundation, this thesis examines how in the context of contemporary globalization, increased volumes of luxury commodities shape the modern consciousness of individuals in a developing African city. This project specifically examines this phenomenon through a study of youth clothing consumption. Dakar is a consumer society with particular consumer dynamics. In addition to class, patron-clientage and kinship are central to understanding contemporary patterns of consumption in Dakar. Clothing is a commodity that has been radically altered by urbanization and the globalization of manufacturing processes and advertising. …

This thesis was a descriptive study examining adviser awareness of the Kansas Student Publication Act (1992) as reported by advisers who were members of the Kansas Scholastic Press Association during the academic year 2002-2003. Because there were no studies prior to the passing of the Act, there was no base line study to determine whether the Act has had an impact since its passing. Since 1980, researchers and practitioners have had access to valid and reliable measures of myths about rape (Burt, 1980) and child sexual abuse (Collings, 1997). Despite the utility of such measures in research and program evaluation, no such measure of domestic violence myths currently exists. The present study was undertaken to fill this gap. In this study, domestic violence myths were defined as stereotypical attitudes and beliefs that are generally false but are widely and persistently held, and which serve to minimize, deny, or justify physical aggression against intimate partners. This study of late-glacial and Holocene changes in lake-level and vegetation at Mathews Pond contributes new information about Holocene environments in northeastern North America. The research establishes a 12,000-year record of paleohydrology for the watershed adjacent to Big Reed Forest Reserve, the largest stand of old-growth forest in the northeastern United States. Mathews Pond is a 7.4 ha, closed-basin, groundwaterseepage lake located in an upland, forested region of the Aroostook River drainage system. The industrial working class began the middle decades of the twentieth century with unlimited hope and possibility but ended them fraught with disillusionment and dismay. This marked a disjointed experience as optimism for the future gave way to disenchantment. With the ratification of the National Industrial Recovery Act in 1933 and the National Labor Relations Act in 1935, hundreds of thousands of workers across the United States became union members. The euphoria that this initial burst of unionization created, however, could not be sustained throughout the post-World War II years. Smuggling has been an important problem in American-Canadian relations. Yet the nature of smuggling is little understood; it is by definition an elusive, secretive, and subtle practice. This dissertation explores smuggling as a social force within a border community on the United States-Canada boundary. Smuggling almost always involved the illicit crossing of political boundaries, and as such can be used as a means of studying popular attitudes toward the creation of national borders. Moreover, because smuggling is directly related to the transition to modem capitalism, this study sheds light on the roots of both American and Canadian economic development. The …

In 1901 Alabama established the first independent government archives in the United States. The founding of the Alabama Department of Archives and History (ADAH) preceded that of the National Archives by more than thirty years. Other states had sponsored history programs, assigning the responsibility for public records to state libraries, secretaries of state, or state historical societies, but Alabama was the first to create an official state agency. This concept of government-supported, but independent, archives would become a model for others in the United States.

March 1920 was a traumatic month for Marie Bankhead Owen. It began with the death of her influential father, Senator John Hollis Bankhead, and it ended with the sudden death of her fifty-three-year-old husband, Thomas McAdory Owen, founding director of the Alabama Department of Archives and History (ADAH). Then on April 1 she accepted an appointment as the second director of ADAH, a position she held for over three decades. Thus, in the space of one month, Marie Bankhead Owen lost her father and her husband and began a thirty-five year career as director of the Alabama archives.

Takeover Defense When Financial Markets Are (Only) Relatively Efficient, Michael L. Wachter

This paper evaluates the impact of developments in the understanding of asset value pricing for alternative legal standards for takeover defenses: the management discretion and the shareholder rights positions. Both sides place considerable, albeit implicit, reliance on alternative views of the efficiency of financial markets. Developments in finance theory show that when financial markets are only "relatively efficient," stock prices can incorrectly value the corporation at any point in time, at the same time as investors cannot outperform the market on an ongoing basis. In this article, the author argues that the concept of "judicial independence" has served more as an object of rhetoric than it has of sustained study. He views the scholarly literatures that treat it as ships passing in the night, each subject to weaknesses that reflect the needs and fashions of the discipline, but all tending to ignore courts other than the Supreme Court of the United States. Seeking both greater rigor and greater flexibility than one usually finds in public policy debates about, and in the legal and political science literatures on, judicial independence, the author attributes much of …
