The 'Self' in late-modernity is never singular but multiplies across different discourses, practices and positions. It is constructed through difference. It is only through a relation to the 'Other' that the 'Self' can be defined. This paper endeavours to map the endless negotiations of my 'Self' as male Australian academic of Chinese descent, a Malaysian citizen, a Bruneian resident, and an Indonesian specialist, over a period of fieldwork in Jakarta in 2004. Assimilation, Multiculturalism, Hybridity: The Dilemmas Of Ethnic Chinese In Post-Suharto Indonesia, Chang Yau Hoon

The dominant discourse in accommodating the ethnic Chinese in Indonesia during Suharto's regime was one of assimilation, which forcefully aimed to absorb this minority into the national body. However, continuous official discrimination towards the Chinese placed them in a paradoxical position that made them an easy target of racial and class hostility. The May 1998 anti-Chinese riots proved the failure of the assmilationist policy. The process of democratization has given rise to a proliferation of identity politics in post-Suharto Indonesia. In light of recent discussions on the anthropology of space and theories of governmentality, this article analyzes the entrenchment and interaction in space of ethnic and national identities in an environment in which competing conceptualizations of space persist. The town of Komotini, in northern Greece, is inhabited by both Greek and Turkish speakers; both communities have claims to a variety of ethnic and geographical origins. These claims are presented in different contexts, such as national celebrations, street naming, and instances of communal and intercommunal interaction. This article first briefly summarizes the issues that arise in the lower-court judicial confirmation process, and examines how the issues differ from those that arise during the confirmation of Supreme Court justices. The article considers constitutionally-based differences as well as practical differences in Senate and Executive behavior that have developed during more than two centuries of judicial confirmations. The body of the article offers a chronological history and critique of the rhetoric of both Republican and Democratic senators in discussing lower-court confirmations during the 107th Congress. This Recent Development focuses on the legal standards that would govern the treatment and interrogation tactics applicable to detainees held by the United States abroad after the passage of the Detainee Treatment Act (DTA). The article first discusses the legal implications of the DTA as to U.S. law on the use of torture or CID treatment, which primarily concerns Sections 1002 and 1003 of the DTA. Then, it explores certain shortfalls in the scope of these sections on this issue, as the sections do not fully address all of the potential ways in which detainee abuse and torture might continue. …

Becoming proficient in a second language may involve several factors that are different from those involved in the first language. One factor that may influence performance in either language is academic aptitude. In this study, responses to statements regarding language abilities in Bahasa Malaysia and English by academically inclined and challenged students were analysed using the Chi-Square technique. The results indicate that while the academically inclined students do not have major difficulties in performance in either of the two languages, the academically challenged students report problems in basic linguistic abilities in the English language but not in Bahasa Malaysia. We integrate cross-cultural literature with broader literature in survey methodology, human cognition and communication. First, we briefly review recent work in cognitive survey methodology that advances our understanding of the processes underlying question comprehension and response. Then, using a process model of cultural influence, we provide a framework for hypothesizing how cross-cultural differences may systematically influence the meaning respondents make of the questions researchers ask, how memory is organized, and subjective theories about what constitutes an appropriate answer and therefore the answers participants are likely to give.

A medical treatment is said to have placebo effects if patients who are optimistic about the treatment respond better to the treatment. This paper proposes a simple test for placebo effects. Instead of comparing the treatment and control arms of a single trial, one should compare the treatment arms of two trials with different probabilities of assignment to treatment. If there are placebo effects, patients in the higher-probability trial will experience better outcomes simply because they believe that there is a greater chance of receiving treatment. This paper finds evidence of placebo effects in trials of antiulcer and cholesterol-lowering drugs.

The world is more often exposed to “overcomology” —society’s assertion that oppressed peoples or so-called minorities have overcome past injustices and are now able to access the same educational opportunities as so-called majority groups. Privatization, recognized as one of the most important economic policy reforms from the 1970s, has attracted significant attention from scholars, and the literature on the topic is now vast. Yet there is little agreement on the reasons why governments privatized. Three dominant paradigms explaining European Union (EU) privatization put forward distinct motivations. The ‘British paradigm’ assumed that market-friendly ideology played a significant role in a path towards a global programme inspired by the UK experience. The ‘multiple logics’ approach observed that the UK was an anomaly, not a leader, and that EU privatization was so diverse that there were few, …

This article considers the powers of the Criminal Assets Bureau (CAB) in the context of revenue law, as this lesser-known aspect of the Bureau’s work is often overshadowed by its ability to seize and confiscate the proceeds of crime. Although the taxing of illegal profits was traditionally precluded in Ireland, this situation was altered in the early-1980s, thereby facilitating CAB’s revenue work. Despite CAB’s significant powers in this regard, the courts have overturned its tax assessments in a number of cases, on the basis that certain criteria pertaining to its tax powers have been breached. The issue of witness intimidation has gained currency in the Irish criminal justice system in recent years with the increase in so-called “gangland” crime. The brutal treatment used by organised criminals to resolve gangland feuds is echoed in the threats received by individuals who seek to testify against suspected organised criminals. This article examines various approaches have been adopted by the State to ensure that the evidence of threatened witnesses may be used in court. Legislation in Ireland that pertains to serious and organised crime is characterised by a favouring of public protection over the rights of the accused; by an increased concern for security with a concomitant diminution of the significance of liberty.
