Separation Of Structures, Alex Zhang Jan 2024

Separation Of Structures, Alex Zhang

Faculty Articles

This Article makes three main contributions. First, it fleshes out the theory of separation of structures as distinct from contemporary scholarly approaches. Second, it writes the intellectual history of separation of structures, which has been an integral part of the separation of powers enterprise since its inception, including at the Founding. Third, it explores the scholarly and doctrinal implications of structural separation of powers. In particular, adjudicating the constitutionality of agency structures requires methodological pluralism that incorporates the normative values underlying the structural design. That is, under separation of structures, current doctrine should evolve beyond the formalism heavily criticized by …

“I’M Not The Girl I Was…”, Donald K. Freedheim

My wife has Alzheimer’s. That might not be the precise diagnosis, but her symptoms are practically textbook for it. On a seven-stage scale of the disease, she would be in the latter part of the 5th and early 6th Stage. I have been asked by a number of colleagues to write down what has been happening to Gerda; but up until now, it was too painful and personal to record. I also believed that so much useful information has been written and published that there was no need to add to the literature. But when Gerda said the words I …

The Challenges Of Writing The History Of Localities That Were Under Colonial Rule In The Early Phase Of European Expansion: An Investigation Into Writing The History Of Negombo (Sri Lanka) In The Sixteenth And Early Seventeenth Centuries, Chandra R. De Silva

History Faculty Publications

Local history has been conventionally defined as a chronicle of a limited geographical area. The study of local history can have positive outcomes including reconstructing our ancestor’s everyday lives and providing opportunities for students to develop investigative research skills, develop linkages with locals and to also motivate students to improve their basic skills of reading, writing and critical thinking. Unlike in the West, however, where local historians use old records of their locality, local historians of lands colonized by Westerners have problems finding source material. For example, in Sri Lanka, the Portuguese occupying the southwest lowlands destroyed Buddhist and Hindu …

Papers from the International Association for Cross-Cultural Psychology Conferences

This paper presents the underlying theoretical framework, cross-cultural and interdisciplinary research activities, as well as preliminary findings on influencing factors for a healthy and sustainable Work-Life-Flow (WLF) in diverse countries. The research is conducted within the scope of the cross-cultural Erasmus+-project, "Excellence based profiling to identify and apply tools and training for a better and sustainable Work-Life-Flow" (2020-1-ES01-KA203-083282). Within this framework, we promote the re-conceptualization of the concept of work-life balance towards a more dynamic and inclusive resource-demands based concept of WLF. The project develops assessment and training tools to foster WLF for individual and organizations alike. To justify this …

Recruiting The Right Candidate, Cynthia Bassett Jan 2024

Recruiting The Right Candidate, Cynthia Bassett

Faculty Publications

The market for hiring a law librarian has changed significantly over the last few years. Those on both sides of the equation are a little uncertain about the whole process, wondering when the job search should start, how much to expect in pay, and what aspects of a position are up for discussion. The challenge of a limited pipeline of law librarians requires new approaches to recruiting.

Recommendations To Internal Auditors Regarding The Auditing And Attestation Of Mathematical Programming Models, Jose Rincón, Greg Akai, Daryl Ono Jan 2024

Recommendations To Internal Auditors Regarding The Auditing And Attestation Of Mathematical Programming Models, Jose Rincón, Greg Akai, Daryl Ono

LMU Librarian Publications & Presentations

Mathematical programming planning models increase operational efficiency and minimize operating costs, but the underlying mathematics generally is complex. Combinatorial optimization is technically sophisticated which requires a strong quantitative background to successfully implement. Most internal auditors will not have the technical training to critically assess the underlying mathematics of mathematical programming planning models, but the internal auditor can still provide insight and attestation which can increase the efficiency of mathematical programming planning models.

Lis Journals' Lack Of Participation In Wikidata Item Creation, Eric Willey, Susan Radovsky Jan 2024

Lis Journals' Lack Of Participation In Wikidata Item Creation, Eric Willey, Susan Radovsky

Faculty and Staff Publications – Milner Library

There are many items in Wikidata representing scholarly articles. However, these items have been created mostly by volunteer Wikidata editors and not systematically by journal publishers or editors, which can lead to gaps and inconsistencies in the datasets. This article presents findings from a survey investigating practices of library and information studies (LIS) journals in Wikidata item creation. Believing that a significant number of LIS journal editors would be aware of Wikidata and some would be creating Wikidata items for their publications, the authors sent a survey asking 138 English-language LIS journal editors if they created Wikidata items for materials …

As library budgets are cut or remain flat, librarians asked to do more with less are considering diverse data to investigate how best to invest limited funds. The data available to librarians are extensive but they may also be contradictory. In this presentation, we contextualize findings from interviews conducted with Illinois State University faculty with institutional and collections data. Using the words of faculty members across disciplines, we highlight some of the tensions around discovery and access to scholarly literature, perceptions of urgency, and engagement with open access. The interview results--triangulated with institutional usage and cost data—suggest a variety of …

How Can Law Enforcement Use Technology To Protect Citizens Justly?, Zach Kantenwein Jan 2024

How Can Law Enforcement Use Technology To Protect Citizens Justly?, Zach Kantenwein

Emerging Writers

This paper explores the danger of emerging artificial intelligence technology perpetuating racial injustice in law enforcement and how police can ensure the protection of citizens amid this information age. We dissect a real-world case in which AI predictive policing technology resulted in alarming racial discrimination against American minority citizens. We discuss the possible explanations for this result and explore the limitations of artificial intelligence technology. Furthermore, we brainstorm methods for ensuring American citizens' just and constitutional protection as new technology is developed and tested. We propose implementing transparency laws that make the details about any policing technology and surveillance available …

Death Notification For The Law Enforcement Chaplain; Considering Models That Emphasize The Ministry Of Presence, Steven W. Brooks Jan 2024

Death Notification For The Law Enforcement Chaplain; Considering Models That Emphasize The Ministry Of Presence, Steven W. Brooks

Faculty Publications and Presentations

Against a backdrop of protocols developed in the medical community for delivering bad news (news of a distressing nature) to patients and survivors (e.g., friends and family of a patient or victim), a straightforward procedure is described for law enforcement chaplains who must deliver death notifications to civilians. A description of and appreciation for the ministry of presence is explored. Specifically, the ministry of presence, modeled after Jesus’ example in the Incarnation and His development of disciples, is described as the cornerstone of chaplaincy.

Metaphysical Foundationalist Versus Existentialist Ontologies: Applications For Research On Psychological Energy, Michael Da, Glenn Hartelius Jan 2024

Metaphysical Foundationalist Versus Existentialist Ontologies: Applications For Research On Psychological Energy, Michael Da, Glenn Hartelius

International Journal of Transpersonal Studies Advance Publication Archive

Theories of psychological energy have a rich history going back to the beginning of the field of psychology, employing concepts such as "libido," "psychic energy," "orgone energy," "bioenergetics," "psycho-energetics," "life energy," "organizing field," and "living-matrix." There has been a recent effort to find neural correlates with these concepts, but these data may not capture the fullness of the phenomenon. Because psychological energy is an elusive concept with many interpretations, research into this phenomenon faces the most basic questions regarding where and how to start. To address these questions, this paper explores several theories of ontology that could apply to psychological …

From Mind To Matter: Patterns Of Innovation In The Archaeological Record And The Ecology Of Social Learning, Kathryn Demps, Nicole M. Herzog, Matt Clark

Anthropology Faculty Publications and Presentations

Archaeology and cultural evolution theory both predict that environmental variation and population size drive the likelihood of inventions (via individual learning) and their conversion to population-wide innovations (via social uptake). We use the case study of the adoption of the bow and arrow in the Great Basin to infer how patterns of cultural variation, invention, and innovation affect investment in new technologies over time and the conditions under which we could predict cultural innovation to occur. Using an agent-based simulation to investigate the conditions that manifest in the innovation of technology, we find the following: (1) increasing ecological variation results …

Democracy And The Unconscious, Ali Aslam, David Mcivor, Joel Alden Schlosser Jan 2024

Democracy And The Unconscious, Ali Aslam, David Mcivor, Joel Alden Schlosser

Political Science Faculty Research and Scholarship

This essay examines the relationship between democracy and the unconscious. It does so by understanding democracy through the repressed desire for shared power by a collective actor that has episodically realized itself, in ways that haunt political languages, practices, and aspirations. Democratic flourishing rests upon erotic practices through which the demos transgressively transforms politics by embracing what we refer to as democratic narcissism. Democratic decline and impasse are symptomatic of repressed desires for power that have required the people’s abjection rather than coalescing into a self-affirming narcissism of the demos.

The Worst Choice For School Choice: Tuition Tax Credits Are A Bad Idea And Direct Funding Is Wiser, Michael J. Broyde, Anna G. Gabianelli Jan 2024

The Worst Choice For School Choice: Tuition Tax Credits Are A Bad Idea And Direct Funding Is Wiser, Michael J. Broyde, Anna G. Gabianelli

Faculty Articles

School choice is on the rise, and states use various mechanisms to implement it. One prevalent mechanism is also a uniquely problematic one: the tax credit. Tax credits are deficient at equitably distributing a benefit like school choice; they are costly, and they invite fraud. Instead of using tax credits, states opting for school choice programs should use direct funding. Direct funding will more efficiently achieve the goals of school choice because it can be regulated like any other government benefit, even if it ends up subsidizing religious private schools.

Tax credits’ prevalence is not inexplicable, of course. It is …

Judaism And The Transpersonal, B. Les Lancaster Jan 2024

Judaism And The Transpersonal, B. Les Lancaster

International Journal of Transpersonal Studies Advance Publication Archive

The interplay between Judaism, especially its mystical tradition, and transpersonal psychology is examined, focusing on two major aspects. The first concerns stages in the spiritual journey, which are analyzed for their psychological import. The stages are symbolically depicted in the biblical narrative of the Exodus from Egypt, a journey from "slavery" to "freedom." Here the Hebrew term translated as "wilderness" is seen to act as a code word, applying to five successive stages each of which I analyze in psychospiritual terms. The role of the divine feminine, the Shekhinah, is emphasized on account of Her specific role in exile and …

Are We Practicing What We Preach? Towards Greater Transborder Inclusivity In Information Science Systematic Reviews, Stephanie Krueger, Rebecca D. Frank

School of Information Sciences -- Faculty Publications and Other Works

Abstract. Inclusiveness has been investigated in different ways by Information Science (InfoSci) researchers, often as a line of social justice inquiry. Systematic reviews (SRs), which bridge the gap between research and practice, are a key example of research impacted by inclusiveness. “Transborder” inclusiveness—the ability of researchers from different institutions, regions, and countries to ac-cess information, and the inclusion of information from researchers in regions and countries where English is not an official language in major collections of InfoSci research—influences how researchers perform SRs. Although this topic has been identified in other disciplines involved in Evidence Based Practice (EBP) such as …
