The Supreme Court’s decision in Chimanga Changa has set a clear and resounding tone as well as a sound precedent in the Jurisprudence of Zambian Corporate Insolvency law, specifically in relation to how voluntary business rescue proceedings should be commenced, when they commence and most importantly that an application objecting to the commencement of business rescue proceedings pursuant to section 22(1), does not answer to the definition of a legal proceeding for purposes of effecting a moratorium within the confines of section 25 of the Act.

The Lifumbela case stems straight from the High Treason Trial, Namibia’s longest and – probably – most expensive judicial saga. In S v Lifumbela, the Supreme Court of Namibia had to settle an appeal against the convictions and sentences of 30 accused implicated in the High Treason Trial. The Benin Bronzes are a grouping of an estimated 10,000 works made from brass, ivory, wood, clay, as well as other materials. These objects originated from the royal palace in Benin City, located in present day Nigeria in Africa. Within the last five years, beginning in 2017, discussions surrounding the repatriation of these artifacts from museums around the world have been reignited to a high degree where institutions are actively working towards researching and, in increasing numbers, repatriating the material to Nigeria. The Employment Effects Of Mobile Internet In Developing Countries, Gaurav Chiplunkar, Pinelopi K. Goldberg

Discussion Papers

We examine the employment effects of 3G mobile internet expansion in developing countries. We find that 3G significantly increases the labor force participation rate of women and the employment rates of both men and women. Our results suggest that 3G affects the type of jobs and there is a distinct gender dimension to these effects. Men transition away from unpaid agricultural work into operating small agricultural enterprises, while women take more unpaid jobs, especially in agriculture, and operate more small businesses in all sectors. Both men and women are more likely to work in wage jobs in the service sector.

More Roads Or Public Transit? Insights From Measuring City-Center Accessibility, Lucas Conwell, Fabian Eckert, Ahmed Mushfiq Mobarak

We propose a theory-inspired measure of the accessibility of a city’s center: the size of the surrounding area from which it can be reached within a specific time. Using publicly-available optimal routing software, we compute these ”accessibility zones” for the 109 largest American and European cities, separately for cars and public transit commutes. Compared to European cities, US cities are half as accessible via public transit and twice as accessible via cars. Car accessibility zones are always larger than public transit zones, making US cities more accessible overall. However, US cities’ car orientation comes at the cost of less green …

Research has emphasised the importance of emotional intelligence (EI) in the work of higher education staff. However, little is about the motivations and expectations of lecturers who decide to participate in EI coaching programmes. As part of a larger study pertaining to the efficacy of EI coaching for Irish higher education lecturers, qualitative data was collected by way of a questionnaire that contained two open-ended questions from all participants who signed up for coaching (N = 40). The findings indicate that the primary motivations for participants to sign-up for coaching were personal development and a desire to support research activities. …

This study demonstrates that microcontent, a snippet of personalized content that responds to users’ needs, is a form of localization reliant on a content ecology. Active participation of youth and surrogate decision-makers in providing informed consent and assent for mental health treatment is critical. However, the procedural elements of an informed consent process, particularly for youth in child welfare custody, are not well defined. Given calls for psychotropic medication oversight for youth in child welfare custody, this study proposes a taxonomy for the procedural elements of informed consent policies based upon formal and informal child welfare policies and then examines whether enacted state formal policies across the United States endorsed these elements. Objective: The current study explored differences in mental health problems, services utilization, and support of graduate students by gender, race/ethnicity, and year in school.

Participants: Participants consisted of 734 graduate students from a large, Midwestern university.

Methods: Graduate students answered a series of questionnaires in fall 2021 assessing their mental health, services utilization, and perception of services.

Results: Women (vs men) and participants in their second year and beyond (vs first year) reported greater mental health problems, negative impact of the pandemic, and more services utilization. This is a judgment against the first judge among his peers: the Chief Justice. Handed down by the Judicial Conduct Committee (JCC) of South Africa’s Judicial Service Commission (JSC), this judgment involves the remarks made in 2020 by Chief Justice Mogoeng Mogoeng at a webinar hosted by a pro-Israel, conservative, Zionist newspaper. During that webinar, Mogoeng criticized the South African government’s official policy on the Israel-Palestine conflict. Following Mogoeng’s faux pas and a loud public outcry, three non-governmental organizations (NGOs) lodged complaints with the JCC against Mogoeng for his Israel comments.

However, as this article has demonstrated, it reached an outcome not supported by principles of law, particularly those relating to the need to provide lucid and clear evidence of a vitiating factor or illegality to declare a contract null and void.
