Not So Respectful Consideration: The U.S. Supreme Court’S Deference Or Lack Thereof To Foreign Government Statements Of Law, Cindy G. Buys
Penn State Journal of Law & International Affairs
The amount of deference due foreign governments’ statements regarding the meaning of foreign law has long plagued U.S. courts. Courts have applied a variety of approaches in answering this question, including reliance on doctrines of international comity, respectful consideration, and Rule 44.1 of the Federal Rules of Civil Procedure. The U.S. Supreme Court recently attempted to provide additional guidance to lower courts and litigants in Animal Science Products, Inc. v. Hebei Welcome Pharmaceutical Co., Ltd., where it created a new, five-factor test. However, application of this new test is likely to generate continued uncertainty and inconsistency in this area of …

Role Of Bpifb4 In Immune System And Cardiovascular Disease: The Lesson From Centenarians, Francesco Montella, Valentina Lopardo, Monica Cattaneo, Albino Carrizzo, Carmine Vecchione, Elena Ciaglia, Annibale A. Puca
Puca
Translational Medicine @ UniSa
Recent discoveries have shed light on the participation of the immune system in the physio pathology of the cardiovascular system underpinning the importance of keeping the balance of the first to preserve the latter. Aging, along with other risk factors, can challenge such balance triggering the onset of cardiovascular diseases.
Among several mediators ensuring the proper cross-talk between the two systems, bactericidal/permeability-increasing fold-containing family B member 4 (BPIFB4) has been shown to have a pivotal role, also by sustaining important signals such as eNOS and PKC-alpha.
In addition, the Longevity-associated variant (LAV), which is an haplotype allele in BPIFB4characterized by …

A Pandemic Road Map: Creating Social Work Student Wellness Plans In Field Placement, Susan Reay
Social Work Faculty Publications
During the unprecedented early stages of COVID-19, few protocols were established to support overall student wellness in social work field placements. In response to the overwhelming need for a contextual framework to promote wellness and determine the next steps in mitigating health risks, faculty developed a unique solution in a dynamic situation. Rooted in the university-sponsored dimensions of wellness, BSW and MSW students developed wellness plans that were integrated into the field placement course. These plans were intended to enhance students' ability to evaluate their well-being and encourage them to plan wellness activities. The wellness plan was critical in determining …

Nebraska Monthly Economic Indicators: February 23, 2022, Eric Thompson
Leading Economic Indicator Reports
The LEI-N rose by 0.58% during January 2022. The increase in the leading indicator, which is designed to predict economic activity six months in the future, signals moderate economic growth in Nebraska through the summer of 2022. The indicator improved for three primary reasons. There were positive business expectations in January according to respondents to the monthly Survey of Nebraska Business. Initial claims for unemployment insurance also fell during the month as a sign of strength for the labor market. The value of the U.S. dollar also fell, which is helpful for Nebraska businesses that compete in international markets.

Changes In Character Virtues Are Driven By Classroom Relationships: A Longitudinal Study Of Elementary School Children, Kendra J. Thomas, Josafa M. Da Cunha, Jonathan Santo
Psychology Faculty Publications
The purpose of this study is to understand the role of school relationships in shaping students’ character development in middle childhood. Students and teachers completed surveys on student–teacher relationships, peer relationships, social-emotional learning (SEL), parent-teacher communication, and character strengths of fairness, hope, bravery, teamwork, self-regulation, social responsibility, and prosocial leadership. Participants were 1881 Brazilian children in fourth or fifth grade across 288 classrooms and 60 schools. Data were analyzed using a multi-level model framework. Higher student–student relationships were associated with higher starting scores of character strengths paired with a stronger increase among classes whose relationships improved over time. Higher quality …
The Importance Of Quality Of Life In Weight Loss Programs, Brooke Taylor
The Importance Of Quality Of Life In Weight Loss Programs, Brooke Taylor
Undergraduate Honors Theses
The obesity epidemic has plagued the United States for over 50 years, but there is still much education and research that needs to be done to understand weight loss, specifically the relationship between weight loss and quality of life. This paper considers this relationship from three angles: first, by considering the different types of weight loss treatment, including traditional behavioral weight loss, surgery, acceptance-based programs, and internet weight-loss interventions; second, by considering the impact of weight loss on quality of life through the lens of specific demographics, specifically female, child, and elderly populations; and finally, by considering the impact of …

This report describes findings of changes over time attributable to the “Keeping Girls in Schools” study in Bangladesh that implemented skill-building activities for a two-year period in the districts of Chapainawabganj, Kushtia, and Sherpur. The project sought to bring about change in child marriage norms prevalent in the area by offering young girls a safe place to meet after school hours with mentors and teachers and to offer girls tutoring support and life-skills. The project was implemented by the Population Council with the cooperation of secondary schools in the community and was supported by UNICEF under the aegis of the …
Showing Up “More As My True Self”: Gender And Mushing In The United States, Cynthia Caron, Victoria Beyer
Showing Up “More As My True Self”: Gender And Mushing In The United States, Cynthia Caron, Victoria Beyer
Sustainability and Social Justice
Mushing exists in several forms: short and long-distance races, adventure tourism, recreation, and sport. While some scholars assert that gender does not influence a musher’s experience, this research, based on interviews with mushers, broadens understanding of how gender influences mushing and a musher’s sense of self. Nearly all research participants initially stated that gender is irrelevant in mushing; for example, in competitions, people of all genders compete directly against one another. As interviews unfolded, participants spoke about how gender norms and stereotypes complicated their experiences and how non-mushers perceive them. Despite depictions of mushing as masculine, participants stated that mushing …

Marginality In Inquiry-Based Science Learning Contexts: The Role Of Exclusion Cascades, Karlyn Adams-Wiggins, Julia Sara Dancis
Psychology Faculty Publications and Presentations
Vygotskyan-inspired theories of learning have been applied in science education research, yet to more explicit attention to links between local social interactions and cultural-historical processes is needed advance critical theories of science learning. This microgenetic case study examined identity and motivation processes in a 7th grade inquiry science context with the goal of better historicizing these processes by describing the phenomenon of exclusion cascades in relation to two backgrounded cultural-historical processes, alienation and the social division of labor. Exclusion cascades highlighted the mutual constitution of competence and belonging. Implications are discussed with respect to challenging adaptationist ethos in science education.
Finding God On The Indian Road: Exploring The Intersectionality Between Native American And Christian Spiritual Living, Chad Johnson
Finding God On The Indian Road: Exploring The Intersectionality Between Native American And Christian Spiritual Living, Chad Johnson
Doctor of Ministry Projects and Theses
Drawing on the long and arduous history between the Indigenous people of the United States and the Christian church that colonists brought to them, this project works to address the harmful relationship of the past to establish a foundation for moving forward in a spirit of respect and reverence for Native American spiritual practices that have much to offer the Christian world of spiritual living. For centuries these two deeply spiritual worlds were told that they could not and would not co-exist. This project then draws deep attention to ways Native American spiritual practices have been misappropriated and trivialized over …
Lost Grounds In Us Trade Integration, John C. Beghin
Lost Grounds In Us Trade Integration, John C. Beghin
Cornhusker Economics
Growing World Trade Organization (WTO) membership and plurilateral trade agreements have increasingly occurred in the last 20 years leading to unprecedented market integration. However, in the last 5 years, the United States (US) has been diverging from its traditional role as a main driver of this integration. In contrast, Europe has been integrated progressively within itself and beyond, outpacing the US. The article documents these trends and changes. This article is based on a longer working paper and an article in EuroChoices coauthored with Jill O’Donnell.

Event-based landslide inventories are essential sources to broaden our understanding of the causal relationship between triggering events and the occurring landslides. Moreover, detailed inventories are crucial for the succeeding phases of landslide risk studies like susceptibility and hazard assessment. The openly available inventories differ in the quality and completeness levels. Event-based landslide inventories are created based on manual interpretation, and there can be significant differences in the mapping preferences among interpreters. To address this issue, we used two different datasets to analyze the potential of U-Net and machine learning approaches for automated landslide detection in the Himalayas. Dataset-1 is composed …

Domesticating Space: Media Production Pedagogy For The Empowerment Of Marginalized Youth, Maarit Jaakkola, Linda Sterno, Elias Fryk
Journal of Media Literacy Education Pre-Prints
This article inquires into the role of space in media and information literacy (MIL), especially when supporting learners’ production skills. The MIL framework is to a great extent focused on deconstruction of messages in a private position of reception, while the theoretical, didactic and ethical components of the production pedagogy are less developed. This multiple-case study analyses the situated agency of young people in a vulnerable position with regard to the spaces where agency is sustained. We develop the concept of production context into a more specific concept of production space and apply it to the film club in a …
